April 12 2023 Update: Many are asking how J&J could file for bankruptcy again. The answer is complex and complicated. Let’s try to clarify it clearly.
Johnson & Johnson asserts that bankruptcy is the only method to settle both present and future lawsuits involving talc conclusively. Also, it thinks it can get a lower rate if there is the bankruptcy element which applies pressure to negotiate a settlement. Is talc safe in face powder. Moving past the 400-year span of American history, the company asserts that bankruptcy benefits everyone by dispersing settlements more equally and efficiently than trial courts, in which some litigants receive substantial payouts, while others are left with nothing.
The essence in the 3rd Circuit decision was this isn’t a case that involves a profitable company making an affiliate to accept the legal responsibility and declare bankruptcy – something Congress contemplated when drafting the Bankruptcy Code. It also clarified that the subsidiary was not financially difficulty due to the fact that J&J assured it of unlimited funding.
So J&J decided to go with the funding unlimited part of the contract and didn’t promise to fund unlimited cases. The company says that its modified financing arrangements with its subsidiary addresses the concerns of the appeals court while offering funds to pay claims. As if offering victims lower amounts of money would resolve the underlying issue.
Lawyers representing cancer patients who oppose the agreement counter this by arguing that the plaintiff is countering legal nonsense legal absurdity: J&J fraudulently transferred $50 billion in assets away from LTL Management to circumvent the appeals court’s decision. The hyperbole wasn’t spared: victims’ lawyers call it the largest “fraudulent deal in United States history.”

The funders’ involvement is publicly available due to a New Jersey court rule requiring the disclosure of certain information regarding outside funding backers. The rules aim to tackle the growing demands for regulation of the litigation funders. J&J faces over 60,000 claims when you include state and federal Baby Powder lawsuits. Third-party funding in mass tort claims is not without its pros and pros and. There is no doubt that we are seeing how third-party funding could level the playing field between people and big corporations in court.

J&J suffered another setback this week, when the Third Circuit denied J&J’s request to maintain the automatic stay as J&J appeals a bankruptcy decision at the U.S. Supreme Court. February 25 2023 Update: A Congressmen from Tennessee has now demanded that be the U.S. Government Accountability Office (GAO) start an investigation into the amount J&J talc products have cost the government over the years.
in a letter addressed to the GAO, Rep. Steven Cohen (D-Ten.) has accused J&J of ignoring the risks of its talc products over years while tax dollars were spent on treating people who suffered injuries from exposure to the product. The lawsuit comes just a few weeks after J&J’s significant loss in the 3rd Circuit Court of Appeals.
