Johnson & Johnson asserts that bankruptcy is the only means to address both present and future talc lawsuits conclusively. Hyperbole did not go unnoticed by the victims’ lawyers, who call it the largest “fraudulent move that has occurred in United States history.”
Notwithstanding the legal mumbo jumbo, J&J does not really think this bankruptcy will survive. However, it’s a means of pushing this $8.9 billion settlement through and maintain the pressure on plaintiffs.
