Lawyers representing cancer victims who do not agree with the agreement counter this by arguing that the plaintiff is countering legal nonsense with legal nonsense: J&J fraudulently transferred $50 billion of assets from LTL Management to circumvent the appeals court’s earlier ruling. Hyperbole was not spared by the victims’ lawyers, who call this the biggest “fraudulent transfer of assets in United States history.”
In spite of the legal jargon, J&J does not really believe this bankruptcy will be able to last. It is however a method of pushing this $8.9 billion settlement, and to keep the pressure on plaintiffs.
