J&J affiliate LTL Management filed a bankruptcy plan in New Jersey late on Monday that details how the company intends to pay for different types of cancer victims in an arrangement for bankruptcy. April 13th 2023 Update: major update is about the $8.9 billion over the course of 25 years of settlement. Johnson & Johnson asserts that bankruptcy is the only option to deal with both present and future talc-related lawsuits definitively. In other words, it thinks it can get a lower rate in the event of an element of bankruptcy that puts pressure to negotiate a settlement. Is there an asbestos free talc. Going back to the 400-year span of American time, the business argues that bankruptcy benefits all parties because it distributes settlement payments more evenly and effectively than trial courts where some litigants receive significant settlements while others get nothing.

Lawyers representing cancer victims who oppose the agreement counter this argument by saying that it is a defense against legal nonsense by pointing out legal absurdity: J&J fraudulently transferred $50 billion in assets to LTL Management to circumvent the appeals court’s ruling. Hyperbole did not go unnoticed the lawyers representing victims call it the most significant “fraudulent transfer that has occurred in United States history.”
Despite all the legal jargon, J&J does not really believe that this bankruptcy will last. But it is a way of pushing this $8.9 billion settlement and keep pressure on plaintiffs.
April 10, 2023 update: Bloomberg is running an intriguing article about a new law of New Jersey that is shedding new light on the funding of litigation in the class action lawsuit. The funders who fund litigation Virage Capital Management and TRGP Capital invested in hundreds of lawsuits in the case of Johnson & Johnson (J&J) over talc products in exchange for a percentage of any profits. J&J has now offered an offer of $8.9 billion to settle all lawsuits.
The involvement of the funders is publicly available because of an New Jersey court rule requiring the disclosure of certain information about outside funding backers. This rule is intended to tackle the growing demands for regulation of the litigation funders. J&J has more than 60,000 claims when you take into account state and federal child powder-related lawsuits. Third-party funding of mass tort cases has both pros and cons. There is no doubt that we are seeing how third-party funding could level the playing field between individual and big corporations in the courtroom.

February 25 2023 Update This morning, a Congressmen from Tennessee is now requesting that the U.S. Government Accountability Office (GAO) initiate an investigation into how much J&J product containing talc has cost the government over the many years.
In a recent letter to the GAO, Rep. Steven Cohen (D-Ten.) accused J&J of failing to recognize the dangers of its talc product for many years, while tax dollars were utilized to treat people injured by exposure to the products. The lawsuit comes just a few weeks after J&J’s significant loss in the 3rd Circuit Court of Appeals.
