Johnson and Johnson and talc. “The law firms that are behind this filing have financial interests that conflict with, contradict and oppose the interests of their clients. May 1, 2023 Update: One most frequently asked question is how could plaintiffs and their lawyers be able to turn off $8.9 billion. Of course, that’s a lot of money. But there are a lot of victims. Johnson and Johnson and talc. These are an excellent arguments for plaintiffs. We were reminded of this last week when two talc cases have resulted in huge verdicts for plaintiffs. Johnson and Johnson and talc. However, 75% of plaintiffs in the talc category, which is required for bankruptcy plan approval is not an easy task because of the number of lawyers who have vast inventory of baby powder-related lawsuits, opposed in favor of the deal.
What can be done to end the impasse? More billions.
April 25 2023 Update: Talc patients have demanded a judge disqualify the Chapter 11 case filed by LTL Management LLC, a ridiculously made-up Johnson & Johnson subsidiary, insisting that the company is not financially strained. LTL applied for Chapter 11 to settle tens of thousands of claims that J&J’s baby powders cause cancer. Johnson and Johnson and talc. In the end, however, the 3rd Circuit dismissed its first Chapter 11 case in January in a ruling that said the company wasn’t eligible for bankruptcy relief since it did not show financial distress.
The claimants assert that LTL’s Second Chapter 11 case is an overreach of the bankruptcy system and that it’s being conducted in bad faith. J&J states that the bankruptcy settlement is backed by “significant backing” from companies representing about 60,000 potential claimants. It’s fair to say that lawyers representing plaintiffs and victims ‘ lawyers are divided on this $8.9 billion settlement offer.

While trials in Talc lawsuits are suspended for at least 60 calendar days and new lawsuits are able to be filed and lawyers can begin preparing their cases. Johnson and Johnson and talc. Judges expressed skepticism about J&J’s attempt to revive its plan with a second bankruptcy case.
April 13th 2023 update: the major update is about the $8.9 billion over the next 25 years offer for settlement. Lawyers representing cancer victims within the MDL class action have promised to fight the settlement along with those who claim talc. Why? They argue that it’s too little money for the more than 70,000 cancer victims. Johnson and Johnson and talc. They argue that J&J should negotiate a bigger settlement or pursue individual claims if the most recent bankruptcy is thrown out.
There is a different group of lawyers that is not part of the top leadership in this class action. They have amassed tens of thousands of cases. This group wants to settle today with what they believe is far less than what these victims deserve. The argument they make is two-fold. The first is that they claim the settlement – about an average of $100,000 per plaintiff is fair.
This is an argument that is difficult to prove. The second argument is more teeth: victims can now not wait and they want to get their money right now.
April 12 2023 Update: Many are looking for ways J&J could file for bankruptcy again. The answer is complicated and confusing. Let’s try to clarify it in simple terms.
Johnson & Johnson asserts that bankruptcy is the only option to resolve both current and future lawsuits involving talc conclusively. In other words, it thinks it will pay less should there be the bankruptcy element which applies pressure for a settlement. Johnson and Johnson and talc. Moving past 400 years of American history, the company argues that bankruptcy benefits all parties because it distributes settlements more equally and effectively than trial courts in which some litigants receive substantial awards while others receive nothing.
The basic tenet in this 3rd Circuit decision was this is not a matter of a profitable company making an entity to assume the legal responsibility and declare bankruptcy, which is what Congress had in mind when it came to drafting the Bankruptcy Code. It also clarified it was not in financial crisis due to the fact that J&J promises unlimited funding.
Then J&J did not hesitate to take advantage of the unlimited funding aspect of the agreement and didn’t make any promises to offer unlimited funding for cases. The company claims that modified financing arrangements with its subsidiary will address concerns of the appellate court, while offering claim payment funds. In the hope that offering victims lesser money could solve the underlying issue.
Lawyers representing cancer victims who do not agree with the agreement counter the agreement with what is countering legal nonsense with legal nonsense: J&J fraudulently transferred $50 billion of assets from LTL Management to circumvent the appeals court’s decision. Hyperbole was not spared: victims’ lawyers call this the biggest “fraudulent transaction ever in United States history.”
Despite all the legal jargon, J&J does not really believe that this bankruptcy will last. But it is a way of trying to push this $8.9 billion settlement to keep the pressure on plaintiffs.
April 10, 2023 Update Bloomberg has an interesting piece on a law that has been passed in New Jersey that is shedding new light on litigation funding in the baby powder suit for class actions. Funders of litigation Virage Capital Management and TRGP Capital invested in hundreds of lawsuits from Johnson & Johnson (J&J) concerning talc products in exchange in exchange for a portion of profits. J&J has now offered to pay $8.9 billion to settle any lawsuits.
The involvement of the funders is publicly available due to the New Jersey court rule requiring the disclosure of certain information regarding outside funding backers. This rule is intended to tackle the growing demands for regulation of litigation funders. J&J faces over 60,000 claims when you combine state and federal Baby Powder lawsuits. Third-party funding for mass tort lawsuits is not without its pros and pros and. But there is no question that we are witnessing how third-party funding can level the playing field between people and large corporations in the courtroom.
April 4 2023 Update: It is fun to watch the worm turn in this legal battle. J&J was hit again this week when it was found that the Third Circuit denied J&J’s request to extend the automatic stay during the time that J&J appeals an appeal before the U.S. Supreme Court. Automatic stays have halted the cases of talcum powder in a number of years and prevented new lawsuits from being filed ever since J&J initiated the controversial effort to spin the talc debts into a bankrupt company over one year in the past. Johnson and Johnson and talc. When it was decided that the 3rd Circuit ruled that this bankruptcy was not valid just a few months ago the stay was revoked. J&J wanted to see it remain in effect until an appeal to the SCOTUS appeal. But, no.
April 1st, 2023 Update Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The odds that the Supreme Court is willing even to consider the appeal? Low.
March 16th, 2023 Update: with the bankruptcy stay being in effect, the first new cases have been filed and transferred into the class action for talcum powder MDL in just over a year. Seven new talc lawsuits have been brought into the MDL during the month of March which brings the total number of cases in the pending process up to 37,522.
February 25 2023 Update The following information is available: A Congressmen from Tennessee is now demanding that the U.S. Government Accountability Office (GAO) start an investigation into how much J&J product containing talc has cost the government in the decades.
A recent email to the GAO, Rep. Steven Cohen (D-Ten.) accused J&J of not recognizing the risks of its talc-based products for long while tax dollars utilized to treat people injured by exposure to the products. The demand comes just weeks after J&J’s significant loss in the 3rd Circuit Court of Appeals.
Johnson and Johnson and talc. J&J has to begin making reasonable settlements to victims, in order to put all of this behind. This is a blemish on one of the world’s greatest businesses.
February 14 2023 Update: During the hearing held today in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention in light of the 3rd U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
