Talc face powder cancer. Randi Ellis, a lawyer who is frequently involved in MDLs across the country was appointed as the claims representative in the initial bankruptcy. J&J’s defense team wants Ellis to be named to the position in the future, however lawyers representing the talc plaintiffs are objecting due to the fact that Ellis has an unrelated conflict of interest that would prevent her from holding that position once more. The issue stems from the fact that Ellis was apparently involved in drafting the controversially litigated second bankruptcy, which raises questions regarding her capacity to remain neutral. In reality, this bankruptcy is likely to be dismissed in the end.
May 17, 2023 Update The pretend company that J&J created for the talc bankruptcy disclosed to a New Jersey bankruptcy court that they have allocated $400 million to pay the claims brought by states accusing the company of misleading advertising for its talc-based products. It is hard to imagine any scenario in which J&J can get the settlements of baby powder through given these numbers. While J&J’s $8.5 billion offer may seem like a large sum initially, it may not look very appealing when you do the math. The settlement plan based on our rough calculations – would not be able to pay victims more than $100,000 per instance. That’s not enough.
May 15 2023 update: J&J could be facing lawsuit by an advocacy group that represents cancer patients. Talc face powder cancer. They plan to explore J&J’s actions after the announcement of the dismissal of LTL’s first bankruptcy case.

Other suppliers of talc have been forced to file for bankruptcy as a result of the litigation.
May 4, 2023 Update U.S. The bankruptcy Judge Michael Kaplan has directed Johnson & Johnson to relaunch negotiations with lawyers who rebuffed the company’s $8.9 billion deal. In Trenton, New Jersey yesterday, the parties gathered in court to discuss the next steps for another bankruptcy proceeding and Judge Kaplan encouraged further settlement talks.
This is the best way to resolve these claims for J&J. A settlement for baby powder can be completed. Talc face powder cancer. But it will require more money – more billions of dollars – from Johnson & Johnson.
Lawyers are divided over whether or not to accept the plan and not all clients see the issue the same way their attorney does. This second case of bankruptcy is expected to be a failure with Judge Kaplan has scheduled a hearing in June to decide if he will close the case for the third time.
May 3, 2023 Update A group of cancer victims who are suing Johnson & Johnson (J&J) demanded to have the Third Circuit halt the bankruptcy filed by J&J subsidiary LTL Management, claiming it attempts to block litigation over talc products. The group of talc claimants filed a motion on Tuesday requesting for the Third Circuit to consider their case and send it back the lower court, with instructions to discharge the bankruptcy. Talc face powder cancer. They also requested that the stoppage of tort litigation against J&J should be permitted to proceed.
LTL requested Chapter 11 protection once again after its bankruptcy filing was rejected by the Third Circuit earlier this year, offering an $8.9 billion agreement. The committee believes that the recent ruling which allowed the second Chapter 11 to continue, as well as halting the trials against J&J is a reason for immediate Third Circuit review. The US Trustee requested an New Jersey bankruptcy court dismiss the LTL bankruptcy case. J&J’s global vice-president of litigation, Erik Haas, was quoted by Bloomberg as saying that J&J intends to file a response to the appeals court calling the request a “desperate and legally inadequate plan” by a select group of law firms that have conflicting financial interests.
May 1 2023 Update: One most frequently asked question is how plaintiffs and their lawyers be able to turn down $8.9 billion. Of course, it’s quite a sum. There are a lot of victims. Talc face powder cancer. These are an excellent cases for plaintiffs. We were reminded of this recently when two talc cases have resulted in huge verdicts for plaintiffs. In February mesothelioma, a talcum-based powder trial in Oregon led to the verdict worth $18.1 million. A month later, another mesothelioma-related talc case went to hearing on the other side of South Carolina and resulted in a verdict of $29million to the plaintiff. Both cases were defended by Whittaker, Clark & Daniels Inc., one of the most prominent manufacturers of talc in U.S.
April 30 2023 Update: In the year 2023, when J&J first attempted to drag the litigation over talcum powder into bankruptcy, it was met with the option of putting aside $2 billion to settle the case. The sum was ridiculously low. All of the talc plaintiffs agreed with the proposal. However, this time, J&J has increased the offer to $8.9 in the event that the talc victims agree to a bankruptcy settlement and they also have the support of a substantial segment of the talc plaintiffs and their attorneys. Talc face powder cancer. But with 75% of plaintiffs of talc are required to approve bankruptcy plans It’s a long and difficult process since there are so many lawyers with vast inventory of baby powder-related lawsuits, opposed towards the agreement.
What could solve the impasse? More billions.
April 25, 2023 Update: Talc patients have demanded a judge disqualify the Chapter 11 case filed by LTL Management LLC, a ridiculously made-up Johnson & Johnson subsidiary, which claims that the business is not financially strained. LTL has filed for Chapter 11 to settle tens of thousands of claims that J&J’s baby-powders caused cancer. Talc face powder cancer. In the end, however, the 3rd Circuit dismissed its first Chapter 11 case in January The court ruled that the company was not eligible to receive bankruptcy relief because it failed to show financial difficulties.
The claimants assert that LTL’s 2nd Chapter 11 case is an fraud on the bankruptcy system and it is being pursued in bad faith. J&J asserts that the bankruptcy settlement has “significant backing” from the firms that represent around 60,000 people who are claiming. It’s fair to say that plaintiffs’ lawyers and the victims are split over their disagreement over the $8.9 billion settlement offer.
April 21, 2023 Update: A bankruptcy judge decided that Johnson & Johnson must face new lawsuits alleging that the company sold a baby powder that contained a chemical that causes cancer. The judge expressed his doubts about J&J’s ridiculous effort to revive its strategy by filing a second bankruptcy case.
April 13th 2023 update: the big announcement is an $8.9 billion over 25 year period settlement offered. Lawyers representing cancer victims within the MDL group action promised to fight the settlement with those who claim talc. Why? They feel it’s not enough to pay for 70,000 victims who have cancer. Talc face powder cancer. These lawyers argue that J&J should seek a bigger settlement or litigate individual claims if the most recent bankruptcy is dismissed.
But there is another set of lawyers who are not part of the leadership group in the class action. They have amassed hundreds of thousands of cases. They want to settle today with what they believe is lower than what the victims should be paid. The argument they make is twofold. The first is that they claim the settlement – which amounts to an average of $100,000 per plaintiff is fair.
This argument isn’t easy to present. However, their second argument has more substance: the victims will no longer wait and want their money now.
April 12 2023 Update: Many are asking how J&J is able to file for bankruptcy again. The answer is complex and confusing. However, let’s attempt to explain it in simple terms.
Johnson & Johnson asserts that bankruptcy is the only method to address both present and future talc lawsuits conclusively. It thinks it can get a lower rate should there be a bankruptcy component that applies pressure to settle. Talc face powder cancer. Driving past hundreds of years of American past, the company believes that bankruptcy is beneficial to all parties by distributing settlements more equally and effectively than trial courts, where some litigants receive significant settlements while others get nothing.
The main thrust in the 3rd Circuit decision was this is not a case of a profitable company making an entity to assume the legal risk and declare bankruptcy – Congress had in mind when it came to drafting the Bankruptcy Code. However, the court also ruled the company was financially difficulty due to the fact that J&J offered unlimited financing.
Then J&J decided to go with the funding unlimited part of the contract and didn’t make any promises that it would provide unlimited funds for the litigation. J&J claims that its modified financing arrangements with its subsidiary address concerns of the appellate court, while providing funds for claims. As if providing victims with lower amounts of money would resolve the problem at hand.
Lawyers representing cancer patients who are against the agreement argue the agreement with what is countering legal nonsense with legal absurdity: J&J fraudulently transferred $50 billion of assets from LTL Management to circumvent the appeals court’s previous ruling. Hyperbole is not exempt by the victims’ lawyers, who call it the most significant “fraudulent deal in United States history.”
Despite the legal jargon, J&J does not really believe that this bankruptcy will last. But it is a way to push for this $8.9 billion settlement to keep pressure on plaintiffs.
April 10 2023 Update Bloomberg has an interesting piece on a law that has been passed of New Jersey that is shedding new light on litigation funding in the suit for class actions. Funders for litigation Virage Capital Management and TRGP Capital invested in hundreds of lawsuits from Johnson & Johnson (J&J) over talc products in exchange for a share of any winnings. J&J has now offered that it will pay $8.9 billion to settle any lawsuits.
The involvement of funders is public knowledge due to an New Jersey court rule requiring the release of certain details regarding outside funding backers. This rule is intended to address the growing calls for regulation of litigation funders. J&J faces over 60,000 claims when you add up state and federal infant powder litigation. Third-party financing in mass tort cases has both pros and pros and. There is no doubt that we are witnessing how third-party financing can help level the playing field between individuals and large corporations in the courtroom.
April 4 2023 Update: It’s enjoyable to see the worm turning in this legal battle. J&J has taken another blow this week, when it was found that the Third Circuit denied J&J’s request to extend the automatic stay in the meantime that J&J appeals a bankruptcy ruling to the U.S. Supreme Court. Automatic stays have froze thousands of talcum cases and prevented new lawsuits from arising ever since J&J began the controversial plan to spin talc-related liabilities into a bankrupt subsidiary more than one year back. Talc face powder cancer. After it was decided that the 3rd Circuit ruled that this bankruptcy was insufficient a few months ago, the stay was lifted. J&J had hoped to have it stayed in place until its SCOTUS appeal. However, the answer was no.
April 1, 2023 Update: Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The chance for the Supreme Court is willing even to hear the appeal? Low.
March 16 2023 Update: with the bankruptcy stay having been fully lifted, the first new cases have been filed and transferred into the talcum powder class action MDL in the space of a year. Seven new talc cases were added to the MDL during the month of March which brings the total number of cases in the pending process up to 37,522.
February 25 2023 Update 2023 Update: A Congressmen from Tennessee has now demanded that be the U.S. Government Accountability Office (GAO) begin an investigation into how much J&J Talc products have cost the government in the years.
Recently, in an open letter to the GAO, Rep. Steven Cohen (D-Ten.) accused J&J of failing to recognize the dangers of its talc-based products for long while tax dollars utilized to treat people injured by exposure to the chemicals. This lawsuit comes a few weeks after J&J’s significant loss in the 3rd Circuit Court of Appeals.
Talc face powder cancer. J&J has to begin making reasonable settlement proposals to victims, in order in putting this behind. It’s a mark on one of the most prestigious firms.
February 14 2023 Update: During an earlier hearing at the hearing in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention to follow the third U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
