J&J’s defense group wants Ellis to be appointed in that position yet again, but the lawyers for the talc plaintiffs are protesting because Ellis has a conflict of interest that should prevent her from assuming that position once more. While J&J’s $8.5 billion offer may seem like a lot of money initially, it will not look great when you look at the numbers. This settlement offer based on our estimates – will not provide victims with much more than a median settlement of $100,000 per case. That’s not enough.

This is the solution to settle these claims for J&J. The baby powder settlement is likely to be completed. Talc does it cause cancer. But it will require more money – more billions of dollars – by Johnson & Johnson.
Lawyers are divided over whether or not to accept the plan and not all clients see the issue the same way their lawyer sees it. A second bankruptcy proceeding is likely to go nowhere as Judge Kaplan has scheduled a hearing for June to determine whether to discharge the bankruptcy for the 2nd time.
May 3, 2023 Update The group of cancer victims suing Johnson & Johnson (J&J) demanded to have they request that the Third Circuit halt the bankruptcy filed by J&J subsidiary LTL Management, claiming it is an attempt to derail litigation over talc products. LTL has filed for Chapter 11 protection once again after its bankruptcy filing was rejected by the Third Circuit earlier this year with a $8.9 billion payment. The committee says that the recent ruling, which allows LTL’s second Chapter 11 to continue, and also stopping trials against J&J is a reason for an immediate Third Circuit review. The US Trustee also requested that an New Jersey bankruptcy court dismiss the LTL bankruptcy case. J&J’s global vice president of litigation Erik Haas, was quoted by Bloomberg saying that J&J intends to file a statement in the appeals court, saying that the filing is an “desperate and legally inadequate effort” by a select group of law firms that have conflicts of financial interests.
May 1st, 2023 Update: One question people keep asking is how could the plaintiffs’ lawyers and their clients turn off $8.9 billion. Of course, that’s an enormous amount of money. But there are a lot of victims. Talc does it cause cancer. These are an excellent cases for plaintiffs. We were reminded of this recently by two talc-related trials that have resulted in huge verdicts for the plaintiffs. In February, a talcum powder mesothelioma trial in Oregon ended in a verdict of $18.1 million. The following month, a second mesothelioma trial involving talc was held for trial in South Carolina and resulted in a verdict of $29million for the plaintiff. In both instances, the defendant was Whittaker, Clark & Daniels Inc. One of the leading producers of talc in the U.S.
April 30th, 2023 Update: When J&J first tried to bring the talcum powder litigation into bankruptcy, it did so with an offer to put aside $2 billion for settlements. The sum was ridiculously low. There was no one among the talc victims who supported it. This time, however, J&J has increased the offer to $8.9 for talc-related plaintiffs if they will allow a bankruptcy settlement and also has the support of a large part of the talc-related plaintiffs and their lawyers. Talc does it cause cancer. But with 75% of plaintiffs in the talc category, which is needed for approval of the bankruptcy plan is a difficult road with so many lawyers with huge inventories of baby powder lawsuits opposed in favor of the deal.
What could solve the impasse? More billions.
April 25, 2023 update: Talc patients have sought a court order to disqualify their Chapter 11 case filed by LTL Management LLC, a absurdly fabricated Johnson & Johnson subsidiary, which claims that the business is not financially strained. LTL requested Chapter 11 to settle tens of thousands of claims that J&J’s baby-powders caused cancer. Talc does it cause cancer. The 3rd Circuit dismissed its first Chapter 11 case in January, saying the company wasn’t eligible for bankruptcy relief as it had not demonstrated financial distress.
The claimants contend that the 2nd Chapter 11 case is an overreach of the bankruptcy system and that the case is being handled in bad faith. J&J claims the bankruptcy settlement receives “significant support” from the firms that represent about 60,000 potential people who are claiming. It’s fair to say that plaintiffs’ lawyers and victims are divided over the $8.9 billion offer for settlement.
April 21st, 2023 Update A bankruptcy judge has ruled that Johnson & Johnson must face new lawsuits claiming that the company sold tainted baby powder causing cancer. Although the trials for the talc lawsuits have been suspended for at least 60 days but new lawsuits can be filed, and lawyers will begin preparing their cases. Talc does it cause cancer. The judge expressed his doubts about J&J’s attempt to revive its plan with another bankruptcy case.
April 13, 2023 Update: most important update is about the $8.9 billion over the next 25 years of settlement. Lawyers representing cancer victims within MDL class action MDL collective action vowed to fight the settlement alongside the talc claimants. Why? They feel it’s too little money for the more than 70,000 cancer victims. Talc does it cause cancer. These lawyers argue that J&J could negotiate a greater settlement or even litigate individual claims if the latest bankruptcy is dismissed.
But there’s a separate group of lawyers that is not part of the leadership group in group action. The lawyers collectively have accumulated tens of thousands of cases. They want to settle today with what they believe is less than the victims deserve. Their argument appears to be two-fold. First, they argue that the settlement – which amounts to 100,000 dollars per plaintiff – is fair.
It’s a difficult argument to make. The second argument is more force: victims should be no longer patient and demand their money today.
April 12 2023 Update: Many are asking how J&J is able to file for bankruptcy again. The answer is complicated and complicated. Let’s try to clarify it clearly.
Johnson & Johnson asserts that bankruptcy is the only option to deal with both present and future talc lawsuits conclusively. That is, it believes it can pay less when there is an element of bankruptcy that puts pressure to negotiate a settlement. Talc does it cause cancer. Driving past 400 years of American time, the business argues that bankruptcy benefits all parties because it distributes settlements more equally and effectively than trial courts in which some litigants receive substantial settlements while others get nothing.
The main thrust of the 3rd Circuit decision was this is not a matter of an enterprise that is profitable, forming a subsidiary to take the legal liability and declare bankruptcy Congress had in mind when it came to drafting the Bankruptcy Code. But it also said the company was financially distress due to the fact that J&J promises unlimited funding.
This is why J&J jumped on the funding unlimited part of the agreement and did not promise to fund unlimited cases. J&J claims that its revised financing arrangements with its subsidiary address the concerns of the appeals court while offering funds to pay claims. In the hope that offering victims less money will solve the overarching problem.
Lawyers representing cancer patients who do not agree with the agreement counter this with what you conclude is the legal argument. Talc does it cause cancer. They counter with legal nonsense: J&J fraudulently transferred $50 billion of assets away from LTL Management to circumvent the appeals court’s earlier decision. Hyperbole is not exempt by the victims’ lawyers, who call it the biggest “fraudulent transfer that has occurred in United States history.”
Notwithstanding the legal mumbo jumbo, J&J does not really think this bankruptcy will survive. However, it’s a means to try and push the $8.9 billion settlement, and to keep the pressure on plaintiffs.
April 10 2023 Update: Bloomberg offers an informative article on a new law within New Jersey that is shedding new light on litigation funding in the Class action suit. Litigation funders Virage Capital Management and TRGP Capital invested in hundreds of lawsuits from Johnson & Johnson (J&J) concerning talc products in exchange for a portion of any winnings. J&J is now willing to pay $8.9 billion to settle any lawsuits.
The funders’ involvement is publicly available because of the New Jersey court rule requiring the release of certain details about funding sources outside of the. The rule aims to address the growing calls for regulation of litigation funders. J&J has to deal with more than 60,000 lawsuits when you combine state and federal baby powder lawsuits. Third-party financing in mass tort cases has pros and pros and. There is no doubt that we are witnessing how third-party financing can help level the playing field between individual as well as large corporations in court.
April 4 2023 Update: It is interesting to watch the worm turn in this lawsuit. J&J suffered another setback this week when they were denied by the Third Circuit denied J&J’s request to continue the automatic stay as J&J appeals a bankruptcy decision to the U.S. Supreme Court. Automatic stays have halted the cases of talcum powder in a number of years and prevented the filing of new lawsuits ever since J&J started the controversial process to spin the talc liability off into a bankrupt entity over a year earlier. Talc does it cause cancer. After it was decided that the 3rd Circuit ruled that this bankruptcy was invalid just a few months ago the stay was lifted. J&J wanted to see it continue in the meantime of the SCOTUS appeal. However, the answer was no.
April 1st, 2023 Update Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The chance the Supreme Court is willing even to consider the appeal? Low.
March 16th, 2023 Update: with the bankruptcy stay officially lifted, the first new cases have been filed and transferred into the Talcum Powder class action MDL in over one year. Seven new talc-related lawsuits were included in the MDL over the last month increasing the number of pending cases up to 37,522.
February 25, 2023 Update This morning, a Congressmen from Tennessee has now demanded that be the U.S. Government Accountability Office (GAO) begin an investigation into the amount J&J talc products have cost the government over the years.
in a letter to the GAO, Rep. Steven Cohen (D-Ten.) claimed that J&J of not recognizing the risks of its talc products for long while tax dollars utilized to treat people injured by exposure to the products. The demand comes just weeks after J&J’s major loss in the 3rd Circuit Court of Appeals.
Talc does it cause cancer. J&J has to begin making fair settlement offers to victims, in order to put all of this behind. This is a blemish on one of the world’s greatest firms.
February 14 2023 Update: In a hearing today in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention in light of the 3rd U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
