J&J subsidiary LTL Management filed a bankruptcy plan in New Jersey late on Monday that details how the company will pay various types of cancer patients in a bankruptcy settlement. Johnson & Johnson asserts that bankruptcy is the only option to deal with both present and future lawsuits involving talc conclusively. Litigation funders Virage Capital Management and TRGP Capital invested in hundreds of claims against Johnson & Johnson (J&J) over talc products in exchange for a portion of any wins. J&J is now willing that it will pay $8.9 billion to settle all lawsuits.
The funders’ involvement is public knowledge due to the New Jersey court rule requiring the disclosure of certain information regarding outside funding backers.
