In a quest to cover the 400-year span of American history, the firm believes that bankruptcy is beneficial to everyone by dispersing settlement payments more equitably and effectively than trial courts which are where litigants get significant awards while others receive nothing.
The essence of this 3rd Circuit decision was this isn’t a case that involves a profitable company making an affiliate to accept the legal burden and declare bankruptcy – something Congress had in mind when it came to drafting the Bankruptcy Code. It also clarified that the subsidiary was not financially difficulty because J&J promised unlimited funding.
Thus, J&J did not hesitate to take advantage of the unlimited funding part of the contract and didn’t make any promises to fund unlimited cases. As if providing victims with lesser money could solve the overall issue.
Lawyers representing cancer patients who oppose the deal counter this argument by saying that it is countering legal nonsense with legal absurdity: J&J fraudulently transferred $50 billion in assets to LTL Management to circumvent the appeals court’s ruling. Hyperbole was not spared attorneys representing the victims claim this the biggest “fraudulent move of assets in United States history.”
