On February 20, 2022 Kaplan acknowledged J&J’s use of Chapter 11 to hasten a settlement that would free J&J from the hundreds of thousands of claims regarding its talcum products.

The opening statements exposed the stark differences in each side’s story. The attorney representing the plaintiff took aim at Johnson & Johnson, alleging the use of misleading tactics in research practices and throughout the litigation process. As per the lawyer the company attempted to manipulate the definition of asbestos in spite of internal documents dating from 1978 and 1994 showing that fibers discovered in the tissues of the plaintiff are part of.

The trial also includes six retailers who are accused of selling talc-containing products.
May 22, 2023 Update: Lawyers involved in the 2nd J&J talc bankruptcy are disputing who should be chosen to fill the role of a future claims representative. This is which is vitally essential to the resolution of the Talc claims. Lawsuit on Johnson and Johnson vaccine. Randi Ellis, a lawyer who frequently appears in MDLs throughout the United States was appointed as the claims representative during the first bankruptcy. J&J’s defense team wants Ellis to be appointed to that role yet again, but the lawyers for the talc plaintiffs have raised objections on the grounds that Ellis has conflicts of interest that should prevent her from assuming that position for the second time. The dispute stems from reality that Ellis was reportedly involved in the drafting of the highly contesting second bankruptcy, which raises questions about her capability to remain neutral. It’s true that this bankruptcy is likely to get dismissed anyway.

It is hard to imagine any scenario in which J&J will be able to push the settlements of baby powder through with these numbers. While J&J’s proposed $8.5 billion offer sounds like a lot initially, it may not appear appealing when you do the math. This settlement proposal – by our rough calculations would not offer victims anything more than an average settlement $100,000 per case. That is not enough.
May 15 2023 update: J&J is potentially facing a suit from an advocacy group representing cancer victims. Lawsuit on Johnson and Johnson vaccine. The group argues that J&J intentionally withdrew an $61.5 billion contract for funding in conjunction with its affiliate, LTL Management LLC, to create the appearance of financial hardship and confirm the unit’s Chapter 11 bankruptcy filing. The group asserts this action is a fraud transfer of the rights of victims’ compensation. They plan to explore J&J’s actions after the announcement of the denial of LTL’s first bankruptcy suit.
May 10 2023 Update: The following week, next week, the U.S. Bankruptcy Court in New Jersey will hear oral arguments regarding a motion to dismiss the second bankruptcy petition filed that was filed by J&J subsidiaries LTL Management. Other suppliers of talc have filed for bankruptcy due to legal proceedings.
May 4, 2023 Update: U.S. bankruptcy judge Michael Kaplan has directed Johnson & Johnson to restart negotiations with lawyers who rebuffed Johnson & Johnson’s $8.9 billion agreement. At Trenton, New Jersey yesterday, the parties appeared before a judge to discuss the next steps in their second bankruptcy matter. Judge Kaplan pushed more settlement talks.
This is the best way to resolve the claims of J&J. A baby powder settlement can get done. Lawsuit on Johnson and Johnson vaccine. But it’ll need more money – more billions of dollars by Johnson & Johnson.
Lawyers are split on whether to take the proposal or not and not every client views this issue the same way their lawyer does. A second bankruptcy proceeding is likely to be a failure the judge Kaplan has scheduled a hearing in June to decide whether to remove the bankruptcy after the second.
May 3, 2023 Update The group of cancer patients who have sued Johnson & Johnson (J&J) requested to have the Third Circuit halt the bankruptcy filed by J&J subsidiary LTL Management, claiming it attempts to block the litigation surrounding talc-based products. The group representing the claimants made a motion Tuesday asking the Third Circuit to consider their case and send it back before a court of lower jurisdiction, with instructions for dismissing the bankruptcy. Lawsuit on Johnson and Johnson vaccine. They also asked that the halted tort litigation against J&J continue to continue.
LTL applied for Chapter 11 protection once again following the bankruptcy filing it made earlier was rejected by the Third Circuit earlier this year which offered a $8.9 billion agreement. The committee says that the recent ruling allowing LTL’s second Chapter 11 to continue, while also halting trials against J&J, warrants urgent Third Circuit review. The US Trustee requested be the New Jersey bankruptcy court dismiss the LTL bankruptcy case. J&J’s vice president for global litigation, Erik Haas, was quoted by Bloomberg saying that J&J plans to file a reply in the appeals court, declaring the filing a “desperate and legally insufficient attempt” by a few of law firms who have conflicts of financial interests.
May 1 2023 Update: A frequently asked question is how could the plaintiffs’ lawyers and their clients turn around $8.9 billion. Of course, it’s an enormous amount of money. However, there are lots of victims. Lawsuit on Johnson and Johnson vaccine. They are a great case for plaintiffs. We were reminded of this recently when two talc cases have resulted in huge verdicts for the plaintiffs. In February, a talcum powder mesothelioma trial in Oregon was settled with a verdict worth $18.1 million. The following month, a second mesothelioma-related talc case went to trials on the other side of South Carolina and resulted in a verdict of $29million for the plaintiff. Both cases were defended by Whittaker, Clark & Daniels Inc. which is one of the largest producers of talc in the U.S.
April 30, 2023 Update: When J&J initially attempted to pull the lawsuit over talcum powder into bankruptcy, it came with an offer to reserve $2 billion for settlements. The amount was absurdly low. There was no one among the talc victims who supported it. However, this time, J&J has increased the offer to $8.9 in the event that the talc victims will allow a bankruptcy settlement and they have the support of a large portion of the talc plaintiffs and their lawyers. Lawsuit on Johnson and Johnson vaccine. But 75% of the plaintiffs in the talc category, which is required to approve bankruptcy plans is a difficult road because of the number of lawyers who have large inventory of baby powder-related lawsuits, opposed to the settlement.
What could solve the impasse? More billions.
April 25 2023, Update Talc patients have asked a judge to disqualify their Chapter 11 case filed by LTL Management LLC, a absurdly-made-up Johnson & Johnson subsidiary, saying the company is not financially troubled. LTL has filed for Chapter 11 to settle tens of thousands of claims that J&J’s baby powders caused cancer. Lawsuit on Johnson and Johnson vaccine. The 3rd Circuit dismissed its first Chapter 11 case in January in a ruling that said LTL was not eligible to receive bankruptcy relief because it did not show financial distress.
The plaintiffs argue that LTL’s 2nd Chapter 11 case is an misuse of the bankruptcy system and it’s being conducted in bad faith. J&J claims the bankruptcy settlement is backed by “significant backing” from the firms that represent approximately 60,000 plaintiffs. It’s safe to say that the plaintiffs’ attorneys and victims are divided over the $8.9 billion offer for settlement.
April 21st, 2023 Update A bankruptcy judge decided that Johnson & Johnson must face new lawsuits claiming that the company offered a baby powder with a contaminant that caused cancer. Although trials for the lawsuits involving talc are delayed for at least 60 days however, new lawsuits may be filed, and lawyers can begin preparing their cases. Lawsuit on Johnson and Johnson vaccine. Judges expressed skepticism about J&J’s absurd attempt to revive its plan with the second bankruptcy case.
April 13th 2023 Update: The major news is the $8.9 billion over 25 year period settlement offered. Lawyers representing cancer patients in the MDL class action have pledged to challenge the settlement talc claimants. Why? They believe it’s not enough to pay for more than 70,000 cancer victims. Lawsuit on Johnson and Johnson vaccine. These lawyers argue that J&J could negotiate a greater settlement or pursue individuals’ claims if the current bankruptcy is declared unconstitutional.
But there’s a separate lawyer group that isn’t part of the leadership of this class action. These lawyers have collectively amassed the equivalent of tens of thousands of lawsuits. The group is seeking to settle today for what is believed to be less than these victims deserve. Their argument is two-fold. They argue that the settlement – about an average of $100,000 per plaintiff – is fair.
This is an argument that is difficult to prove. But their second argument has more teeth: victims can now not wait and they want their money today.
April 12, 2023 Update: People are looking for ways J&J could file for bankruptcy once more. The answer is complex and confusing. Let’s try to clarify the issue in a simple way.
Johnson & Johnson asserts that bankruptcy is the only method to address both present and future lawsuits involving talc conclusively. That is, it thinks it will pay less if there is a bankruptcy component that applies pressure for a settlement. Lawsuit on Johnson and Johnson vaccine. Moving past 400 years of American time, the business asserts that bankruptcy benefits everyone by dispersing settlements more equally and more efficiently than trial courts which are where litigants get significant awards while others receive nothing.
The basic tenet of the 3rd Circuit decision was this is not a matter of one that makes a profit, but an entity to assume the legal risk and declare bankruptcy – Congress thought of when drafting its Bankruptcy Code. However, the court also ruled that the subsidiary was not in financial distress because J&J promises unlimited funding.
So J&J took advantage of the unlimited funding portion of the agreement and did not promise that it would provide unlimited funds for the litigation. The company claims that its modified financing arrangements with its subsidiary address the concerns of the appeals court while supplying funds for claim payments. It’s as if giving victims lesser money could solve the overall issue.
Lawyers representing cancer victims who oppose the deal counter this with what you conclude is a defense against legal nonsense by pointing out legal absurdity: J&J fraudulently transferred $50 billion of assets from LTL Management to circumvent the appeals court’s earlier ruling. The hyperbole wasn’t spared the lawyers representing victims call it the biggest “fraudulent transfer in United States history.”
Despite all the legal jargon, J&J does not really believe this bankruptcy will be able to last. It is however a method to try and push the $8.9 billion settlement to keep pressure on plaintiffs.
April 10, 2023 Update Bloomberg has an interesting report on a brand new law in New Jersey that is shedding new light on litigation funding in the Class action suit. Litigation funders Virage Capital Management and TRGP Capital invested in hundreds of claims from Johnson & Johnson (J&J) over talc products in exchange in exchange for a portion of winnings. J&J is now willing the payment of $8.9 billion in settlements for all lawsuits.
The funders’ involvement is public information due to an New Jersey court rule requiring the release of certain details about outside funding backers. The law is designed to tackle the growing demands for the regulation of lawsuit funders. J&J has more than 60,000 claims when you combine federal and state infant powder litigation. Third-party funding of mass tort cases has pros and cons. But there is no question that we are witnessing how third-party financing can help level the playing field between individual and big companies in court.
April 4, 2023 Update: It is fun to watch the worm turning in this legal battle. J&J was hit again this week, when it was found that the Third Circuit denied J&J’s request to keep the automatic stay in place while J&J appeals a bankruptcy ruling in the U.S. Supreme Court. Automatic stays have frozen thousands of talcum cases and stopped new lawsuits from being filed ever since J&J launched the controversial attempt to spin the talc debts off into a bankrupt subsidiary over a year earlier. Lawsuit on Johnson and Johnson vaccine. After the 3rd Circuit ruled that this bankruptcy was insufficient only a few months back, the stay was revoked. J&J wanted to see it continue in the meantime of its SCOTUS appeal. But, no.
April 1, 2023 Update: Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. There is a chance that is that the Supreme Court is willing even to accept the appeal? Low.
March 16th, 2023 Update: with the bankruptcy stay in effect, the first new cases were filed and incorporated into the Talcum Powder class action MDL in over one year. Seven new talc lawsuits have been joined to the MDL in the past month increasing the number of cases in the pending process up to 37,522.
February 25 2023 Update This morning, a Congressmen from Tennessee is now demanding that the U.S. Government Accountability Office (GAO) start an investigation to determine how much J&J products containing talc have cost the government in the years.
A recent email addressed to the GAO, Rep. Steven Cohen (D-Ten.) claimed that J&J of not recognizing the risks of its talc products over years while tax dollars were spent treating those injured by exposure to the product. This lawsuit comes a few weeks after J&J’s significant loss in the 3rd Circuit Court of Appeals.
Lawsuit on Johnson and Johnson vaccine. J&J has to begin making reasonable settlement proposals for victims in order in putting this behind it. This is a disgrace to one of the world’s greatest companies.
February 14 2023 Update: In the hearing held today at the hearing in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention following the ruling of 3rd U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
