Despite all the legal jargon, J&J does not really think that the bankruptcy will endure. But it’s a way to try and push the $8.9 billion settlement, and to keep the pressure on plaintiffs.

Funders of litigation Virage Capital Management and TRGP Capital invested in hundreds of claims against Johnson & Johnson (J&J) over talc products in exchange in exchange for a portion of winnings. J&J is now offering that it will pay $8.9 billion in settlements for all lawsuits.
The involvement of funders is public information because of an New Jersey court rule requiring the disclosure of certain information regarding outside funding backers.
