Lawyers representing cancer patients who do not agree with the agreement counter this by arguing that the plaintiff is a defense against legal nonsense by pointing out legal nonsense: J&J fraudulently transferred $50 billion of assets away from LTL Management to circumvent the appeals court’s earlier ruling. Hyperbole did not go unnoticed by the victims’ lawyers, who call it the most significant “fraudulent deal of assets in United States history.”
Notwithstanding the legal mumbo jumbo, J&J does not really believe that this bankruptcy will last. It is however a method of trying to push this $8.9 billion settlement to keep the pressure on plaintiffs.
