April 25 2023 Update Talc cancer claimants have demanded a judge dismiss their Chapter 11 case filed by LTL Management LLC, a ridiculously made-up Johnson & Johnson subsidiary, which claims that the business is not financially distressed. LTL has filed for Chapter 11 to settle tens of thousands of claims that J&J’s baby products caused cancer. Talc asbestos verdicts. LTL was denied Chapter 11 in January. 3rd Circuit dismissed its first Chapter 11 case in January in a ruling that said the company was not eligible for bankruptcy relief because it had not demonstrated financial stress.
The claimants argue that the third Chapter 11 case is an misuse of the bankruptcy system and that it’s being pursued in bad faith. J&J asserts that the bankruptcy settlement is backed by “significant backing” from companies representing about 60,000 potential people who are claiming. Driving past the 400-year span of American history, the company asserts that bankruptcy benefits everyone by dispersing settlements more equally and more efficiently than trial courts in which some litigants receive substantial awards while others receive nothing.
The gist of this 3rd Circuit decision was this is not a case of a profitable company making subsidiaries to meet the legal risk and declare bankruptcy Congress had in mind when it came to drafting the Bankruptcy Code. However, it also stated it was not in financial trouble due to the fact that J&J promises unlimited funding.
This is why J&J jumped on the funding unlimited part of the contract and did not promise to provide unlimited funding for litigation. The company claims that its updated financing arrangements with its subsidiary address the appeals court’s concerns, while offering funds to pay claims. As if offering victims lesser money could solve the overarching problem.
Attorneys representing cancer patients who oppose the agreement counter the agreement with what is countering legal nonsense with legal nonsense: J&J fraudulently transferred $50 billion in assets to LTL Management to circumvent the appeals court’s earlier ruling. J&J is now willing to pay $8.9 billion to settle all lawsuits.
The funders’ involvement is public knowledge because of the New Jersey court rule requiring the disclosure of certain information about funding sources outside of the. The rules aim to respond to the increasing calls for regulation of litigation funders. J&J has to deal with more than 60,000 lawsuits when you add up state and federal Baby Powder lawsuits. Third-party funding for mass tort lawsuits is not without its pros and cons. There is no doubt that we are seeing how third-party financing can help level the playing field between individual and big corporations in court.
April 4, 2023 Update: It is pleasing to see the worm turn in this lawsuit. J&J suffered another setback this week when they were denied by the Third Circuit denied J&J’s request to continue the automatic stay in the meantime that J&J appeals an appeal in the U.S. Supreme Court.
