Johnson & Johnson (JNJ.N) has put aside $400 million to address U.S. state consumer protection actions as part of a broader $8.9 billion plan to settle allegations that it’s Baby Powder and other talc-based product causes cancer. Talc contain asbestos.
J&J affiliate LTL Management filed a bankruptcy plan in New Jersey late on Monday that describes how the company will pay various types of cancer patients in the bankruptcy settlement. J&J is seeking an additional time to conclude more than 38,000 lawsuits in bankruptcy, and to prevent any new cases from arising in the future.
LTL’s bankruptcy plan will pay $400 million to a separate trust for claims filed by state attorneys general claiming that J&J violated the state’s unfair commercial practices as well as consumer protection laws by misinforming consumers about the safety of its talc products.

April 12 2023 Update: Some people are seeking out how J&J can file for bankruptcy again. The answer is complicated and complicated. Let’s try to simplify it clearly.
Johnson & Johnson asserts that bankruptcy is the only means to deal with both present and future talc-related lawsuits definitively. Lawyers representing cancer patients who oppose the deal counter this argument by saying that it is countering legal nonsense legal nonsense: J&J fraudulently transferred $50 billion in assets to LTL Management to circumvent the appeals court’s ruling. The hyperbole wasn’t spared attorneys representing the victims claim it the biggest “fraudulent transfer of assets in United States history.”
In spite of the legal jargon, J&J does not really think this bankruptcy will survive. But it’s a way of trying to push this $8.9 billion settlement and keep pressure on plaintiffs.

The funders who fund litigation Virage Capital Management and TRGP Capital invested in hundreds of lawsuits from Johnson & Johnson (J&J) on behalf of talc products. They exchanged for a portion of any profits. J&J is now offering an offer of $8.9 billion in settlements for all lawsuits.
The involvement of funders is publicly available due to an New Jersey court rule requiring the disclosure of certain information about outside funding backers.
