J&J affiliate LTL Management filed a bankruptcy plan in New Jersey late on Monday that details how the company intends to pay for different types of cancer patients in a bankruptcy settlement. Then J&J decided to go with the unlimited funding part of the deal but did not pledge to provide unlimited funding for cases. J&J claims that its revised financing arrangements with its subsidiary address the concerns of the appellate court, while supplying funds for claim payments. As if providing victims with less money will solve the overall issue.
Lawyers representing cancer victims who oppose the agreement counter this by arguing that the plaintiff is countering legal nonsense with legal absurdity: J&J fraudulently transferred $50 billion of assets from LTL Management to circumvent the appeals court’s earlier decision. The hyperbole wasn’t spared by the victims’ lawyers, who call it the most significant “fraudulent transaction ever in United States history.”
Despite the legal jargon, J&J does not really believe this bankruptcy will be able to last. But it is a way of trying to push this $8.9 billion settlement, and to keep pressure on plaintiffs.
April 10, 2023 Update Bloomberg is running an intriguing report on a brand new law that has been passed in New Jersey that is shedding new light on litigation funding in the baby powder class action lawsuit. The funders who fund litigation Virage Capital Management and TRGP Capital invested in hundreds of lawsuits that were brought against Johnson & Johnson (J&J) over talc products in exchange in exchange for a portion of winnings. The involvement of funders is made public due to a New Jersey court rule requiring the release of certain details regarding outside funding backers.
