Johnson & Johnson asserts that bankruptcy is the only method to resolve both current and future talc litigations in a definitive manner. Also, it thinks it can get a lower rate if there is the bankruptcy element which applies pressure to settle. Going back to 400 years of American past, the company believes that bankruptcy is beneficial to all parties as it distributes settlement payments more evenly and effectively than trial courts, where some litigants receive significant settlements while others get nothing.
