May 1st 2023 Update: A most frequently asked question is how plaintiffs and their lawyers be able to turn off $8.9 billion. Of course, it’s an immense amount of money. There are a lot of victims. Is talc safe for men. These are an excellent claims for plaintiffs. We have been reminded of this recently in two talc trials which have resulted in huge verdicts for the plaintiffs. Is talc safe for men. However, 75% of plaintiffs in the talc category, which is required to approve bankruptcy plans is not an easy task due to the sheer number of lawyers with huge collections of baby powder lawsuits that are opposed to the settlement.

April 25, 2023 Update: Talc patients have sought a court order to reject their Chapter 11 case filed by LTL Management LLC, a absurdly-made-up Johnson & Johnson subsidiary, declaring that the company isn’t financially troubled. LTL requested Chapter 11 to settle tens of thousands of claims that J&J’s baby products caused cancer. Is talc safe for men. LTL was denied Chapter 11 in January. 3rd Circuit dismissed its first Chapter 11 case in January in a ruling that said the company was not eligible for bankruptcy relief since it was unable to demonstrate financial trouble.
The claimants assert that LTL’s 2nd Chapter 11 case is an misuse of the bankruptcy system and that it’s being pursued in bad faith. J&J claims the bankruptcy settlement has “significant backing” from firms representing an estimated 60,000 claimants. It’s safe to say plaintiffs’ lawyers and victims ‘ lawyers are divided on the $8.9 billion deal.

The judge expressed his doubts about J&J’s absurd attempt to revive its strategy with a second bankruptcy case.
April 13th, 2023: Update on the major update is about the $8.9 billion over the course of 25 year period settlement offered. Lawyers representing cancer victims within MDL class action MDL Class Action have pledged to fight the settlement with Talc claimants. Why? They feel it’s not enough for 70 000 cancer patients. Is talc safe for men. The lawyers say that J&J should negotiate a bigger settlement or litigate individuals’ claims if the current bankruptcy is thrown out.
There is a different group of lawyers outside of the top leadership in that class action. The lawyers collectively have accumulated many thousands of cases. The group is seeking to settle today with what they believe is lower than what the victims should be paid. The argument they make is twofold. First, they argue that the settlement of around the equivalent of $100,000 per plaintiff – is fair.
This argument isn’t easy to prove. However, their second argument has more teeth: victims can now not wait and they want their money today.
April 12, 2023 Update: People are wondering if J&J could file for bankruptcy once more. The answer is complex and complex. However, let’s attempt to explain it clearly.
Johnson & Johnson asserts that bankruptcy is the only method to deal with both present and future talc litigations in a definitive manner. In other words, it thinks it will pay less when there is a bankruptcy component that applies pressure to negotiate a settlement. Is talc safe for men. Going back to 400 years of American time, the business asserts that bankruptcy benefits all parties because it distributes settlement payments more evenly and effectively than trial courts, which are where litigants get significant payouts, while others are left with nothing.
The gist in the 3rd Circuit decision was this isn’t a case that involves one that makes a profit, but a subsidiary to take the legal liability and declare bankruptcy – something Congress thought of when drafting its Bankruptcy Code. However, it also stated it was not in financial distress due to the fact that J&J promised unlimited funding.
Thus, J&J jumped on the unlimited funding part of the contract and didn’t make any promises to provide unlimited funding for lawsuits. The company claims that updated financing arrangements with its subsidiary addresses the concerns of the appellate court, while offering funds to pay claims. As if offering victims lower amounts of money would resolve the overall issue.
Attorneys representing cancer patients who oppose the agreement counter this argument by saying that it is a defense against legal nonsense by pointing out legal nonsense: J&J fraudulently transferred $50 billion in assets to LTL Management to circumvent the appeals court’s previous ruling. Hyperbole is not exempt: victims’ lawyers call this the biggest “fraudulent deal that has occurred in United States history.”
Notwithstanding the legal mumbo jumbo, J&J does not really believe that this bankruptcy will last. But it is a way of pushing this $8.9 billion settlement to keep the pressure on plaintiffs.
April 10 2023 update: Bloomberg offers an informative article on a new law in New Jersey that is shedding new light on the funding of litigation in the class action lawsuit. Litigation funders Virage Capital Management and TRGP Capital invested in hundreds of claims that were brought against Johnson & Johnson (J&J) concerning talc products in exchange for a portion of any wins. J&J is now offering that it will pay $8.9 billion to settle all lawsuits.
The involvement of funders is public information because of an New Jersey court rule requiring the disclosure of certain information about funders outside the state. This rule is intended to address the rising calls for regulation of litigation funders. J&J has more than 60,000 claims when you take into account state and federal child powder-related lawsuits. Third-party funding in mass tort claims is not without its pros and pros and. However, there is no doubt that we are seeing how third-party financing can help level the playing field between individual and large corporations in court.
April 4, 2023 Update: It is interesting to watch the worm turn in this legal battle. J&J was hit again this week when the Third Circuit denied J&J’s request to keep the automatic stay in place during the time that J&J appeals an appeal at the U.S. Supreme Court. Automatic stays have stopped the cases of talcum powder in a number of years and prevented new lawsuits from getting filed ever since J&J started the controversial process to spin the talc debts into a bankrupt subsidiary more than one year in the past. Is talc safe for men. After it was decided that the 3rd Circuit ruled that this bankruptcy was not legal some months ago, the stay was lifted. J&J had hoped to have it remain in effect until an appeal to the SCOTUS appeal. But, no.
April 1st, 2023 Update: Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. There is a chance that of the Supreme Court is willing even to consider the appeal? Low.
March 16th 2023 Update: With the bankruptcy stay now fully lifted, the first new cases have been filed and transferred into the Talcum Powder class action MDL in over one year. Seven new talc lawsuits were joined to the MDL in the last month, bringing the total number of cases that are pending to 37,522.
February 25 2023 Update The following information is available: A Congressmen from Tennessee is now calling for The U.S. Government Accountability Office (GAO) launch an investigation to determine how much J&J Talc products have cost the government in the decades.
A recent email to the GAO, Rep. Steven Cohen (D-Ten.) claimed that J&J of ignoring the dangers of its talc product for decades while tax dollars were utilized to treat people injured by exposure to the products. The suit comes just a few days after J&J’s major loss in the 3rd Circuit Court of Appeals.
Is talc safe for men. J&J must begin making fair settlement offers to victims, in order the process of putting all this behind it. It is a stain on one of the greatest firms.
February 14 2023 Update: In an appearance today at the hearing in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention to follow the third U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
