J&J company subsidiary LTL Management filed a bankruptcy plan in New Jersey late on Monday that outlines how the firm intends to pay different types of cancer victims as part of a bankruptcy settlement. May 22nd, 2023 Update: Lawyers involved in the 2nd J&J talc bankruptcy are now battling over who should be appointed to the role of future claims representative. The group representing claimants for talc filed a motion on Tuesday asking the Third Circuit to consider their case and send it back to a lower court, with instructions to discharge the bankruptcy. LTL filed for Chapter 11 protection once again following the bankruptcy filing it made earlier was rejected by the Third Circuit earlier this year, offering an $8.9 billion agreement. This time, J&J has increased the offer to $8.9 if the talc plaintiffs are willing to accept bankruptcy settlements and they also have the backing of a significant portion of the talc plaintiffs and their attorneys. April 21st, 2023 Update: A bankruptcy judge has ruled the company Johnson & Johnson must face new lawsuits alleging that the firm sold baby powder that was contaminated and causing cancer. April 13 2023: Update on the big announcement is an $8.9 billion over the course of 25 years offer for settlement. April 12, 2023 Update: People are asking how J&J could file for bankruptcy again. The answer is complex and complex. Let’s try to simplify the issue in a simple way.
Johnson & Johnson asserts that bankruptcy is the only method to settle both present and future talc litigations in a definitive manner. J&J claims that its updated financing arrangements with its subsidiary address concerns of the appellate court, while offering claim payment funds. In the hope that offering victims lesser money could solve the problem at hand.
Lawyers representing cancer patients who oppose the deal counter this by arguing that the plaintiff is countering legal nonsense with legal nonsense: J&J fraudulently transferred $50 billion in assets to LTL Management to circumvent the appeals court’s previous decision. Hyperbole is not exempt: victims’ lawyers call it the biggest “fraudulent move that has occurred in United States history.”
Despite the legal jargon, J&J does not really think this bankruptcy will survive. But it’s a way to push for this $8.9 billion settlement, and to keep the pressure on plaintiffs.
April 10 2023 Update: Bloomberg has an interesting article on a new law of New Jersey that is shedding new light on the funding of litigation in the plaintiffs in the class action. Litigation funders Virage Capital Management and TRGP Capital invested in hundreds of lawsuits from Johnson & Johnson (J&J) on behalf of talc products. They exchanged in exchange for a portion of wins. J&J has now offered an offer of $8.9 billion to settle any lawsuits.
The involvement of funders is public information because of the New Jersey court rule requiring the release of certain details about outside funding backers. The law is designed to tackle the growing demands for the regulation of litigation funders. J&J is facing more than 60,000 claims when you take into account federal and state Baby Powder lawsuits. in a letter to the GAO, Rep. Steven Cohen (D-Ten.) claimed that J&J of not recognizing the risks of its talc products for long while tax dollars used to treat those who were injured through exposure to the product. The lawsuit comes just a few weeks after J&J’s significant loss in the 3rd Circuit Court of Appeals.
