J&J’s defense attorneys want Ellis to be appointed in that position in the future, however lawyers representing the talc plaintiffs are protesting on the grounds that Ellis has a conflict of interest that would prevent her from holding that position in the future. The issue stems from the issue that Ellis was believed to have been involved in the drafting of the highly contesting second bankruptcy, which raises doubts about her capability to remain neutral. The reality is this bankruptcy will likely to be tossed out anyway.

This is the answer to resolve these claims for J&J. A baby powder settlement can get done. Talc in vitamin c is safe. But it will require more money – more billions of dollars coming from Johnson & Johnson.
Lawyers have a split opinion on whether or not to accept the plan and not every client views the issue in the same manner their lawyer sees it. LTL applied for Chapter 11 protection once again following the bankruptcy filing it made earlier was denied in the Third Circuit earlier this year with a $8.9 billion deal. The committee argues that the recent decision allowing LTL’s 2nd Chapter 11 to continue, as well as halting the trials against J&J and J&J, requires the immediate Third Circuit review. The US Trustee also requested that an New Jersey bankruptcy court dismiss the LTL bankruptcy case. J&J’s vice president for global litigation, Erik Haas, was quoted by Bloomberg saying that J&J intends to file a statement in the appeals court calling the request a “desperate and legally insufficient move” by a select group of law firms with different financial interests.
May 1st 2023 Update: One question people keep asking is how could plaintiffs and their lawyers turn off $8.9 billion. Of course, that is an immense amount of money. There are a lot of victims. Talc in vitamin c is safe. They are a great arguments for plaintiffs. We were reminded of this last week in two talc trials which have resulted in huge verdicts for plaintiffs. In February, a talcum powder mesothelioma trial in Oregon resulted in the verdict that was $18.1 million. The following month, a second mesothelioma-related talc case went to the court on the other side of South Carolina and resulted in the verdict of $29 million to the plaintiff. The defendant in both cases was Whittaker, Clark & Daniels Inc. which is one of the leading suppliers of talc in the U.S.
April 30, 2023 Update: When J&J first tried to bring the talcum powder lawsuit into bankruptcy, they came with an offer to set aside $2 billion for settlements. It was a ridiculously small amount. All of the talc plaintiffs believed in the offer. This time, J&J has increased the offer to $8.9 in the event that the talc victims agree to a bankruptcy settlement and they have the support of a large part of the talc-related plaintiffs and their attorneys. Talc in vitamin c is safe. But with 75% of plaintiffs who are a talc, which is required to approve bankruptcy plans is not an easy task due to the sheer number of lawyers with large inventories of baby powder lawsuits opposed against the proposed settlement.
What could solve the impasse? More billions.
April 25 2023, Update Talc patients have asked a judge to dismiss the Chapter 11 case filed by LTL Management LLC, a absurdly-made-up Johnson & Johnson subsidiary, saying the company is not financially strained. LTL requested Chapter 11 to settle tens of thousands of claims that J&J’s baby products caused cancer. Talc in vitamin c is safe. In the end, however, the 3rd Circuit dismissed its first Chapter 11 case in January and said that the company was not eligible to receive bankruptcy relief because it had not demonstrated financial trouble.
The claimants argue that LTL’s second Chapter 11 case is an abuse of the bankruptcy system and that it is being pursued in bad good faith. J&J asserts that the bankruptcy settlement is backed by “significant support” from the firms that represent about 60,000 potential plaintiffs. It’s fair to say plaintiffs’ lawyers and victims ‘ lawyers are divided on the $8.9 billion amount of settlement offered.
April 21st, 2023 Update: A bankruptcy judge ruled that Johnson & Johnson must face new lawsuits alleging that the company sold tainted baby powder causing cancer. Even though trials for Talc lawsuits are suspended for a minimum of 60 days, new lawsuits can be filed, and lawyers will begin preparing their cases. Talc in vitamin c is safe. The judge expressed his doubts about J&J’s attempt to revive its strategy with a second bankruptcy trial.
April 13 2023: Update on the big update is about the $8.9 billion over the course of 25 year period settlement offered. Lawyers representing cancer patients involved in the MDL Class Action have promised to challenge the settlement the talc claimants. Why? They feel it’s not enough money for more than 70,000 cancer victims. Talc in vitamin c is safe. The lawyers say that J&J should seek a bigger settlement or even litigate individual claims if the latest bankruptcy is dismissed.
However, there is a second lawyer group that isn’t part of the top leadership in that class action. The lawyers collectively have accumulated many thousands of cases. This group wants to settle the case now in what many believe to be less than the victims deserve. The argument they make is twofold. The first is that they claim the settlement – about 100,000 dollars per plaintiff is fair.
It’s a difficult argument to argue. However, their second argument has more substance: the victims will be no longer patient and demand their money today.
April 12, 2023 Update: People are asking how J&J could file for bankruptcy again. The answer is complex and convoluted. Let’s try to simplify it simply.
Johnson & Johnson asserts that bankruptcy is the only method to settle both present and future talc litigations in a definitive manner. Also, it thinks it can get a lower rate if there is the bankruptcy element which applies pressure for a settlement. Talc in vitamin c is safe. In a quest to cover the 400-year span of American history, the company asserts that bankruptcy benefits all parties as it distributes settlement payments more equitably and effectively than trial courts, in which some litigants receive substantial award while others do not.
The essence in the 3rd Circuit decision was this isn’t a case that involves a profitable company making subsidiaries to meet the legal liability and declare bankruptcy – Congress contemplated when drafting the Bankruptcy Code. However, the court also ruled that the subsidiary was not financially trouble due to the fact that J&J promised unlimited funding.
So J&J decided to go with the unlimited funding portion of the deal and did not promise to offer unlimited funding for the litigation. The company claims that modified financing arrangements with its subsidiary address concerns of the appellate court, while offering claim payment funds. It’s as if giving victims lesser money could solve the problem at hand.
Attorneys representing cancer patients who do not agree with the agreement counter this with what you conclude is a defense against legal nonsense by pointing out legal absurdity: J&J fraudulently transferred $50 billion in assets away from LTL Management to circumvent the appeals court’s decision. Hyperbole was not spared by the victims’ lawyers, who call it the biggest “fraudulent deal that has occurred in United States history.”
Despite all the legal jargon, J&J does not really think this bankruptcy will survive. But it is a way of pushing this $8.9 billion settlement through and maintain pressure on plaintiffs.
April 10, 2023 Update: Bloomberg provides an insightful report on a brand new law within New Jersey that is shedding new light on litigation funding in the plaintiffs in the class action. The funders who fund litigation Virage Capital Management and TRGP Capital invested in hundreds of lawsuits against Johnson & Johnson (J&J) over talc products in exchange for a share of any wins. J&J is now willing the payment of $8.9 billion to settle all lawsuits.
The involvement of funders is made public because of a New Jersey court rule requiring the disclosure of certain information about funders outside the state. This rule is intended to respond to the increasing calls for the regulation of litigation funders. J&J has to deal with more than 60,000 lawsuits when you add up federal and state infant powder litigation. Third-party financing in mass tort cases has pros and pros and. But there is no question that we are seeing how third-party financing can help level the playing field between individual and big companies in court.
April 4 2023 Update: It’s enjoyable to see the worm turn in this lawsuit. J&J has taken another blow this week when the Third Circuit denied J&J’s request to maintain the automatic stay while J&J appeals a bankruptcy decision before the U.S. Supreme Court. The automatic stay has froze the cases of talcum powder in a number of years and stopped any new lawsuits from getting filed ever since J&J launched the controversial attempt to spin the talc liability into a bankrupt entity over one year back. Talc in vitamin c is safe. After the 3rd Circuit ruled that this bankruptcy was not valid a few months ago, the stay was lifted. J&J had hoped to have it continued pending the SCOTUS appeal. But, no.
April 1, 2023 Update: Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The odds that is that the Supreme Court is willing even to take up the appeal? Low.
March 16th 2023 Update: with the bankruptcy stay being fully lifted, the first new cases have been filed and transferred into the class action for talcum powder MDL within a year. Seven new talc lawsuits have been included in the MDL in the last month, bringing the total number of cases pending to 37,522.
February 25 2023 Update: A Congressmen from Tennessee is now requesting that authorities from the U.S. Government Accountability Office (GAO) begin an investigation to determine how much J&J product containing talc has cost the government over the decades.
Recently, in an open letter addressed to the GAO, Rep. Steven Cohen (D-Ten.) has accused J&J of ignoring the dangers of its talc products over decades while tax dollars were spent treating those injured by exposure to the product. The demand comes just weeks after J&J’s loss to the 3rd Circuit Court of Appeals.
Talc in vitamin c is safe. J&J has to begin making reasonable settlement proposals to victims, in order to put all of this behind it. It is a stain on one of the top firms.
February 14 2023 Update: At an earlier hearing at the hearing in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention following the 3rd U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
