J&J subsidiaries LTL Management filed a bankruptcy plan in New Jersey late on Monday that describes how the company will pay various types of cancer victims as part of bankruptcy settlement. Johnson & Johnson asserts that bankruptcy is the only method to address both present and future talc litigations in a definitive manner. That is, it thinks it can get a lower rate in the event of a bankruptcy component that applies pressure to settle. Talc in soap safe. Lawyers representing cancer victims who do not agree with the agreement counter this with what you conclude is countering legal nonsense with legal nonsense: J&J fraudulently transferred $50 billion in assets away from LTL Management to circumvent the appeals court’s previous ruling. Hyperbole is not exempt the lawyers representing victims call this the biggest “fraudulent deal in United States history.”
Despite the legal jargon, J&J does not really believe that this bankruptcy will last. But it’s a way to push for this $8.9 billion settlement and keep pressure on plaintiffs.
