J&J’s proposed talc settlement will be worth $440 million US state AGs. Talc In Vitamins Safe .

Johnson & Johnson (JNJ.N) has put aside $400 million to address U.S. state consumer protection actions as part of its larger $8.9 billion settlement of allegations that its Baby Powder and other talc items cause cancer. Talc in vitamins safe.

J&J affiliate LTL Management filed a bankruptcy plan in New Jersey late on Monday that outlines how the firm intends to pay different types of cancer sufferers in bankruptcy settlement. Talc in vitamins safe. J&J has stated that its Talc products are safe, and won’t cause cancer. It is attempting for an additional time to conclude more than 38,000 lawsuits brought in bankruptcy, as well as prevent new lawsuits from arising in the future.
The bankruptcy plan of LTL would pay $400 million into a separate trust for claims filed from state attorney generals alleging that J&J had violated laws against unfair business practices in the State of New York as well as consumer protection laws by misinforming consumers about the safety of its talc products.

A number of states had already initiated consumer protection measures against J&J prior to the time that LTL’s bankruptcy filing prevented these investigations from proceeding in 2021. Talc in vitamins safe. New Mexico and Mississippi had already brought actions with Johnson & Johnson before then and states like Arizona, Maryland, North Carolina, Texas and Washington had issued subpoenas or civil investigative demands in LTL’s court filings.

New Mexico and Mississippi have filed a petition to end LTL’s bankruptcy along with cancer sufferers as well as the U.S. Justice Department’s bankruptcy watchdog. They have argued that a successful company like J&J can’t benefit from bankruptcy protections intended for those struggling with debt.
The company’s initial attempt to resolve the bankruptcy lawsuits was thrown out after similar arguments. The U.S. appeals court determined that LTL had not been in “financial trouble” and ineligible of bankruptcy protection. Talc in vitamins safe. LTL declared bankruptcy a second time in just two hours following the dismissal, arguing the second bankruptcy was different because there was less money available and more support for the possibility of settling.

New Mexico and Mississippi said in their motion for dismissal that LTL’s latest bankruptcy violation of the state’s law enforcement authority by seeking to unilaterally limit the company’s liability for state consumer protection actions.

The filings of LTL’s latest bankruptcy proceedings also include more information about how the company plans to evaluate and pay cancer claims when the bankruptcy plan is approved.

The most significant payments under the settlement would be $500,000 to those diagnosed with terminal mesothelioma before age 45. Talc in vitamins safe. The second payment would be $260,000 for patients diagnosed with terminal ovarian cancer before age 45.

The proposed settlement applies discounts depending on the kind and severity of cancer, the patient’s age, history of usage of talc and other variables. Talc in vitamins safe. For example someone who regularly used talc products on a weekly basis, who had an ovarian cancer family history, cancer and was diagnosed an ovarian cancer stage II at age 55 may qualify to receive a payment of $21,125 under the program.

Judge decides J&J and talc oppositionists to take part in settlement talks.

Following another round of hearings in Johnson & Johnson’s effort to use a Texas Two-Step bankruptcy strategy to resolve talc litigation and federal bankruptcy judge Michael Kaplan has ordered the company as well as those who oppose the plan to hold talks to reach a settlement, Bloomberg reports.

In its second bankruptcy effort for LTL management, a subsidiary founded by J&J to hold the claims–the company made a settlement offer of $8.9 billion. Talc in vitamins safe. While a firm representing plaintiffs supports the offer, another group opposes the deal.

In the last week, an opposition group, known as”The Official Committee of Talc Claimants requested the bankruptcy court to dismiss this case saying that LTL cannot be regarded as to be in financial trouble.

“The filing is an incredibly legal and ineffective attempt by a tiny number of law firms to prevent claimants from voting on the resolution, which the vast majority of claimants approve of,” J&J’s litigation chief Erik Haas, said in an announcement. Talc in vitamins safe. “The law firms behind this filing have financial interests that clash with, diverge from and infringe on the rights they represent. We’ll submit an appeal to the appellate court.”

Talc in vitamins safe. Clay Thompson, a lawyer for MRHFM that has more than 80 mesothelioma patients who have filed lawsuits against J&J and J&J, has said that the company’s second bankruptcy try will fail.

“J&J issue press releases describing how fantastic its plan is, while insisting that the details of its plan–including the treatment individuals with illnesses would receive–be kept secret,” Thompson said in an announcement. “What do J&J have to keep secret?”

Kaplan has instructed the sides to develop a new restructuring plan, with supervision from two mediators.

On February 20, 2022 Kaplan acknowledged J&J’s recourse to Chapter 11 to hasten a settlement that will free the company from the hundreds of thousands of claims regarding its talcum products.

But in January of this year an appeals court of the federal government overturned the decision, deciding that the company could not be considered in “financial trouble.”

The J&J’s plan to challenge the U.S. Supreme Court was turned down in April, J&J was granted a second petition for bankruptcy roughly two hours later. In response to that move, Kaplan froze the lawsuits for 60 days to decide whether or not to accept the second bankruptcy.

J&J’s unstoppable profit machine sputters after $6.9B the talc litigation cost.

Through two Chapter 11 attempts, J&J has bought 19 months during which cases were put in limbo. Talc in vitamins safe. The company would like claimants to decide whether they want to accept the settlement. J&J requires 75% acceptance for the deal to go through.

In addition to the gang of talc lawyers that criticized the company’s bankruptcy play as well, the U.S. Trustee, an arm from the U.S. Department of Justice was also the one to file an application to dismiss LTL’s second bankruptcy.

In a statement this week, U.S. trustee Andrew R. Vara wrote that the doors of bankruptcy are “open to honest, but naive debtors.” These doors “are not open to any parties that do not have a legitimate purpose or that seek to abuse the bankruptcy process to hinder or delay their creditors,” Vara continued.

To its credit, J&J maintains there is no proof conclusive that their Talc products, which includes its popular baby powder cause cancer. J&J has taken the products from the market and will first launch them in North America in 2020–and the rest of the world this year.

J&J wants to avoid the expense of going to court. It has won the majority of cases that have been decided in court, however certain losses have been harsh.
A high-profile trial in Missouri produced a $4.7 billion judgment against the drug manufacturer and was later lowered to $2.1 billion after appeals.

Johnson & Johnson faces high-stakes hearing over ‘Texas Two Step’ talc strategy: report
In all, J&J has lost nine trial cases in talc which are on appeal or have been settled. Of the 41 trials, 32 ended with winning for J&J or a mistrial, or verdict of a plaintiff annulled after appeal. Talc in vitamins safe. Separately, the company has announced plans to settle more than 1000 cases for $100 million, Bloomberg published at the time.

Johnson and Johnson Talcum Powder Lawsuit Update 2023 – Talc In Vitamins Safe

June 2 2023 Update: In the asbestos talc trial in California yesterday, some technical issues interrupted the opening statements of the defense lawyers. Talc in vitamins safe. Jurors watching from their homes via Zoom however, heard Johnson & Johnson’s lawyer expressing doubt about the science of the 70s that claimed asbestos was present in their product prior to the session abruptly ended.

The plaintiff could introduce its first expert witness Arthur Langer. Langer explained that the existence of other minerals in the talc mineral is a given. He testified that his team was notified by J&J in 1971 of the presence of chrysotile asbestos within the talc manufactured by the company, though with lower than 0.1 percent. He also uncovered more asbestos in 1976.

June 1, 2023 Update: Talc in vitamins safe. This is the first court trial that has taken place since J&J decided to spin off its Talc segment and file for bankruptcy marks an important point in the ongoing talc lawsuit story. The trial began on Tuesday in the poignant case of a young 24 year-old plaintiff, diagnosed with a rare and aggressive type of mesothelioma earlier this year. a diagnosis lawyers on both sides agree is a grave tragedy.

Opening statements revealed distinct differences between each side’s story. The attorney for the plaintiff took aim towards Johnson & Johnson, alleging the use of misleading tactics in research practices and throughout the litigation procedure. According to the attorney the company tried to manipulate the definition of asbestos despite internal documents dating back to 1978 and 1994 showing that asbestos fibers found in tissue of the plaintiffs are included.

Johnson &J’s highly uncertain $8.9 billion settlement offer hangs in the balance with the progression of this trial. Despite the unique nature of this mesothelioma lawsuit and its unique challenges compared to other talcum powder lawsuits and a decision in favor of the plaintiff could result in a serious setback to J&J’s hopes of broad acceptance of their proposed settlement among plaintiffs.

May 31 2023 Update: Johnson & Johnson’s bankrupt talc division strongly defended it’s two-time Chapter 11 filing in the facing challenges from the talc injury plaintiffs. In a written objection to the New Jersey bankruptcy court, the subsidiary argued that the situation differed fundamentally from the previous filing. It emphasized the unprecedented commitment of $8.9 billion in settlement from J&J the largest settlement ever in the history of a mass tort bankruptcy. Talc in vitamins safe. The issue is not discussed: whether the size of the settlement indicates that it is a fair settlement. J&J also claimed that it received support from several plaintiffs’ legal firms representing more than sixty thousand claimants. This is not easy to confirm but is probably incorrect.

May 24 2023 Update: In the wake of Johnson and Johnson’s bankruptcy filing in 2021 filing, the very first trial regarding the cosmetic talc products it claims to that contain asbestos is scheduled to begin jury selection on Monday in California at Alameda County Superior Court, which is a well-known court for plaintiffs. The plaintiff claims his mesothelioma is the result of asbestos exposure in J&J’s product, an allegation the company is denying. The trial also involves six retailers who are accused of selling talc-based products.

May 22nd, 2023 Update: Lawyers in the 2nd J&J Talc bankruptcy are in a dispute over who should be chosen to fill the post of the future claims representative, a role that is critically essential to the resolution of the Talc claims. Talc in vitamins safe. Randi Ellis, a lawyer who is frequently involved in MDLs all over the nation, was appointed as the claims representative in the first bankruptcy. J&J’s defense group wants Ellis to be appointed in that position yet again, but the lawyers for the plaintiffs in talc are arguing to the claim that Ellis has a conflict of interest which would prohibit her from being appointed to that post again. The issue stems from the issue that Ellis was apparently involved in the creation of the hotly contesting second bankruptcy, which raises questions regarding her capacity to remain neutral. In reality, this bankruptcy is likely to be dismissed regardless.

May 17, 2023 Update: The pretend company J&J created to settle the talc litigation bankruptcy told a New Jersey bankruptcy court that they have allocated $400 million to settle claims made by states accusing the company of misleading advertising for its talc product. Talc in vitamins safe. That’s an $8.5 billion settlement for cancer patients. It’s hard to imagine the scenario in which J&J could push the settlements of baby powder through with these numbers. While J&J’s proposed $8.5 billion offer might seem like a lot of money initially, it may not appear appealing after you calculate the figures. The settlement plan based on our rough calculations would not offer victims anything more than a median settlement of $100,000 per instance. That is not enough.

May 15 2023, Update J&J might be facing lawsuit brought by an advocacy group that represents cancer patients. Talc in vitamins safe. The group claims that J&J deliberately withdrew a $61.5 billion fund-raising agreement together with its parent company, LTL Management LLC, in order to create a false sense of financial distress and validate the unit’s Chapter 11 bankruptcy filing. The group claims that this move is equivalent to a fraudulent transfer of victims’ compensation rights. They will investigate J&J’s actions after the announcement of the decision to dismiss LTL’s first bankruptcy case.

May 10 2023 Update: The following week this week, next week, the U.S. Bankruptcy Court in New Jersey will hear oral arguments regarding a motion to dismiss the second bankruptcy filing that was filed by J&J company LTL Management. However, in the meantime, it has approved an order which requires both sides to take part in a new settlement negotiation hoping that it will be possible to reach a global settlement agreement brokered.

May 5th 2023 Update: Talc supplier Whittaker, Clark & Daniels filed for Chapter 11 bankruptcy due to numerous lawsuits alleging its talc products caused cancer from asbestos exposure. Talc in vitamins safe. More than 2700 people have filed lawsuits against the firm and the company was spending $1 million a month on legal defense. The company’s recent $29million verdict that was handed down in South Carolina forced it to file for bankruptcy protection, arguing for a fair distribution of assets between the claimants of talc instead of being seized by the receiver. Other suppliers of talc have been forced to file for bankruptcy as a result of the litigation.

May 4 2023 Update: U.S. Court of Bankruptcy Michael Kaplan has directed Johnson & Johnson to relaunch talks with lawyers who rebuffed Johnson & Johnson’s $8.9 billion agreement. It was in Trenton, New Jersey yesterday, the parties appeared before a judge to discuss the next steps to take in another bankruptcy proceeding and Judge Kaplan pushed more settlement talks.

This is the way to settle these claims for J&J. A baby powder settlement can get done. Talc in vitamins safe. However, it will require additional money – perhaps billions of dollars from Johnson & Johnson.

Lawyers are divided on whether to take the proposal or not and not all clients view the situation the same way their lawyer views it. This second case of bankruptcy is destined to go nowhere and Judge Kaplan has set a date for a hearing in June to decide whether to discharge the bankruptcy for the 2nd time.

May 3, 2023 Update The group of cancer victims suing Johnson & Johnson (J&J) requested to have they request that the Third Circuit halt the bankruptcy filed by J&J subsidiary LTL Management, claiming it attempts to block the litigation involving talc products. The group of talc claimants has filed a motion this week asking the Third Circuit to consider their appeal and return the case the lower court with instructions to discharge the bankruptcy. Talc in vitamins safe. They also asked that lawsuit against the halted torts of J&J allow the litigation to continue.
LTL filed for Chapter 11 protection once again after its first bankruptcy filing was rejected by the Third Circuit earlier this year and offered an $8.9 billion payment. The committee believes that the recent decision allowing the second Chapter 11 to continue, and also stopping trials against J&J, warrants an immediate Third Circuit review. The US Trustee also requested that the New Jersey bankruptcy court dismiss the LTL bankruptcy case. J&J’s vice president for global litigation Erik Haas, was quoted by Bloomberg as saying that J&J intends to file a response in the appeals court, characterizing the filing as an “desperate and legally insufficient effort” by a few of law firms that have conflicting financial interests.
May 1st, 2023 Update: One question people keep asking is how could plaintiffs and their lawyers turn off $8.9 billion. Of course, that is an immense amount of money. There are a lot of victims. Talc in vitamins safe. These are an excellent cases for plaintiffs. We were reminded of this recently by two talc-related trials that led to huge verdicts for the plaintiffs. In February, a talcum powder mesothelioma trial in Oregon led to the verdict in the amount of $18.1 million. The following month, a second talc mesothelioma case went to hearing within South Carolina and resulted in the verdict of $29 million on behalf of the plaintiff. The defendant in both cases was Whittaker, Clark & Daniels Inc. which is one of the most prominent suppliers of talc in the U.S.
April 30th, 2023 Update: When J&J first attempted to drag the talcum powder lawsuit into bankruptcy, it came with an offer to set aside $2 billion for settlements. The amount was absurdly low. None of the talc plaintiffs believed in the offer. This time around, however, J&J has increased the offer to $8.9 in the event that the talc victims will allow a bankruptcy settlement and they have the backing of a significant part of the talc-related plaintiffs as well as their lawyers. Talc in vitamins safe. But with 75% of plaintiffs who are a talc, which is required to approve bankruptcy plans It’s a long and difficult process due to the sheer number of lawyers with huge inventories of baby powder lawsuits that are opposed to the settlement.

What can be done to end the impasse? More billions.
April 25, 2023 Update: Talc plaintiffs have sought a court order to disqualify their Chapter 11 case filed by LTL Management LLC, a absurdly-made-up Johnson & Johnson subsidiary, which claims that the business is not financially strained. LTL requested Chapter 11 to settle tens of thousands of claims that J&J’s baby products caused cancer. Talc in vitamins safe. In the end, however, the 3rd Circuit dismissed its first Chapter 11 case in January, saying LTL was not a candidate for bankruptcy relief because it failed to show financial distress.

The plaintiffs argue that the second Chapter 11 case is an abuse of the bankruptcy system and that the case is being handled in bad faith. J&J states that the bankruptcy settlement is backed by “significant backing” from firms representing an estimated 60,000 claimants. It’s safe to say that the plaintiffs’ attorneys and victims ‘ lawyers are not united over this $8.9 billion deal.

April 21, 2023 Update: A bankruptcy judge ruled the company Johnson & Johnson must face new lawsuits alleging that the firm offered a baby powder with a contaminant that caused cancer. Although the trials for the lawsuits involving talc are delayed for at least 60 calendar days and new lawsuits are able to be filed, and lawyers will begin preparing their cases. Talc in vitamins safe. Judges expressed doubt about J&J’s ridiculous effort to revive its plan with a second bankruptcy case.

April 13th 2023 Update: The major update is about the $8.9 billion over the course of 25 years of settlement. Lawyers representing cancer victims within the MDL Class Action have vowed to fight the settlement along with the talc claimants. Why? They believe it’s not enough money for 70,000 victims who have cancer. Talc in vitamins safe. The lawyers say that J&J should negotiate a bigger settlement or settle individual claims if the latest bankruptcy is declared unconstitutional.

But there is another set of lawyers who are not part of the top leadership in that class action. These lawyers have amassed the equivalent of tens of thousands of lawsuits. This group wants to settle the case now with what they believe is less than these victims deserve. Their argument seems to be two-fold. First, they argue the settlement – about an average of $100,000 per plaintiff is fair.

This argument isn’t easy to make. But their second argument has more teeth: victims can no longer wait and want their money now.

April 12 2023 Update: Many are asking how J&J is able to file for bankruptcy again. The answer is complicated and convoluted. Let’s try to simplify it clearly.
Johnson & Johnson asserts that bankruptcy is the only means to deal with both present and future lawsuits involving talc conclusively. Also, it thinks it can get a lower rate when there is the bankruptcy element which applies pressure to negotiate a settlement. Talc in vitamins safe. In a quest to cover the 400-year span of American time, the business claims that bankruptcy benefits everyone by dispersing settlements more fairly and more efficiently than trial courts in which some litigants receive substantial award while others do not.

The essence of the 3rd Circuit decision was this isn’t a case that involves a profitable company making an affiliate to accept the legal liability and declare bankruptcy – something Congress had in mind when it came to drafting the Bankruptcy Code. It also clarified it was not in financial crisis due to the fact that J&J promises unlimited funding.
This is why J&J decided to go with the unlimited funding part of the agreement and did not promise that it would provide unlimited funds for lawsuits. J&J claims that its revised financing arrangements with its subsidiary addresses the concerns of the appellate court, while offering claim payment funds. It’s as if giving victims less money will solve the overall issue.

Attorneys representing cancer victims who are against the agreement argue this argument by saying that it is a defense against legal nonsense by pointing out legal absurdity: J&J fraudulently transferred $50 billion in assets to LTL Management to circumvent the appeals court’s previous ruling. Hyperbole was not spared: victims’ lawyers call it the biggest “fraudulent deal that has occurred in United States history.”

Despite the legal jargon, J&J does not really believe this bankruptcy will be able to last. However, it’s a means of pushing this $8.9 billion settlement through and maintain pressure on plaintiffs.

April 10 2023 Update: Bloomberg is running an intriguing article about a new law that has been passed in New Jersey that is shedding new light on litigation funding in the suit for class actions. Litigation funders Virage Capital Management and TRGP Capital invested in hundreds of claims that were brought against Johnson & Johnson (J&J) regarding talc products, in exchange in exchange for a portion of profits. J&J has now offered the payment of $8.9 billion to settle lawsuits.

The funders’ involvement is public knowledge because of an New Jersey court rule requiring the release of certain details about funders outside the state. This rule is intended to respond to the increasing calls for regulation of litigation funders. J&J is facing more than 60,000 claims when you take into account federal and state Baby Powder lawsuits. Third-party funding in mass tort claims has both pros and cons. However, there is no doubt that we are witnessing how third-party financing can help level the playing field between individual and big corporations in court.

April 4, 2023 Update: It is pleasing to see the worm turn in this lawsuit. J&J was hit again this week when they were denied by the Third Circuit denied J&J’s request to maintain the automatic stay in the meantime that J&J appeals a bankruptcy decision to the U.S. Supreme Court. Automatic stays have frozen thousands of talcum powder cases and stopped new lawsuits from getting filed ever since J&J started the controversial process to spin the talc debts off into a bankrupt company over a year ago. Talc in vitamins safe. After it was decided that the 3rd Circuit ruled that this bankruptcy was insufficient a few months ago, the stay was removed. J&J was hoping to have it continued pending hearing the SCOTUS appeal. But the answer was no.
April 1st, 2023 Update: Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The chance of the Supreme Court is willing even to consider the appeal? Low.
March 16 2023 Update: With the bankruptcy stay having been in effect, the first new cases were filed and incorporated into the class action for talcum powder MDL within a year. Seven new talc lawsuits were included in the MDL in the last month increasing the number of pending cases up to 37,522.

February 25, 2023 Update 2023 Update: A Congressmen from Tennessee has now demanded that the U.S. Government Accountability Office (GAO) start an investigation into the amount J&J product containing talc has cost the government in the decades.
Recently, in an open letter to the GAO, Rep. Steven Cohen (D-Ten.) has accused J&J of not recognizing the risks of its talc products over many years, while tax dollars were spent on treating people who suffered injuries from exposure to the products. This lawsuit comes a few weeks following J&J’s dramatic loss in the 3rd Circuit Court of Appeals.

Talc in vitamins safe. J&J should begin to make reasonable settlements to victims, in order getting this behind. It is a stain on one of the top businesses.

February 14 , 2023 Update: At an appearance today in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention following the ruling of 3rd U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
