Johnson & Johnson (JNJ.N) has set aside $400 million to settle U.S. state consumer protection actions as part of a broad $8.9 billion settlement of allegations that its Baby Powder and other talc items cause cancer. Talc causes cancer.

J&J subsidiary LTL Management filed a bankruptcy plan in New Jersey late on Monday that describes how the company intends to pay different types of cancer victims in bankruptcy settlement. It’s trying for a second time to resolve more than 38,000 lawsuits in bankruptcy and stop new cases from being filed in the near future.
LTL’s bankruptcy plans would deposit $400 million to an additional trust to settle claims made with state attorneys general claiming that J&J violated state unfair business practices as well as consumer protection laws through misleading consumers about the dangers of its talc products.

This week, the opposition group, dubbed”the Official Committee of Talc Claimants requested the bankruptcy court for dismissal of the matter arguing that LTL is not considered to be financially distressed.

“The filing is a desperate and legally ineffective attempt by a small number of law firms to stop claimants from voting on the resolution plan – a plan the vast majority of claimants favor,” J&J’s litigation chief Erik Haas, said in an announcement. We’ll soon submit a response before the court of appeals.”

April 13, 2023: Update on the biggest announcement is an $8.9 billion over 25 years of settlement. Lawyers representing cancer victims involved in the MDL group action promised to fight the settlement along with Talc claimants. Why? But there’s a separate lawyer group that isn’t part of the leadership group in this class action. These lawyers have collectively amassed many thousands of cases. April 12 2023 Update: Many are asking how J&J can file for bankruptcy once more. The answer is complicated and complicated. But let’s try to explain it simply.
Johnson & Johnson asserts that bankruptcy is the only way to settle both present and future talc litigations in a definitive manner. Also, it believes that it will be less expensive in the event of a bankruptcy element that creates pressure for a settlement. Talc causes cancer. Moving past the 400-year span of American past, the company believes that bankruptcy is beneficial to all parties because it distributes settlement payments more evenly and more efficiently than trial courts in which some litigants receive substantial awards while others receive nothing.

J&J claims that its updated financing arrangements with its subsidiary will address concerns of the appeals court while supplying funds for claim payments. It’s as if giving victims less money will solve the overarching problem.

Attorneys representing cancer patients who do not agree with the agreement counter this by arguing that the plaintiff is countering legal nonsense legal nonsense: J&J fraudulently transferred $50 billion of assets from LTL Management to circumvent the appeals court’s previous ruling. Hyperbole is not exempt: victims’ lawyers call it the most significant “fraudulent transaction in United States history.”

Notwithstanding the legal mumbo jumbo, J&J does not really believe this bankruptcy will be able to last. But it’s a way to push for this $8.9 billion settlement to keep the pressure on plaintiffs.

April 10 2023 Update Bloomberg is running an intriguing article on a new law within New Jersey that is shedding new light on the funding of litigation in the baby powder class action lawsuit. The funders who fund litigation Virage Capital Management and TRGP Capital invested in hundreds of lawsuits against Johnson & Johnson (J&J) concerning talc products in exchange in exchange for a portion of settlements. J&J is now willing that it will pay $8.9 billion to settle all lawsuits.

The involvement of the funders is publicly available due to the New Jersey court rule requiring the release of certain details about outside funding backers. The law is designed to address the rising calls for the regulation of litigation funders. J&J is facing more than 60,000 claims when you add up state and federal child powder-related lawsuits. Third-party funding of mass tort cases has both pros and cons. But there is no question that we are seeing how third-party financing can help level the playing field between people as well as large corporations in the courtroom.

March 16 2023 Update: with the bankruptcy stay now officially lifted, the first new cases have been filed and transferred into the Talcum Powder class action MDL within a year. Seven new talc-related lawsuits were brought into the MDL over the last month and brought the total number of cases pending to 37,522.

February 25 2023 Update: A Congressmen from Tennessee is now demanding that The U.S. Government Accountability Office (GAO) initiate an investigation into the cost J&J Talc products have cost the government over the many years.
A recent email addressed to the GAO, Rep. Steven Cohen (D-Ten.) claimed that J&J of ignoring the dangers of its talc-based products for years while tax dollars were spent treating those injured by exposure to the products. The demand comes just weeks after J&J’s significant loss in the 3rd Circuit Court of Appeals.
