Going back to 400 years of American history, the firm claims that bankruptcy benefits everyone by dispersing settlements more fairly and efficiently than trial courts, in which some litigants receive substantial settlements while others get nothing.
The main thrust in this 3rd Circuit decision was this is not a case of a profitable company making an entity to assume the legal responsibility and declare bankruptcy Congress considered when it was drafting the Bankruptcy Code. Thus, J&J decided to go with the unlimited funding part of the agreement and did not promise that it would provide unlimited funds for cases. Lawyers representing cancer victims who oppose the deal counter this argument by saying that it is countering legal nonsense with legal absurdity: J&J fraudulently transferred $50 billion of assets away from LTL Management to circumvent the appeals court’s ruling. Hyperbole did not go unnoticed: victims’ lawyers call it the biggest “fraudulent move that has occurred in United States history.”
Despite the legal jargon, J&J does not really believe that this bankruptcy will last. It is however a method of pushing this $8.9 billion settlement and keep the pressure on plaintiffs.
