April 12, 2023 Update: People are looking for ways J&J could file for bankruptcy again. The answer is complex and convoluted. But let’s try to explain it clearly.
Johnson & Johnson asserts that bankruptcy is the only option to deal with both present and future talc lawsuits conclusively. That is, it believes it can pay less in the event of a bankruptcy element that creates pressure for a settlement. Talc have ovarian cancer. Driving past more than 400 years in American history, the company believes that bankruptcy is beneficial to everyone by dispersing settlements more fairly and effectively than trial courts where litigants are awarded significant payouts, while others are left with nothing.

Attorneys representing cancer victims who do not agree with the agreement counter this with what you conclude is countering legal nonsense legal absurdity: J&J fraudulently transferred $50 billion of assets away from LTL Management to circumvent the appeals court’s previous decision. Hyperbole was not spared by the victims’ lawyers, who call it the biggest “fraudulent move ever in United States history.”
Notwithstanding the legal mumbo jumbo, J&J does not really think that the bankruptcy will endure. However, it’s a means of trying to push this $8.9 billion settlement, and to keep pressure on plaintiffs.

The funders who fund litigation Virage Capital Management and TRGP Capital invested in hundreds of lawsuits against Johnson & Johnson (J&J) on behalf of talc products.
