The hyperbole wasn’t spared: victims’ lawyers call it the largest “fraudulent transfer in United States history.”
Notwithstanding the legal mumbo jumbo, J&J does not really think this bankruptcy will survive. However, it’s a means of pushing this $8.9 billion settlement through and maintain pressure on plaintiffs.
April 10, 2023 update: Bloomberg is running an intriguing article about a new law in New Jersey that is shedding new light on the funding of litigation in the Class action suit. The funders who fund litigation Virage Capital Management and TRGP Capital invested in hundreds of claims against Johnson & Johnson (J&J) concerning talc products in exchange for a percentage of any settlements. J&J is now offering that it will pay $8.9 billion in settlements for all lawsuits.
The funders’ involvement is public information because of the New Jersey court rule requiring the disclosure of certain information about funders outside the state.
