J&J’s defense attorneys want Ellis to be appointed in that position yet again, but the lawyers for the plaintiffs in talc are arguing due to the fact that Ellis has a conflict of interest which should stop her from assuming that position again. This conflict is rooted in the reality that Ellis was believed to have been involved in the creation of the hotly contested second bankruptcy, which raises concerns about her capacity to be neutral. The reality is the bankruptcy will be dismissed in the end.

Although J&J’s $8.5 billion offer might seem like a lot initially, it will not look great after you calculate the figures. This is the answer to resolve these claims for J&J. The baby powder settlement is likely to be achieved. Johnson and Johnson lawsuit appeal. However, it’ll require additional money – perhaps billions of dollars – coming from Johnson & Johnson.

May 3, 2023 Update: A group representing cancer victims who are suing Johnson & Johnson (J&J) asked that the Third Circuit halt the bankruptcy filed by J&J subsidiary LTL Management, claiming it is an attempt to derail litigation regarding talc-related products. Johnson and Johnson lawsuit appeal. They also asked that stoppage of tort litigation against J&J should be permitted to proceed.
LTL applied for Chapter 11 protection once again after its bankruptcy filing was rejected in the Third Circuit earlier this year, offering the possibility of an $8.9 billion payment. The committee argues that the recent ruling which allowed LTL’s third Chapter 11 to continue, as well as halting the trials against J&J, warrants immediate Third Circuit review. The US Trustee has also requested an New Jersey bankruptcy court dismiss the LTL bankruptcy case. J&J’s global vice president of litigation Erik Haas, was quoted by Bloomberg saying that J&J intends to file a reply in the appeals court, characterizing the filing as an “desperate and legally inadequate plan” by a select group of law firms who have competing financial interests.
May 1 2023 Update: One common question that people ask is how could plaintiffs and their attorneys turn around $8.9 billion. That’s of course an enormous amount of money. But there are a lot of victims. Johnson and Johnson lawsuit appeal. These are an excellent case for plaintiffs. We have been reminded of this recently in two talc trials which led to huge verdicts for the plaintiffs. In February mesothelioma, a talcum-based powder trial in Oregon ended in a verdict of $18.1 million. A month later, another mesothelioma trial involving talc was held for trials at South Carolina and resulted in a verdict of $29million in favor of plaintiff. Both cases were defended by Whittaker, Clark & Daniels Inc. one of the top manufacturers of talc in U.S.
April 30th 2023 Update: J&J initially tried to take the litigation over talcum powder into bankruptcy, it came with an offer to set aside $2 billion for settlements. It was a ridiculously small amount. None of the talc plaintiffs were in favor of the offer. However, this time, J&J has increased the offer to $8.9 in the event that the talc victims are willing to accept bankruptcy settlements and also has the support of a large portion of the talc plaintiffs and their attorneys. Johnson and Johnson lawsuit appeal. However, 75% of talc plaintiffs, which is needed for approval of the bankruptcy plan, it a tough road since there are so many lawyers with vast stocks of baby powder litigations opposed to the settlement.
What is the solution to this impasse? More billions.
April 25 2023, Update Talc plaintiffs have sought a court order to disqualify their Chapter 11 case filed by LTL Management LLC, a absurdly fabricated Johnson & Johnson subsidiary, saying the company is not financially distressed. LTL requested Chapter 11 to settle tens of thousands of claims that J&J’s baby powders caused cancer. Johnson and Johnson lawsuit appeal. LTL was denied Chapter 11 in January. 3rd Circuit dismissed its first Chapter 11 case in January The court ruled that the company was not eligible for bankruptcy relief as it did not show financial difficulties.
The plaintiffs argue that LTL’s second Chapter 11 case is an abuse of the bankruptcy system, and that the case is being handled in bad faith. J&J says the bankruptcy settlement has “significant support” from the firms that represent around 60,000 people who are claiming. It’s fair to say plaintiffs’ lawyers and victims are divided over this $8.9 billion settlement offer.
April 21st, 2023 Update A bankruptcy judge has ruled in favor of Johnson & Johnson must face new lawsuits claiming that the company sold tainted baby powder causing cancer. Even though trials for the talc lawsuits have been suspended for a minimum of 60 days, new lawsuits can be filed, and lawyers can begin preparing their cases. Johnson and Johnson lawsuit appeal. Judges expressed skepticism about J&J’s pathetic attempt to revive its strategy with the second bankruptcy case.
April 13th, 2023 update: the major news is the $8.9 billion over 25 years offer for settlement. Lawyers representing cancer patients within the MDL collective action vowed to challenge the settlement Talc claimants. Why? They argue that it’s too little money for the more than 70,000 cancer victims. Johnson and Johnson lawsuit appeal. The lawyers say that J&J should negotiate a bigger settlement or even litigate individual claims in the event that the latest bankruptcy is declared unconstitutional.
But there is another set of lawyers who are not part of the leadership in the class action. These lawyers have amassed hundreds of thousands of cases. The group is seeking to settle for what many argue is less than the victims deserve. Their argument seems to be two-fold. First, they argue that the settlement – which amounts to 100 million dollars on average per plaintiff is fair.
This argument isn’t easy to make. But their second argument has more substance: the victims will be no longer patient and demand their money today.
April 12, 2023 Update: People are wondering if J&J can go through bankruptcy again. The answer is complex and complex. But let’s try to explain it simply.
Johnson & Johnson asserts that bankruptcy is the only means to address both present and future talc-related lawsuits definitively. In other words, it believes it can pay less should there be an element of bankruptcy that puts pressure to negotiate a settlement. Johnson and Johnson lawsuit appeal. Going back to more than 400 years in American history, the firm claims that bankruptcy benefits everyone by dispersing settlement payments more equitably and effectively than trial courts, which are where litigants get significant awards while others receive nothing.
The gist in the 3rd Circuit decision was this is not a case of a profitable company making an affiliate to accept the legal risk and declare bankruptcy, which is what Congress thought of when drafting its Bankruptcy Code. However, the court also ruled that the entity was financially crisis because J&J offered unlimited financing.
Then J&J decided to go with the funding unlimited part of the holding but did not pledge to fund unlimited litigation. The company says that its revised financing arrangements with its subsidiary will address concerns of the appellate court, while providing funds for claims. In the hope that offering victims less money will solve the problem at hand.
Attorneys representing cancer patients who do not agree with the agreement counter this argument by saying that it is countering legal nonsense with legal nonsense: J&J fraudulently transferred $50 billion of assets from LTL Management to circumvent the appeals court’s earlier ruling. Hyperbole is not exempt by the victims’ lawyers, who call it the biggest “fraudulent deal of assets in United States history.”
Notwithstanding the legal mumbo jumbo, J&J does not really believe this bankruptcy will be able to last. However, it’s a means to push for this $8.9 billion settlement through and maintain the pressure on plaintiffs.
April 10, 2023 Update: Bloomberg provides an insightful report on a brand new law of New Jersey that is shedding new light on litigation funding in the baby powder plaintiffs in the class action. Funders of litigation Virage Capital Management and TRGP Capital invested in hundreds of claims from Johnson & Johnson (J&J) concerning talc products in exchange for a portion of any wins. J&J is now willing that it will pay $8.9 billion to settle lawsuits.
The involvement of funders is made public due to the New Jersey court rule requiring the disclosure of certain information regarding outside funding backers. The law is designed to respond to the increasing calls for the regulation of lawsuit funders. J&J has more than 60,000 claims when you take into account state and federal baby powder lawsuits. Third-party funding in mass tort claims is not without its pros and pros and. However, there is no doubt that we are witnessing how third-party financing can help level the playing field between people and large corporations in the courtroom.
April 4, 2023 Update: It is enjoyable to see the worm turning in this lawsuit. J&J has taken another blow this week, when they were denied by the Third Circuit denied J&J’s request to maintain the automatic stay while J&J appeals a bankruptcy decision in the U.S. Supreme Court. It has froze the cases of talcum powder in a number of years and stopped any new lawsuits from being filed ever since J&J initiated the controversial effort to spin the talc debts off into a bankrupt subsidiary over one year ago. Johnson and Johnson lawsuit appeal. When it was decided that the 3rd Circuit ruled that this bankruptcy was insufficient a few months ago, the stay was lifted. J&J wanted to see it continue in the meantime of its SCOTUS appeal. The answer was no.
April 1st, 2023 Update Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The likelihood that of the Supreme Court is willing even to consider the appeal? Low.

Seven new talc lawsuits have been brought into the MDL in the past month which brings the total number of cases that are pending to 37,522.
February 25 2023 Update This morning, a Congressmen from Tennessee is now requesting that be the U.S. Government Accountability Office (GAO) begin an investigation to determine how much J&J Talc products have cost the government over the decades.
Recently, in an open letter to the GAO, Rep. Steven Cohen (D-Ten.) claimed that J&J of failing to recognize the dangers of its talc products for years while tax dollars were spent treating those injured by exposure to the products. The lawsuit comes just a few weeks after J&J’s significant loss in the 3rd Circuit Court of Appeals.
