April 25, 2023 Update: Talc patients have asked a judge to dismiss the Chapter 11 case filed by LTL Management LLC, a absurdly made-up Johnson & Johnson subsidiary, saying the company is not financially troubled. It was the 3rd Circuit dismissed its first Chapter 11 case in January The court ruled that the company wasn’t eligible for bankruptcy relief because it did not show financial distress.

J&J claims the bankruptcy settlement receives “significant backing” from companies representing around 60,000 claimants. It’s fair to say that lawyers representing plaintiffs and victims ‘ lawyers are not united over this $8.9 billion settlement offer.

They argue that J&J should negotiate a larger settlement or pursue individual claims in the event that the latest bankruptcy is thrown out.
There is a different set of lawyers who are not part of the top leadership in the class action. The lawyers collectively have accumulated the equivalent of tens of thousands of lawsuits. The group is seeking to settle now for what is believed to be less than these victims deserve. Their argument appears to be twofold. They argue that the settlement of around 100 million dollars on average per plaintiff – is fair.
That is a hard argument to prove. The second argument is more force: the victims can no longer wait and want to get their money right now.
April 12 2023 Update: Many are asking how J&J is able to file for bankruptcy once more. The answer is complicated and complicated. But let’s try to explain it clearly.
Johnson & Johnson asserts that bankruptcy is the only way to address both present and future talc-related lawsuits definitively. In other words, it thinks it will pay less when there is an element of bankruptcy that puts pressure for a settlement. Johnson and Johnson settlement mesh. Going back to hundreds of years of American history, the firm argues that bankruptcy benefits all parties as it distributes settlement payments more evenly and effectively than trial courts which are where litigants get significant settlements while others get nothing.
The basic tenet in the 3rd Circuit decision was this is not a case – one that makes a profit, but an affiliate to accept the legal burden and declare bankruptcy – something Congress contemplated when drafting the Bankruptcy Code. It also clarified the company was in financial difficulty due to the fact that J&J promises unlimited funding.
Thus, J&J jumped on the unlimited funding portion of the holding and didn’t make any promises to fund unlimited litigation. The company claims that new financing agreements with its subsidiary address the appeals court’s concerns while still supplying funds for claim payments. It’s as if giving victims lower amounts of money would resolve the overarching problem.
Lawyers representing cancer patients who oppose the deal counter this by arguing that the plaintiff is countering legal nonsense legal absurdity: J&J fraudulently transferred $50 billion in assets to LTL Management to circumvent the appeals court’s earlier decision. Hyperbole was not spared by the victims’ lawyers, who call it the most significant “fraudulent transaction ever in United States history.”
In spite of the legal jargon, J&J does not really believe this bankruptcy will be able to last. But it is a way to push for this $8.9 billion settlement through and maintain the pressure on plaintiffs.
April 10, 2023 Update Bloomberg has an interesting report on a brand new law of New Jersey that is shedding new light on the funding of litigation in the baby powder plaintiffs in the class action. The funders who fund litigation Virage Capital Management and TRGP Capital invested in hundreds of lawsuits against Johnson & Johnson (J&J) on behalf of talc products. They exchanged for a percentage of any winnings. J&J is now offering to pay $8.9 billion to settle lawsuits.
The involvement of funders is public information because of a New Jersey court rule requiring the disclosure of certain information about funders outside the state. This rule is intended to respond to the increasing calls for regulation of the litigation funders. J&J faces over 60,000 claims when you take into account federal and state Baby Powder lawsuits. Third-party funding for mass tort lawsuits has pros and pros and. But there is no question that we are seeing how third-party funding can level the playing field between individual and large corporations in court.
April 4, 2023 Update: It’s interesting to watch the worm turn in this legal battle. J&J took another hit this week, when they were denied by the Third Circuit denied J&J’s request to continue the automatic stay while J&J appeals a bankruptcy decision at the U.S. Supreme Court. This automatic stay froze thousands of talcum cases and prevented new lawsuits from arising ever since J&J initiated the controversial effort to spin the talc debts off into a bankrupt subsidiary over one year back. Johnson and Johnson settlement mesh. When it was decided that the 3rd Circuit ruled that this bankruptcy was not valid just a few months ago the stay was revoked. J&J was hoping to have it continued pending its SCOTUS appeal. But, no.
April 1st, 2023 Update Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The odds that for the Supreme Court is willing even to hear the appeal? Low.

J&J of ignoring the risks of its talc products for long while tax dollars spent on treating people who suffered injuries from exposure to the product.
