Lawyers representing cancer victims who do not agree with the agreement counter this argument by saying that it is countering legal nonsense with legal nonsense: J&J fraudulently transferred $50 billion in assets to LTL Management to circumvent the appeals court’s previous ruling. Hyperbole is not exempt by the victims’ lawyers, who call this the biggest “fraudulent move in United States history.”
In spite of the legal jargon, J&J does not really think that the bankruptcy will endure. It is however a method of trying to push this $8.9 billion settlement to keep pressure on plaintiffs.
