Attorneys representing cancer victims who are against the agreement argue the agreement with what is a defense against legal nonsense by pointing out legal nonsense: J&J fraudulently transferred $50 billion of assets away from LTL Management to circumvent the appeals court’s earlier decision. Hyperbole is not exempt by the victims’ lawyers, who call it the most significant “fraudulent deal that has occurred in United States history.”

Despite the legal jargon, J&J does not really think this bankruptcy will survive. It is however a method of pushing this $8.9 billion settlement and keep the pressure on plaintiffs.

April 10 2023 Update Bloomberg is running an intriguing article about a new law of New Jersey that is shedding new light on the funding of litigation in the baby powder class action lawsuit. Litigation funders Virage Capital Management and TRGP Capital invested in hundreds of lawsuits from Johnson & Johnson (J&J) over talc products in exchange for a percentage of any settlements.
