Johnson & Johnson (JNJ.N) has put aside $400 million to resolve U.S. state consumer protection actions as part of its larger $8.9 billion settlement of allegations that it’s Baby Powder and other talc-based ingredients cause cancer. Talc has asbestos.

J&J company subsidiary LTL Management filed a bankruptcy plan in New Jersey late on Monday that describes how the company will pay various types of cancer patients in bankruptcy settlement. Talc has asbestos. J&J has declared that its Talc products are safe, and won’t cause cancer. It’s trying for an additional time to conclude more than 38,000 lawsuits in bankruptcy and prevent new cases from arising in the near future.
LTL’s bankruptcy plan would pay $400 million into a separate trust for claims filed by state attorneys general claiming that J&J violated states’ unfair practices as well as consumer protection laws through misleading consumers regarding the safety of its talc products.

Many states had initiated consumer protection measures against J&J prior to the first bankruptcy filing stopped these investigations from proceeding in 2021. Talc has asbestos. New Mexico and Mississippi had already filed suits against Johnson & Johnson before then and the states of Arizona, Maryland, North Carolina, Texas and Washington had issued civil investigative demands or subpoenas according to court papers.

New Mexico and Mississippi have moved to dismiss LTL’s bankruptcy along with cancer sufferers as well as their counterparts from the U.S. Justice Department’s watchdog on bankruptcy, who have claimed that a lucrative company such as J&J does not qualify for bankruptcy protections designed for struggling debtors.
The company’s initial attempt to resolve the bankruptcy cases was thrown out after similar arguments. A U.S. appellate court determined that LTL wasn’t in “financial difficulty” and was not eligible of bankruptcy protection. Talc has asbestos. LTL filed a second bankruptcy less than two hours after the dismissal, saying that its second attempt was different because there was less money available and more backing for the possibility of settling.

New Mexico and Mississippi said in their motion for dismissal that LTL’s renewed bankruptcy violates the state’s law enforcement authority in attempting to unilaterally limit the liability of the company in state consumer protection actions.

LTL’s filings for the new year also contained more information about how the company would assess and settle cancer claims in the event that the bankruptcy plan is approved.

The largest amount of money under the settlement will be $500,000 for people diagnosed with cancer of the mesothelioma ovary before age 45. Talc has asbestos. The second payment would be $260,000 for those diagnosed with cancer of the ovary prior to age 45.

From there, the proposed settlement will offer discounts based on the kind and severity of the cancer, the person’s age, previous the use of talc, and other aspects. Talc has asbestos. For instance an individual who was using talc products weekly, had an ovarian cancer family history, cancer and was diagnosed an ovarian cancer stage II by age 55 might qualify for a $21,125 payout under the program.

Judge ordains J&J and talc opponents to engage in settlement talks.

After another round of hearings in Johnson & Johnson’s attempt to employ a Texas Two Step bankruptcy strategy to resolve talc litigation and federal bankruptcy judge Michael Kaplan has ordered the firm and the people who opposed the strategy to engage in negotiations to settle the matter, Bloomberg reports.

In its second bankruptcy effort for LTL Management, a subsidiary created by J&J to manage the claims company made a settlement offer of $8.9 billion. Talc has asbestos. While a group of law firms representing plaintiffs support the proposal, another group opposes the deal.

In the last week, an opposition group, known as”the Official Committee of Talc Claimants in the bankruptcy court, demanded to dismiss this case by argument that LTL can not be considered in financial hardship.

“The filing is an incredibly legal and ineffective attempt by a tiny number of law firms to try to prevent claimants from voting on the resolution plan, a plan that the overwhelming majority of claimants are in favor of,” J&J’s litigation chief Erik Haas, said in an announcement. Talc has asbestos. “The law firms involved in these filings have interests in finance that conflict with, differ from and are in opposition to the interests which their clientele. We’ll submit a response before the court of appeals.”

Talc has asbestos. Clay Thompson, a lawyer for MRHFM which includes more than mesothelioma victims who have filed lawsuits against J&J and J&J, has said that the second bankruptcy attempt of J&J failed.

“J&J sends out press releases about how great the plan is but simultaneously demanding that plan details–including what individuals with illnesses would be treated to,” Thompson said in the statement. “What is J&J’s plan to hide?”

Kaplan has instructed the sides to come up with another strategy for reorganization, under the oversight by two mediators.

The court in February of 2022 Kaplan confirmed J&J’s recourse to Chapter 11 to hasten a settlement that would release the company from the hundreds of thousands of claims over its talcum products.

However, in January of this year a federal appeals court ruled against the decision, deciding that the firm could not be considered to be in “financial distress.”

The J&J’s plan to make an appeal before the U.S. Supreme Court was turned down at the end of April J&J declared bankruptcy about two hours later. In response to that move, Kaplan froze the lawsuits for 60 days, allowing the company to decide whether to allow an additional bankruptcy.

J&J’s omnipotent profit engine fails after $6.9B cost of litigation involving talc.

Through 2 Chapter 11 attempts, J&J has gotten 19 months of which cases were placed in limbo. Talc has asbestos. The company wants claimants to accept their settlement. J&J requires 75% support for the deal to go through.

Alongside the group of talc attorneys who have panned the company’s bankruptcy and the U.S. Trustee, a branch of the U.S. Department of Justice was also the one to file a motion to dismiss LTL’s second bankruptcy case.

In a filing this week, U.S. Trustee Andrew R. Vara wrote that the doors of the bankruptcy court are “open to honest, but naive debtors.” The doors “are not open to parties that don’t have a legitimate bankruptcy purpose or that seek to use the bankruptcy process to delay or hinder their creditors.” Vara continued.

For its part, J&J maintains there is no proof conclusive that their Talc products, which includes its iconic baby powder, can cause cancer. J&J has been taking the products of the market–first on North America in 2020–and the rest of the world next year.

J&J seeks to avoid the costly business of going to trial. It has prevailed in the majority of cases that have been decided during trial, however, certain losses have been extremely punishing.
A highly publicized trial in Missouri resulted in an $4.7 billion verdict against the drugmaker that was later reduced to $2.1 billion after appeals.

Johnson & Johnson faces high-stakes hearing over ‘Texas Two Step’ talc strategy: report
In all, J&J has lost nine trial involving talc that are being appealed or resolved. Out of 41 trials, 32 have ended in a win by J&J either through a mistrial or plaintiff verdicts that were reversed after appeal. Talc has asbestos. In addition, J&J in 2020 moved to settle nearly 1000 cases at a cost of $110 million. Bloomberg stated at the time.

Johnson and Johnson Talcum Powder Lawsuit Update 2023 – Talc Has Asbestos

June 2 2023 Update: At the trial for asbestos-containing talc in California yesterday, a few technical glitches interrupted the opening statement by the defense lawyers. Talc has asbestos. Jurors watching from home on Zoom however, heard Johnson &Johnson’s lawyer express doubt about the 70s research claiming asbestos was present in their product, but the opening was abruptly ended.

The plaintiff was able to present the first of their witnesses, Arthur Langer. Langer explained that the existence of other minerals alongside the talc’s mineral content is inevitable. He claimed that his group advised J&J in the year 1971 of the presence of chrysotile asbestos within the company’s talc, albeit with just 0.1 percent. The asbestos was discovered by him in 1976.

June 1, 2023 Update: Talc has asbestos. This is the first court trial that has taken place since J&J took the decision to disband its Talc segment and file for bankruptcy marks an important turning point in the ongoing talc litigation controversy. The trial started yesterday in the heartbreaking trial of a young plaintiff, diagnosed with a rare and aggressive type of mesothelioma earlier this year. which lawyers on both sides acknowledge is a grave tragedy.

The opening statements exposed the stark differences in each side’s story. The attorney representing the plaintiff aimed his ire against Johnson & Johnson, alleging that the company employed deceitful techniques in its research practices and throughout the litigation process. In the words of attorney Johnson & Johnson tried to alter the definition of asbestos despite internal documents from the year 1978 and 1994 indicating that asbestos fibers found in tissues of the plaintiff are part of.

Johnson & Johnson’s precarious $8.9 billion settlement offer hangs in the balance as we progression of this trial. Despite the particularity of the mesothelioma trial and the unique issues it faces compared to other talcum powder lawsuits, a verdict favoring the plaintiff could be an enormous setback for J&J’s hope of gaining broad acceptance for the settlement they have proposed among plaintiffs.

May 31st 2023: Update from Johnson & Johnson’s bankrupt talc business strongly defended the second Chapter 11 filing in the in the face of challenges from talc injury claimants. In an opposition filed with the New Jersey bankruptcy court, the subsidiary argued that the case was vastly different from the first filing. The subsidiary emphasized the record-breaking commitment to $8.9 billion to J&J, the largest settlement ever in an bankruptcy case involving mass torts. Talc has asbestos. There was no mention of how this amount implies that it is a fair settlement. J&J also claimed support from a variety of plaintiffs’ law firms representing more than 600,00 claimants. This is not easy to confirm but is probably incorrect.

May 24 2023 Update: Following Johnson & Johnson’s 2021 bankruptcy filing, the first trial regarding its cosmetic talc products that are believed to containing asbestos is set to start jury selection on Monday, California at Alameda County Superior Court, which is a well-known court for plaintiffs. Plaintiff claims that mesothelioma is the result of asbestos exposure through J&J’s products and that the company does not deny. The trial also involves six retailers who are accused of selling talc-containing products.

May 22nd, 2023 Update Lawyers in the 2nd J&J talc bankruptcy are fighting over who should be chosen to fill the role of future claims representative. This is which is vitally critical to resolving talc claims. Talc has asbestos. Randi Ellis, a lawyer who regularly appears in MDLs across the country, was appointed as the claims representative in the initial bankruptcy. J&J’s defense team wants Ellis to be appointed to that role and again, but attorneys for the talc plaintiffs have raised objections because Ellis has a conflict of interest that should prevent her from assuming that position in the future. This conflict is rooted in the issue that Ellis was believed to have been involved in drafting the hotly litigated second bankruptcy, raising doubts regarding her capacity to remain neutral. In reality, this bankruptcy could get dismissed anyway.

May 17, 2023 Update: The pretend company J&J formed to handle the bankruptcy of talc informed an New Jersey bankruptcy court that they have allocated $400 million to settle the claims brought by states accusing J&J of misleading marketing regarding its talc products. Talc has asbestos. So that makes it an $8.5 billion settlement for cancer victims. It’s hard to imagine a scenario where J&J could push the settlements of baby powder through in these figures. While J&J’s proposed $8.5 billion offer seems like a lot at first, it does not appear appealing when you consider the math. The settlement plan based on our rough calculations would not provide victims with much more than a median settlement of $100,000 per case. That is not enough.

May 15, 2023, Update J&J could be facing lawsuit brought by an advocacy group that represents cancer victims. Talc has asbestos. The group claims that J&J intentionally canceled an $61.5 billion fund-raising agreement with its subsidiary, LTL Management LLC, to create the appearance of financial hardship and to validate the company’s Chapter 11 bankruptcy filing. The group claims that this move is a fraud transfer of the right to compensation for victims. They intend to investigate J&J’s actions in the wake of the decision to dismiss LTL’s first bankruptcy suit.

May 10 2023 Update: During the next week in it is expected that the U.S. Bankruptcy Court in New Jersey will hear oral arguments on a petition to dismiss the second bankruptcy petition filed by J&J subsidiaries LTL Management. In the meantime, however, LTL Management has filed an order that requires both parties to participate in a new settlement mediation hoping that the global settlement can be come to fruition.

May 5th, 2023: Update on Talc provider Whittaker, Clark & Daniels filed for Chapter 11 bankruptcy due to several lawsuits alleging that its talc products caused cancer from asbestos exposure. Talc has asbestos. More than 2700 people have filed lawsuits against the company and the company was paying $1 million per month to defend its legal position. The company’s most recent $29 million settlement in South Carolina forced it to seek bankruptcy protection, arguing for a fair distribution of assets between the claimants of talc instead of being confiscated by the receiver. Other talc suppliers have also been forced to file for bankruptcy as a result of lawsuits.

May 4 2023 Update U.S. The bankruptcy Judge Michael Kaplan has directed Johnson & Johnson to restart negotiations with lawyers who rebuffed the company’s proposed $8.9 billion settlement offer. The court in Trenton, New Jersey yesterday the parties gathered in court to discuss the next steps in the second bankruptcy case and Judge Kaplan encouraged further settlement talks.

This is the solution to resolve the claims of J&J. The baby powder settlement is likely to be completed. Talc has asbestos. But it’ll need more money – more billions of dollars by Johnson & Johnson.

Lawyers have a split opinion on whether to accept the proposal and not all clients see the issue in the same manner their lawyer sees it. A second bankruptcy proceeding is likely to be a failure the judge Kaplan has set a date for a hearing in June to decide whether to discharge the bankruptcy for the 2nd time.

May 3, 2023 Update: A group representing cancer patients who have sued Johnson & Johnson (J&J) asked to have the Third Circuit halt the bankruptcy filed by J&J subsidiary LTL Management, claiming it is an attempt to derail the litigation involving talc products. The group representing claimants for talc submitted a motion on Tuesday requesting to the Third Circuit to consider their appeal and return the case to a lower court, with instructions to dismiss the bankruptcy. Talc has asbestos. The committee also requested that the stopped tort litigation against J&J be allowed to proceed.
LTL applied for Chapter 11 protection once again following its bankruptcy filing that was rejected by the Third Circuit earlier this year, offering a $8.9 billion agreement. The committee argues that the recent ruling which allowed LTL’s third Chapter 11 to continue, as well as halting the trials against J&J and J&J, requires the immediate Third Circuit review. The US Trustee requested it be requested that the New Jersey bankruptcy court dismiss the LTL bankruptcy case. J&J’s global vice-president of litigation Erik Haas, was quoted by Bloomberg saying that J&J plans to file a statement in the appeals court characterizing the filing as a “desperate and legally flawed move” by a handful of law firms that have competing financial interests.
May 1 2023 Update: One question people keep asking is how could plaintiffs and their lawyers turn on $8.9 billion. Of course, it’s quite a sum. But there are a lot of victims. Talc has asbestos. These are actually a good case for plaintiffs. We were reminded of this last week with two talc trials have resulted in huge verdicts for the plaintiffs. In February mesothelioma, a talcum-based powder trial in Oregon led to the verdict of $18.1 million. In the same month, a different mesothelioma trial involving talc was held for trials on the other side of South Carolina and resulted in an award of $29 million in favor of plaintiff. It was the same defendant as in these cases: Whittaker, Clark & Daniels Inc. One of the largest manufacturers of talc in U.S.
April 30, 2023 Update: When J&J first tried to bring the talcum powder lawsuit into bankruptcy, they came with an offer to put aside $2 billion to settle the case. The amount was absurdly low. All of the talc plaintiffs were in favor of the proposal. This time around, however, J&J has increased the offer to $8.9 for talc-related plaintiffs if they agree to a bankruptcy settlement and they also have the support of a large segment of the talc plaintiffs and their lawyers. Talc has asbestos. However, 75% of plaintiffs in the talc category, which is necessary for bankruptcy plan approval It’s a long and difficult process since there are so many lawyers with large inventories of baby powder-related lawsuits, opposed to the settlement.

What can be done to end the impasse? More billions.
April 25 2023 Update Talc Cancer victims have demanded a judge reject their Chapter 11 case filed by LTL Management LLC, a ridiculously made-up Johnson & Johnson subsidiary, which claims that the business is not financially troubled. LTL filed for Chapter 11 to settle tens of thousands of claims that J&J’s baby-powders caused cancer. Talc has asbestos. The 3rd Circuit dismissed its first Chapter 11 case in January in a ruling that said the company wasn’t eligible for bankruptcy relief since it had not demonstrated financial trouble.

The plaintiffs argue that the second Chapter 11 case is an fraud on the bankruptcy system and that it’s being pursued in bad faith. J&J asserts that the bankruptcy settlement is backed by “significant support” from the firms that represent approximately 60,000 claimants. It’s safe to say plaintiffs’ lawyers and victims ‘ lawyers are not united over this $8.9 billion deal.

April 21st, 2023 Update: A bankruptcy judge ruled that Johnson & Johnson must face new lawsuits alleging that the firm sold a baby powder that contained a chemical that causes cancer. Although trials for talc lawsuits are paused for a minimum period of 60 days and new lawsuits are able to be filed, and lawyers may begin to prepare their cases. Talc has asbestos. Judges expressed doubt about J&J’s pathetic attempt to relaunch its strategy in a second bankruptcy trial.

April 13, 2023 update: the big news is the $8.9 billion over the next 25 years offer for settlement. Lawyers representing cancer victims in the MDL class action have pledged to fight the settlement with Talc claimants. Why? They argue that it’s too little money for the more than 70,000 cancer victims. Talc has asbestos. The lawyers say that J&J could negotiate a greater settlement or pursue individual claims in the event that the latest bankruptcy is dismissed.

There is a different set of lawyers who are not part of the leadership group in that class action. These lawyers have amassed tens of thousands of cases. This group wants to settle now with what they believe is lower than what the victims should be paid. Their argument appears to be twofold. First, they argue the settlement, which is about an average of $100,000 per plaintiff – is fair.

This argument isn’t easy to prove. But their second argument has more force: victims should be no longer patient and demand their money today.

April 12, 2023 Update: People are seeking out how J&J can file for bankruptcy once more. The answer is complex and complex. Let’s try to clarify it in simple terms.
Johnson & Johnson asserts that bankruptcy is the only means to deal with both present and future talc litigations in a definitive manner. In other words, it believes it can pay less in the event of a bankruptcy element that creates pressure to settle. Talc has asbestos. Driving past the 400-year span of American past, the company claims that bankruptcy benefits all parties as it distributes settlements more fairly and effectively than trial courts, in which some litigants receive substantial awards while others receive nothing.

The gist in the 3rd Circuit decision was this isn’t a case that involves the profit-making company that has an entity to assume the legal burden and declare bankruptcy – Congress thought of when drafting its Bankruptcy Code. However, it also stated that the entity was in financial difficulty because J&J promises unlimited funding.
Thus, J&J did not hesitate to take advantage of the unlimited funding portion of the contract and didn’t promise to offer unlimited funding for the litigation. J&J claims that its new financing agreements with its subsidiary addresses the concerns of the appeals court while offering claim payment funds. As if offering victims less money will solve the overarching problem.

Lawyers representing cancer victims who are against the agreement argue this by arguing that the plaintiff is countering legal nonsense legal nonsense: J&J fraudulently transferred $50 billion of assets away from LTL Management to circumvent the appeals court’s ruling. Hyperbole did not go unnoticed the lawyers representing victims call it the biggest “fraudulent transfer ever in United States history.”

Despite the legal jargon, J&J does not really believe that this bankruptcy will last. But it is a way of trying to push this $8.9 billion settlement to keep pressure on plaintiffs.

April 10 2023 Update: Bloomberg is running an intriguing piece on a law that has been passed of New Jersey that is shedding new light on litigation funding in the baby powder Class action suit. Funders for litigation Virage Capital Management and TRGP Capital invested in hundreds of claims that were brought against Johnson & Johnson (J&J) regarding talc products, in exchange for a portion of any wins. J&J has now offered to pay $8.9 billion to settle lawsuits.

The involvement of funders is public information because of an New Jersey court rule requiring the release of certain details about outside funding backers. The rules aim to tackle the growing demands for regulation of the litigation funders. J&J faces over 60,000 claims when you add up federal and state child powder-related lawsuits. Third-party funding of mass tort cases is not without its pros and cons. There is no doubt that we are seeing how third-party funding can level the playing field between individuals as well as large corporations in court.

April 4, 2023 Update: It is interesting to watch the worm turning in this case. J&J suffered another setback this week when an appeals court in the Third Circuit denied J&J’s request to continue the automatic stay in the meantime that J&J appeals an order granting bankruptcy at the U.S. Supreme Court. This automatic stay frozen thousands of talcum cases and prevented new lawsuits from arising ever since J&J began the controversial plan to spin the talc liability off into a bankrupt company over one year ago. Talc has asbestos. After the 3rd Circuit ruled that this bankruptcy was invalid just a few months ago the stay was removed. J&J wanted to see it continue in the meantime of an appeal to the SCOTUS appeal. However, the answer was no.
April 1, 2023 Update: Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The chance of the Supreme Court is willing even to accept the appeal? Low.
March 16th 2023 Update: with the bankruptcy stay now fully lifted, the first new cases were filed and incorporated into the class action involving talcum powder MDL in the space of a year. Seven new talc lawsuits were included in the MDL in the past month increasing the number of cases that are pending to 37,522.

February 25, 2023 Update The following information is available: A Congressmen from Tennessee is now calling for The U.S. Government Accountability Office (GAO) launch an investigation into the amount J&J products containing talc have cost the government in the years.
In a recent letter to the GAO, Rep. Steven Cohen (D-Ten.) in a recent letter to the GAO, Rep. Steven Cohen (D-Ten. J&J of ignoring the dangers of its talc products for long while tax dollars spent on treating people who suffered injuries from exposure to the chemicals. The lawsuit comes just a few weeks after J&J’s significant loss in the 3rd Circuit Court of Appeals.

Talc has asbestos. J&J has to begin making reasonable settlement offers to victims, in order getting this behind it. This is a blemish on one of the most prestigious businesses.

February 14 2023 Update: In a hearing today in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention following his 3rd U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
