J&J’s proposed settlement for talc would pay $400 million to US state AGs. Is Talc Still In Baby Powder .

Johnson & Johnson (JNJ.N) has set aside $400 million to resolve U.S. state consumer protection actions as part of a larger $8.9 billion settlement of claims that its Baby Powder as well as other talc items cause cancer. Is talc still in baby powder.

J&J company subsidiary LTL Management filed a bankruptcy plan in New Jersey late on Monday that details how the company intends to pay for different types of cancer victims as part of bankruptcy settlement. Is talc still in baby powder. J&J has declared that its Talc products are safe, and do not cause cancer. It’s trying for another time to settle more than 38,000 cases in bankruptcy and stop new cases from being filed in the future.
LTL’s bankruptcy plan will pay $400 million into an additional trust to settle claims made by state attorneys general claiming that J&J had violated the state’s unfair commercial practices and consumer protection laws through misleading consumers regarding the quality of its talc products.

Some states had started consumer protection cases against J&J before LTL’s first bankruptcy filing prevented these investigations from progressing in 2021. Is talc still in baby powder. New Mexico and Mississippi had already launched suits with Johnson & Johnson before then and the states of Arizona, Maryland, North Carolina, Texas and Washington had issued civil investigative subpoenas or demands, according to LTL’s court filings.

New Mexico and Mississippi have filed a petition to end LTL’s bankruptcy in a joint move with cancer victims as well as those affected by cancer and the U.S. Justice Department’s watchdog on bankruptcy, who have argued that a successful firm like J&J does not qualify for bankruptcy protections intended for those struggling with debt.
The first time LTL attempted to settle the bankruptcy lawsuits was rejected after the same arguments, when a U.S. appellate court ruled in favor of LTL had not been in “financial financial distress” and therefore not eligible of bankruptcy protection. Is talc still in baby powder. LTL made a new bankruptcy application just over two hours after the dismissal, saying that the second bankruptcy was different due to the fact that it had less money and more support for the settlement.

New Mexico and Mississippi said in their motion to dismiss LTL’s renewed bankruptcy violates the law enforcement powers of the state by trying to unilaterally cap LTL’s liability to state consumer protection measures.

LTL’s filings for the new year also contained additional details about the way in which the company will evaluate and pay cancer claims in the event that the bankruptcy plan is approved.

The highest payments under the settlement would be $500,000 for those diagnosed with cancer of the mesothelioma ovary before age 45. Is talc still in baby powder. The second payment would be $260,000 for those diagnosed with ovarian cancer that is terminal before age 45.

From there, the proposed settlement offers discounts based on the nature and severity of cancer, the individual’s age, the history of talc use and other factors. Is talc still in baby powder. For example the case of a woman who used talc products on a weekly basis, who had an ovarian cancer family history, cancer and was diagnosed with the stage 2 ovarian cancer at age 55 may qualify to receive a payout of $21,125 under the program.

Judge orders J&J and talc opponents to engage in settlement talks.

Following another hearing in Johnson & Johnson’s attempt to use a Texas Two-Step bankruptcy strategy for talc litigation and federal bankruptcy judge Michael Kaplan has ordered the company and those opposed to the move to conduct talks to reach a settlement, Bloomberg reports.

With its second bankruptcy bid for LTL Management–a subsidiary established by J&J to settle claims – the company offered a settlement of $8.9 billion. Is talc still in baby powder. While a firm representing plaintiffs is in favor of the deal, another group opposes the move.

Earlier this week, the opposition group, which is known as the Official Committee of Talc Claimants in the bankruptcy court, demanded to dismiss this case arguing that LTL is not a factor in financial distress.

“The filing is an incredibly legal and ineffective attempt by a tiny number of law firms to try to prevent claimants from voting on the resolution plan, a plan the vast and growing majority of claimants favor,” J&J’s litigation chief Erik Haas, said in a statement. Is talc still in baby powder. “The law firms behind the filing are pursuing financial interests which conflict with, diverge from and contravene those which their clientele. We will be submitting an answer in the appeals court.”

Is talc still in baby powder. Clay Thompson, a lawyer for MRHFM which boasts more than mesothelioma clients who have sued J&J for bankruptcy, told J&J’s second bankruptcy attempt will fail.

“J&J publishes press release about how wonderful its plan is while simultaneously requesting that details of the plan, such as what individual sick people would actually receive,” Thompson said in a statement. “What is J&J’s plan to cover up?”

Kaplan has instructed both sides to devise a second strategy for reorganization, under the oversight by two mediators.

The court in February of 2022 Kaplan confirmed J&J’s recourse to Chapter 11 to hasten a settlement that will free the company from the thousands of lawsuits concerning its talcum products.

In January of this year an appeals court in the United States overturned the decision, deciding that the company was not able to be considered to be in “financial trouble.”

The J&J’s plan to appeal to the U.S. Supreme Court was denied the same month, J&J applied for its first bankruptcy just two hours later. In response, Kaplan froze the lawsuits for 60 days to decide whether to allow an additional bankruptcy.

In the 2 Chapter 11 attempts, J&J has gotten 19 months of which cases were put in limbo. Is talc still in baby powder. The company would like claimants to vote on accepting their settlement. J&J will require 75% approval for the deal to go through.

In addition to the group of talc lawyers that criticized LTL’s bankruptcy plan, the U.S. Trustee which is a division that is part of the U.S. Department of Justice, also filed a motion to dismiss LTL’s second bankruptcy.

In a letter filed this week, U.S. trustee Andrew R. Vara wrote that the bankruptcy are “open to honest but unfortunate debtors.” These doors “are not accessible to those that don’t have a legitimate bankruptcy reason or want to use the bankruptcy process to delay or hinder their creditors.” Vara continued.

In its own words, J&J maintains there is no definitive evidence to suggest that its Talc products, which includes the famous baby powder, can cause cancer. J&J has taken its products off of the market, first to be available in North America in 2020–and the rest of the world later this year.

J&J is determined to stay clear of the expense of going to court. J&J has won the majority of cases decided in court, however certain losses have been harsh.

Overall, J&J has lost nine cases involving talc, which are appealing or concluded. Out of 41 trials 32 have ended in a win by J&J either through a mistrial or verdict of a plaintiff annulled in appeal. Johnson and Johnson Talcum Powder Lawsuit Update 2023 – Is Talc Still In Baby Powder

June 2 2023 Update: In an asbestos talc court trial held in California yesterday, technical issues disrupted the opening speech of defense lawyers. Is talc still in baby powder. Jurors who were watching at home via Zoom, did hear Johnson &Johnson’s lawyer express doubt about the 70s research that claimed asbestos was present in their product before the proceedings abruptly ended.

Meanwhile, the plaintiff was able to introduce their first witness, Arthur Langer. Langer said that the presence of additional minerals along with the talc mineral is a given. He also testified that his team informed J&J in the year 1971 about the presence of chrysotile asbestos in the talc produced by the company, although in just 0.1 percent. The asbestos was discovered by him in 1976.

June 1st, 2023 Update Is talc still in baby powder. The first trial since J&J made the decision to split its talc division, and then declare bankrupt marks an important turning point of the ongoing litigation story. Trial started on Monday in the heartbreaking case of a young, 24-year-old plaintiff, diagnosed with a rare and aggressive form of mesothelioma in the past year, a diagnosis lawyers on both sides believe is a tragic loss.

Opening statements revealed huge differences between the sides’ narrative. The attorney representing the plaintiff aimed his ire at Johnson & Johnson, alleging the use of misleading methods in their research practices as well as throughout the litigation process. According to the attorney, the company attempted to manipulate the definition of asbestos despite internal documents from 1978 and 1994 showing that asbestos fibers that were found in the tissues of the plaintiff are part of.

Johnson &J’s tangled $8.9 billion settlement deal hangs in the balance as we progress of this trial. Despite the particularity of this mesothelioma-related case and its distinct issues compared to the majority of talcum powder lawsuits, a verdict favoring the plaintiff could result in an enormous setback for J&J’s hope of gaining broad acceptance for their proposed settlement with plaintiffs.

May 31, 2023 Update: Johnson and Johnson’s bankrupted talc unit has was able to defend it’s second Chapter 11 filing in the face of challenges from talc injury claimants. In an objection submitted to the New Jersey bankruptcy court, the subsidiary argued that the filing differed fundamentally from the prior filing. It highlighted the extraordinary commitment of $8.9 billion by J&J, the largest settlement ever in any bankruptcy case that involves mass tort. Is talc still in baby powder. Not mentioned: how the amount of the settlement means it is an equitable settlement. J&J also claimed support from a variety of plaintiffs’ law firms representing more than 600,00 claimants. It is difficult to confirm but is probably incorrect.

May 24, 2023 Update: Since Johnson &J Johnson’s bankruptcy filing, the very first trial on its cosmetic talc products allegedly containing asbestos is set to start jury selection on Monday in California at Alameda County Superior Court, an historically reliable jurisdiction for plaintiffs. Plaintiff claims that mesothelioma resulted from asbestos exposure from J&J’s products and the company has denied. The trial also includes six retailers accused of selling talc products.

May 22, 2023 Update: Lawyers involved in the second J&J talc bankruptcy are battling over who should be appointed to the position of the future claims representative, which is vitally important to resolving the claim for talc. Is talc still in baby powder. Randi Ellis, a lawyer who is frequently involved in MDLs all over the nation was appointed the claims representative in the previous bankruptcy. J&J’s defense group wants Ellis to be appointed to that role in the future, however lawyers representing the plaintiffs in talc are arguing due to the fact that Ellis has conflicts of interest that should prevent her from being appointed to that post again. The issue stems from the reality that Ellis was apparently involved in the drafting of the highly contested second bankruptcy, which raises questions about her ability to be neutral. However, the reality is that this bankruptcy could be dismissed in the end.

May 17, 2023 Update The pretend company that J&J made up for the talc bankruptcy disclosed to an New Jersey bankruptcy court that they had allocated $400 million as a settlement for claims brought by states accusing J&J of misleading marketing for its talc-based products. Is talc still in baby powder. That’s an $8.5 billion settlement for cancer victims. It’s difficult to envision the scenario in which J&J can push the baby powder settlements in these figures. Although J&J’s $8.5 billion offer seems like a huge sum at first, it does not look great after you calculate the figures. The proposed settlement based on our rough calculations, would not offer victims anything more than an average settlement $100,000 per case. That’s not enough.

May 15, 2023, Update J&J could be facing lawsuit brought by an advocacy group representing cancer victims. Is talc still in baby powder. The group claims that J&J intentionally withdrew a $61.5 billion contract for funding in conjunction with its affiliate, LTL Management LLC, to simulate financial stress and to validate the company’s Chapter 11 bankruptcy filing. The group asserts this action is a fraud transfer of the rights of compensation for victims. They intend to investigate J&J’s actions as a result of the decision to dismiss LTL’s first bankruptcy case.

May 10 2023 Update: The following week this week, it is expected that the U.S. Bankruptcy Court in New Jersey will hear oral arguments on a motion to dismiss the second bankruptcy application of J&J subsidiary LTL Management. In the meantime, the bankruptcy has issued an Order which requires both sides to take part in a new settlement mediation to see if a global settlement deal can brokered.

May 5th, 2023: Update on Talc supplier Whittaker, Clark & Daniels filed for Chapter 11 bankruptcy due to numerous lawsuits alleging that its Talc products caused cancer from asbestos exposure. Is talc still in baby powder. Over 2700 people have sued the company and it has been spending $1 million a month to defend its legal position. The company’s recent $29 million settlement on the state of South Carolina forced it to apply for bankruptcy protection and argue for an equitable distribution of assets among talc claimants instead of being seized from the receiver. Other talc suppliers have also filed for bankruptcy due to lawsuits.

May 4, 2023, Update U.S. Bankruptcy Judge Michael Kaplan has directed Johnson & Johnson to reopen talks with lawyers who rebuffed Johnson & Johnson’s $8.9 billion deal. In Trenton, New Jersey yesterday the parties gathered in court to discuss the next steps for this second case of bankruptcy and Judge Kaplan encouraged further settlement talks.

This is the way to resolve these claims for J&J. A baby powder settlement could be completed. Is talc still in baby powder. But it’ll need more money – more billions of dollars – coming from Johnson & Johnson.

Lawyers are divided on whether to accept the proposal and not every client sees the issue in the same manner their lawyer sees it. A second bankruptcy proceeding is bound to fail the judge Kaplan has scheduled a hearing in June to decide if he will dismiss the bankruptcy for the second time.

May 3, 2023 Update The group of cancer victims who are suing Johnson & Johnson (J&J) demanded an order from J&J’s Third Circuit halt the bankruptcy filed by J&J subsidiary LTL Management, claiming it is a bid to stop the litigation involving talc products. The group representing the claimants has filed a motion this week asking the Third Circuit to consider their case and to send it back before a court of lower jurisdiction, with instructions for dismissing the bankruptcy. Is talc still in baby powder. They also asked that halted tort litigation against J&J should be permitted to continue.
LTL has filed for Chapter 11 protection once again following its bankruptcy filing that was denied by the Third Circuit earlier this year with a $8.9 billion settlement. The committee says that the recent ruling, which allows LTL’s second Chapter 11 to continue, in addition to halting trials against J&J, warrants immediate Third Circuit review. The US Trustee requested be the New Jersey bankruptcy court dismiss the LTL bankruptcy case. J&J’s vice president for global litigation, Erik Haas, was quoted by Bloomberg as saying that J&J intends to file a formal response in the appeals court characterizing the filing as a “desperate and legally insufficient move” by a few of law firms who have conflicts of financial interests.
May 1, 2023 Update: One question people keep asking is how could plaintiffs and their attorneys turn off $8.9 billion. Of course, that is quite a sum. There are a lot of victims. Is talc still in baby powder. These are an excellent cases for plaintiffs. We were reminded of this last week when two talc cases ended in large verdicts for plaintiffs. In February mesothelioma cases, a talcum powder trial in Oregon was settled with a verdict that was $18.1 million. The following month, a second mesothelioma trial involving talc was held for the court within South Carolina and resulted in a verdict of $29million in favor of plaintiff. It was the same defendant as in these cases: Whittaker, Clark & Daniels Inc., one of the most prominent manufacturers of talc in U.S.
April 30 2023 Update: In the year 2023, when J&J first attempted to drag the talcum powder lawsuit into bankruptcy, they came with an offer to reserve $2 billion to settle the case. This was an absurdly low amount. The talc plaintiffs had not agreed with the proposal. This time, J&J has increased the offer to $8.9 for talc-related plaintiffs if they agree to a bankruptcy settlement and they also have the support of a substantial part of the talc-related plaintiffs and their attorneys. Is talc still in baby powder. However, 75% of plaintiffs of talc are required for bankruptcy plan approval, it a tough road because of the number of lawyers who have massive inventory of baby powder-related lawsuits, opposed towards the agreement.

What could solve the impasse? More billions.
April 25 2023 Update: Talc patients have asked a judge to dismiss their Chapter 11 case filed by LTL Management LLC, a absurdly fabricated Johnson & Johnson subsidiary, declaring that the company isn’t financially troubled. LTL filed for Chapter 11 to settle tens of thousands of claims that J&J’s baby-powders caused cancer. Is talc still in baby powder. The 3rd Circuit dismissed its first Chapter 11 case in January in a ruling that said LTL was not a candidate for bankruptcy relief since it was unable to demonstrate financial distress.

The claimants argue that LTL’s Second Chapter 11 case is an misuse of the bankruptcy system, and that it’s being conducted in bad good faith. J&J claims the bankruptcy settlement receives “significant backing” from firms representing about 60,000 potential plaintiffs. It’s fair to say plaintiffs’ lawyers and victims ‘ lawyers are divided on their disagreement over the $8.9 billion settlement offer.

April 21st, 2023 Update A bankruptcy judge has decided in favor of Johnson & Johnson must face new lawsuits alleging that it sold tainted baby powder causing cancer. Although the trials for the talc lawsuits have been suspended for at least 60 days however, new lawsuits may be filed, and lawyers can begin preparing their cases. Is talc still in baby powder. Judges expressed skepticism about J&J’s pathetic attempt to revive its strategy by filing a second bankruptcy trial.

April 13, 2023 Update: most important announcement is an $8.9 billion over the course of 25 years of settlement. Lawyers representing cancer patients involved in the MDL collective action pledged to fight the settlement with the talc claimants. Why? They believe it’s not enough to pay for those suffering from cancer who are 70,000. Is talc still in baby powder. They argue that J&J should negotiate a larger settlement or settle individual claims if the most recent bankruptcy is declared unconstitutional.

But there’s a separate group of lawyers that is not part of the leadership of that class action. These lawyers have collectively amassed the equivalent of tens of thousands of lawsuits. The group is seeking to settle for what is believed to be less than the victims deserve. The argument they make is twofold. First, they argue the settlement – about an average of $100,000 per plaintiff is fair.

That is a hard argument to make. The second argument is more force: the victims can be no longer patient and demand to get their money right now.

April 12 2023 Update: People are seeking out how J&J is able to file for bankruptcy once more. The answer is complex and complex. But let’s try to explain it in simple terms.
Johnson & Johnson asserts that bankruptcy is the only way to address both present and future talc-related lawsuits definitively. Also, it believes it can pay less in the event of the bankruptcy element which applies pressure to settle. Is talc still in baby powder. In a quest to cover more than 400 years in American past, the company believes that bankruptcy is beneficial to all parties as it distributes settlement payments more equitably and more efficiently than trial courts in which some litigants receive substantial settlements while others get nothing.

The basic tenet in this 3rd Circuit decision was this is not a matter of an enterprise that is profitable, forming an entity to assume the legal responsibility and declare bankruptcy – Congress contemplated when drafting the Bankruptcy Code. However, the court also ruled it was not in financial trouble because J&J offered unlimited financing.
This is why J&J did not hesitate to take advantage of the unlimited funding portion of the contract but did not pledge that it would provide unlimited funds for lawsuits. J&J claims that its modified financing arrangements with its subsidiary address concerns of the appellate court, while offering funds to pay claims. As if offering victims less money would solve the problem at hand.

Lawyers representing cancer victims who do not agree with the agreement counter this by arguing that the plaintiff is countering legal nonsense with legal nonsense: J&J fraudulently transferred $50 billion of assets from LTL Management to circumvent the appeals court’s earlier ruling. Hyperbole was not spared by the victims’ lawyers, who call this the biggest “fraudulent transfer of assets in United States history.”

In spite of the legal jargon, J&J does not really believe this bankruptcy will be able to last. It is however a method of pushing this $8.9 billion settlement, and to keep the pressure on plaintiffs.

April 10, 2023 update: Bloomberg provides an insightful piece on a law that has been passed in New Jersey that is shedding new light on the funding of litigation in the plaintiffs in the class action. Funders for litigation Virage Capital Management and TRGP Capital invested in hundreds of lawsuits from Johnson & Johnson (J&J) regarding talc products, in exchange for a portion of any profits. J&J is now offering to pay $8.9 billion to settle any lawsuits.

The funders’ involvement is public information because of a New Jersey court rule requiring the disclosure of certain information regarding outside funding backers. The rule aims to respond to the increasing calls for the regulation of litigation funders. J&J has to deal with more than 60,000 lawsuits when you take into account state and federal infant powder litigation. Third-party funding of mass tort cases is not without its pros and pros and. However, there is no doubt that we are witnessing the ways that third-party funding can even the playing field between individuals as well as large corporations in the courtroom.

April 4 2023 Update: It is fun to watch the worm turning in this lawsuit. J&J suffered another setback this week when the Third Circuit denied J&J’s request to continue the automatic stay during the time that J&J appeals a bankruptcy decision in the U.S. Supreme Court. It has frozen thousands of talcum powder cases and prevented new lawsuits from getting filed ever since J&J initiated the controversial effort to spin the talc liabilities off into a bankrupt subsidiary more than one year earlier. Is talc still in baby powder. When the 3rd Circuit ruled that this bankruptcy was insufficient only a few months back, the stay was removed. J&J was hoping to have it stayed in place until an appeal to the SCOTUS appeal. However, the answer was no.
April 1st, 2023 Update Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The likelihood that the Supreme Court is willing even to take up the appeal? Low.
March 16th 2023 Update: with the bankruptcy stay now officially lifted, the very first new cases have been filed and transferred into the class action involving talcum powder MDL in just over a year. Seven new talc cases were added to the MDL in the past month and brought the total number of pending cases up to 37,522.

February 25 2023 Update 2023 Update: A Congressmen from Tennessee is now requesting that The U.S. Government Accountability Office (GAO) begin an investigation into the cost J&J product containing talc has cost the government over the many years.
A recent email addressed to the GAO, Rep. Steven Cohen (D-Ten.) in a recent letter to the GAO, Rep. Steven Cohen (D-Ten. J&J of not recognizing the risks of its talc products for decades while tax dollars were spent on treating people who suffered injuries from exposure to the product. This lawsuit comes a few weeks following J&J’s dramatic loss in the 3rd Circuit Court of Appeals.

Is talc still in baby powder. J&J needs to start making fair settlement offers to victims to the process of putting all this behind. It’s a mark on one of the greatest firms.

February 14 , 2023 Update: At an earlier hearing at the hearing in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention to follow the third U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
