J&J’s proposed settlement with talc would provide the sum of $400 million US state AGs. Talc Is It Safe .

Johnson & Johnson (JNJ.N) has set aside $400 million to resolve U.S. state consumer protection actions as part of its larger $8.9 billion plan to settle allegations that it’s Baby Powder and other talc-based ingredients cause cancer. Talc is it safe.

J&J subsidiary LTL Management filed a bankruptcy plan in New Jersey late on Monday that describes how the company plans to pay different kinds of cancer victims in a bankruptcy settlement. Talc is it safe. J&J has declared that its products containing talc are safe and don’t cause cancer. It’s trying for the second time to end more than 38,000 lawsuits filed in bankruptcy, and to prevent any new cases from arising in the future.
LTL’s bankruptcy plan would pay $400 million into a separate trust for claims made in state courts by attorneys general claiming that J&J was in violation of the state’s unfair commercial practices and consumer protection laws, by deceiving consumers regarding the safety of its talc products.

Many states had initiated consumer protection measures against J&J prior to LTL’s bankruptcy filing prevented these investigations from proceeding in 2021. Talc is it safe. New Mexico and Mississippi had already brought suit against Johnson & Johnson before then and states like Arizona, Maryland, North Carolina, Texas and Washington had issued subpoenas or civil investigative demands according to court papers.

New Mexico and Mississippi have filed a petition to end LTL’s bankruptcy in a joint move with cancer victims as well as their counterparts from the U.S. Justice Department’s bankruptcy watchdog. have claimed that a lucrative company such as J&J cannot benefit from bankruptcy protections designed for those struggling with debt.
The first attempt by LTL to resolve the bankruptcy-related lawsuits was thrown out after similar arguments. The U.S. appeals court ruled the LTL had not been in “financial trouble” and thus not eligible for bankruptcy protection. Talc is it safe. LTL had filed for bankruptcy again less than two hours after the dismissal, arguing its second attempt was different in that it had less money available and more backing for the possibility of settling.

New Mexico and Mississippi said in their motion for dismissal that LTL’s new bankruptcy violates the law enforcement powers of the state by seeking to unilaterally limit the liability of the company in state consumer protection measures.

Talc Is It Safe

LTL’s recent filings also provided more details on the way in which the company will evaluate and settle cancer claims when the bankruptcy plan is approved.

The largest amount of money under the settlement will be $500,000 to those diagnosed with mesothelioma terminal prior to age 45, and $260,000 for patients diagnosed with advanced ovarian cancer prior to age 45.

From there, the proposed settlement will offer discounts based on the severity and type of cancer, the individual’s age, the history of the use of talc, and other aspects. Talc is it safe. For example someone who regularly used daily talc products, had an ovarian cancer family history, cancer, and was diagnosed with an ovarian cancer stage II by age 55 may be eligible for a $21,125 payment under the plan.

Judge orders J&J and talc oppositionists to discuss settlement negotiations.

Following another hearing in Johnson and Johnson’s efforts to utilize a Texas Two-Step bankruptcy strategy to settle talc lawsuits and federal bankruptcy judge Michael Kaplan has ordered the company as well as those who oppose the plan to enter into negotiations to settle the matter, Bloomberg reports.

With its second bankruptcy bid for LTL Management, a subsidiary set up by J&J to handle the claims company offered a settlement amounting to $8.9 billion. Talc is it safe. While one firm representing plaintiffs agree with the offer, another group is opposed to the offer.

This week, the opposition group, which is known as”the Official Committee of Talc Claimants and urging the bankruptcy court to dismiss the case asserting that LTL is not considered to be in financial distress.

“The filing is an incredibly legal and ineffective attempt by a handful of law firms to block claimants from voting on the resolution plan – a plan the vast and growing majority of claimants are in favor of,” J&J’s litigation chief Erik Haas, said in a statement. Talc is it safe. “The law firms involved in the filing are pursuing financial interests which clash with, diverge from, and oppose the interests of their clients. We’ll submit an appeal before the court of appeals.”

Talc is it safe. Clay Thompson, a lawyer for MRHFM who is home to more than patients with mesothelioma who have sued J&J and J&J, has said that J&J’s second bankruptcy effort will fail.

“J&J publishes press release about how great the plan is but simultaneously insisting that the plan’s details, including what the individual sick individuals would be treated to,” Thompson said in a statement. “What do they have to cover up?”

Kaplan has instructed the sides to develop a new restructuring plan, with supervision by two mediators.

In February 2022, Kaplan confirmed J&J’s use of Chapter 11 to hasten a settlement that would free the company from the tens of thousands of claims over its talcum products.

In January of this year, an appeals court of the federal government overturned the decision, ruling that the business could not be considered to be in “financial difficulty.”

When J&J’s attempt to contest the U.S. Supreme Court was dismissed at the end of April J&J filed for its second bankruptcy just two hours later. In response to that move, Kaplan froze the lawsuits for 60 days, allowing the company to decide whether to allow the second bankruptcy.

J&J’s unstoppable profit machine sputters after $6.9B cost of litigation involving talc.

In the 2 Chapter 11 attempts, J&J has gotten 19 months of which cases were put suspended. Talc is it safe. J&J wants the claimants to decide whether they want to accept the settlement. J&J requires 75% of the vote for the deal to pass.

In addition to the team of talc lawyers who panned LTL’s bankruptcy plan in the U.S. Trustee, the U.S. Trustee, a branch belonging to the U.S. Department of Justice has also filed an appeal to dismiss LTL’s second bankruptcy.

In a filing this week, U.S. Trustee Andrew R. Vara wrote that the doors of bankruptcy courts are “open to honest, but naive debtors.” These doors “are not available to anyone who do not have a legitimate bankruptcy goal or who seek to take advantage of the bankruptcy process to hinder or delay their creditors.” Vara continued.

On the other hand, J&J maintains there is no conclusive evidence that its Talc products, which includes the famous baby powder, can cause cancer. J&J has taken the products of the market, first for North America in 2020–and the rest of the world this year.

J&J intends to steer clear of the costly business of going to court. It has won the majority of cases that have been resolved at trial, but certain losses have been punishing.
A highly-publicized trial in Missouri produced an $4.7 billion judgment against the drug manufacturer but was later reduced to $2.1 billion following appeals.

Johnson & Johnson faces high-stakes hearing over ‘Texas Two Step’ talc strategy: report
Overall, J&J has lost nine trial involving talc that are in appeal or resolved. In 41 trials 32 ended with the favor of J&J, a mistrial or plaintiff verdict that was overturned in appeal. Talc is it safe. Separately, the company in 2020 negotiated to settle over 1,000 cases worth 100 million dollars, Bloomberg stated at the time.

Johnson and Johnson Talcum Powder Lawsuit Update 2023 – Talc Is It Safe

June 2 2023 Update: In the asbestos talc trial which took place in California yesterday, a couple of technical glitches interrupted the opening statement by the defense attorneys. Talc is it safe. The jurors, attending from home via Zoom and hearing the Johnson & Johnson’s lawyer voice his doubts about the 70s research asserting the presence of asbestos in their product prior to the session abruptly ended.

The plaintiff could introduce its first expert witness Arthur Langer. Langer stated that the presence of other minerals alongside talc is expected. He claimed that his group advised J&J in the year 1971 about the presence of chrysotile asbestos in the company’s talc, albeit in just 0.1 percent. He also uncovered more asbestos in the year 1976.

June 1st, 2023 Update: Talc is it safe. This is the first court trial that has taken place since J&J made the decision to split its talc segment and file for bankruptcy is an important point of the ongoing litigation saga. The trial started yesterday in the heartbreaking trial of a young plaintiff, diagnosed with an aggressive and rare form of mesothelioma in the past year, a diagnosis lawyers on both sides acknowledge is a tragic loss.

The opening statements exposed the stark differences in each side’s story. The attorney for the plaintiff took aim on Johnson & Johnson, alleging the use of deceitful methods in their research practices as well as throughout the litigation process. As per the lawyer Johnson & Johnson attempted to alter the definition of asbestos, in spite of internal documents dating from 1998 and 1994 that show asbestos fibers that were found in the tissues of the plaintiff are part of.

Johnson & Johnson’s uncertain $8.9 billion settlement is hanging in the balance with the progress of this trial. Despite the unique nature of this mesothelioma lawsuit and the unique issues it faces compared to the majority of talcum powder lawsuits, a verdict favoring the plaintiff could inflict the company with a major setback in its expectations of widespread acceptance of the settlement they have proposed among plaintiffs.

May 31st 2023: Update from Johnson and Johnson’s bankrupt talc business is defending the two-time Chapter 11 filing in the face of challenges from the talc injury plaintiffs. In an opposition filed with the New Jersey bankruptcy court, the subsidiary argued that the filing was vastly different from the previous filing. It emphasized the unprecedented commitment of $8.9 billion in settlement from J&J as the biggest settlement ever to be made in any bankruptcy case that involves mass tort. Talc is it safe. It was not mentioned how the amount of the settlement implies that it is an equitable settlement. J&J also claimed that it received support from various plaintiffs’ law firms representing more than 600,00 claimants. This is hard to verify however it is likely to be incorrect.

May 24, 2023 Update: Since Johnson & Johnson’s bankruptcy in 2021 filing, the very first trial on the cosmetic talc products it claims to comprised of asbestos is set to commence jury selection on Monday, California in Alameda County Superior Court, a historically good jurisdiction for plaintiffs. Plaintiff claims that mesothelioma was triggered by asbestos exposure resulting from J&J’s products and J&J has denied. The trial also involves six retailers who are accused of selling talc-containing products.

May 22nd, 2023 Update: Lawyers involved in the 2nd J&J talc bankruptcy are now in a dispute over who should be appointed to the role of a future claims representative, the role is crucially critical to resolving talc claims. Talc is it safe. Randi Ellis, a lawyer who is frequently involved in MDLs across the country was appointed the claims representative in the previous bankruptcy. J&J’s defense team would like Ellis to be appointed to this position in the future, however lawyers representing the talc plaintiffs are objecting because Ellis has conflicts of interest that would prevent her from assuming that position in the future. The dispute stems from possibility that Ellis was involved in the creation of the hotly litigated second bankruptcy, which raises doubts regarding her capacity to remain neutral. In reality, the bankruptcy will be dismissed regardless.

May 17, 2023 Update: The fake company J&J put together for the talc litigation bankruptcy informed an New Jersey bankruptcy court that they have designated $400 million to settle claims of states that accuse the company of deceitful advertising regarding its talc products. Talc is it safe. This amounts to an $8.5 billion settlement for cancer victims. It’s difficult to imagine any scenario in which J&J will be able to push these settlements for babies with these numbers. While J&J’s proposed $8.5 billion offer may seem like a lot at first, it does not look good when you do the math. The settlement plan based on our rough calculations would not be able to pay victims more than a median settlement of $100,000 per case. That’s not enough.

May 15 2023 update: J&J may be in the middle of a lawsuit brought by an advocacy group that represents cancer patients. Talc is it safe. The group contends that J&J intentionally canceled an $61.5 billion contract for funding with its subsidiary, LTL Management LLC, to create the appearance of financial hardship and verify the unit’s Chapter 11 bankruptcy filing. The group claims this decision could be interpreted as a fraudulent transfer of the rights of victims’ compensation. They plan to explore J&J’s actions following of the denial of LTL’s first bankruptcy suit.

May 10 2023 Update: During the next week this week, next week, the U.S. Bankruptcy Court in New Jersey will hear oral arguments regarding a motion to dismiss the second bankruptcy filing by J&J LTL Management, J&J’s subsidiary. LTL Management. In the meantime it has approved an Order requiring both sides to participate in a new settlement mediation in the hope that the global settlement can be reached.

May 5th 2023: Update on Talc manufacturer Whittaker, Clark & Daniels filed for Chapter 11 bankruptcy due to numerous lawsuits alleging its talc products caused cancer from asbestos exposure. Talc is it safe. More than 2700 people have filed lawsuits against the company and it has been spending $1 million a month to defend itself. The company’s most recent $29 million settlement at the Supreme Court of South Carolina forced it to pursue bankruptcy protection, and arguing for an equitable distribution of assets between the claimants of talc instead of being taken over in the hands of the receiver. Other talc suppliers have also declared bankruptcy because of legal proceedings.

May 4 2023, Update U.S. Court of Bankruptcy Michael Kaplan has directed Johnson & Johnson to resume talks with lawyers who have rejected the company’s proposed $8.9 billion deal. It was in Trenton, New Jersey yesterday the parties appeared before a judge to discuss the next steps in the second bankruptcy case and Judge Kaplan has pushed for further settlement talks.

This is the way to settle these claims with J&J. The baby powder settlement is likely to be achieved. Talc is it safe. However, it’ll require more money, more billions of dollars – from Johnson & Johnson.

Lawyers are split on whether to take the proposal or not and not all clients see the issue in the same manner their lawyer views it. Second bankruptcy cases are bound to fail as Judge Kaplan has set a date for a hearing in June to determine whether to dismiss the bankruptcy for the second time.

May 3, 2023 Update A group of cancer patients suing Johnson & Johnson (J&J) requested for J&J’s Third Circuit halt the bankruptcy filed by J&J subsidiary LTL Management, claiming it attempts to block the litigation involving talc products. The committee representing talc claimants made a motion Tuesday requesting to the Third Circuit to consider their case and send it back before a court of lower jurisdiction with instructions to dismiss the bankruptcy. Talc is it safe. They also asked that the stopped tort litigation against J&J should be permitted to continue.
LTL has filed for Chapter 11 protection once again after its bankruptcy filing was rejected in the Third Circuit earlier this year and offered a $8.9 billion payment. The committee argues that the recent ruling which allowed LTL’s second Chapter 11 to continue, while also halting trials against J&J should be subject to the immediate Third Circuit review. The US Trustee requested be the New Jersey bankruptcy court dismiss the LTL bankruptcy case. J&J’s global vice president of litigation Erik Haas, was quoted by Bloomberg declaring that J&J intends to file a reply in the appeals court, declaring the filing a “desperate and legally flawed effort” by a few of law firms who have conflicts of financial interests.
May 1st 2023 Update: A common question that people ask is how plaintiffs and their lawyers turn around $8.9 billion. Of course, that’s a lot of money. But there are plenty of victims. Talc is it safe. These are an excellent claims for plaintiffs. We were reminded recently in two talc trials which have resulted in huge verdicts for the plaintiffs. In February mesothelioma cases, a talcum powder trial in Oregon ended in a verdict worth $18.1 million. A month later, another mesothelioma trial involving talc was held for hearing at South Carolina and resulted in an award of $29 million for the plaintiff. It was the same defendant as in these cases: Whittaker, Clark & Daniels Inc. which is one of the largest producers of talc in the U.S.
April 30th 2023 Update: When J&J initially tried to take the litigation over talcum powder into bankruptcy, it was met with an offer to put aside $2 billion to settle the case. This was an absurdly low amount. The talc plaintiffs had not believed in the offer. This time around, however, J&J has increased the offer to $8.9 If the talc plaintiffs will allow a bankruptcy settlement and they also have the support of a substantial segment of the talc plaintiffs and their lawyers. Talc is it safe. But with 75% of plaintiffs of talc are required for bankruptcy plan approval is a difficult road with so many lawyers with vast collections of baby powder lawsuits opposed against the proposed settlement.

What can be done to end the impasse? More billions.
April 25 2023, Update Talc cancer claimants have sought a court order to dismiss the Chapter 11 case filed by LTL Management LLC, a absurdly fabricated Johnson & Johnson subsidiary, declaring that the company isn’t financially troubled. LTL applied for Chapter 11 to settle tens of thousands of claims that J&J’s baby products caused cancer. Talc is it safe. The 3rd Circuit dismissed its first Chapter 11 case in January The court ruled that LTL was not a candidate for bankruptcy relief as it was unable to demonstrate financial distress.

The claimants argue that LTL’s second Chapter 11 case is an abuse of the bankruptcy system, and that it’s being pursued in bad faith. J&J says the bankruptcy settlement receives “significant support” from the firms that represent approximately 60,000 claimants. It is fair to say plaintiffs’ lawyers and the victims are split over this $8.9 billion deal.

April 21st, 2023 Update: A bankruptcy judge has ruled in favor of Johnson & Johnson must face new lawsuits claiming that the company sold a baby powder that contained a chemical that causes cancer. Although trials for the talc lawsuits have been suspended for a minimum of 60 days however, new lawsuits may be filed and lawyers can begin preparing their cases. Talc is it safe. The judge expressed his doubts about J&J’s ridiculous effort to revive its strategy with a second bankruptcy trial.

April 13th, 2023 Update: big announcement is an $8.9 billion over the next 25 years offer for settlement. Lawyers representing cancer patients in the MDL class action have vowed to fight the settlement alongside the talc claimants. Why? They think it is not enough money for more than 70,000 cancer victims. Talc is it safe. They argue that J&J should seek a bigger settlement or even litigate individual claims in the event that the latest bankruptcy is dismissed.

But there is another lawyer group that isn’t part of the leadership in that class action. The lawyers collectively have accumulated hundreds of thousands of cases. This group wants to settle today in what many believe to be far less than what these victims deserve. The argument they make is two-fold. First, they argue the settlement of around the equivalent of $100,000 per plaintiff is fair.

That is a hard argument to present. The second argument is more substance: the victims will now not wait and they want their money now.

April 12 2023 Update: People are looking for ways J&J can go through bankruptcy again. The answer is complex and complex. However, let’s attempt to explain it in simple terms.
Johnson & Johnson asserts that bankruptcy is the only way to settle both present and future lawsuits involving talc conclusively. It believes it can pay less in the event of a bankruptcy component that applies pressure to negotiate a settlement. Talc is it safe. In a quest to cover 400 years of American past, the company claims that bankruptcy benefits all parties as it distributes settlements more equally and effectively than trial courts, where some litigants receive significant award while others do not.

The basic tenet of the 3rd Circuit decision was this is not a case of a profitable company making subsidiaries to meet the legal liability and declare bankruptcy – something Congress had in mind when it came to drafting the Bankruptcy Code. It also clarified it was not financially trouble because J&J assured it of unlimited funding.
Thus, J&J took advantage of the unlimited funding part of the holding and did not promise to fund unlimited litigation. The company says that its modified financing arrangements with its subsidiary address the concerns of the appellate court, while providing funds for claims. As if providing victims with less money would solve the overall issue.

Lawyers representing cancer patients who are against the agreement argue the agreement with what is the legal argument. Talc is it safe. They counter with legal nonsense: J&J fraudulently transferred $50 billion in assets away from LTL Management to circumvent the appeals court’s earlier decision. Hyperbole was not spared the lawyers representing victims call it the most significant “fraudulent transaction of assets in United States history.”

Despite the legal jargon, J&J does not really believe that this bankruptcy will last. It is however a method of pushing this $8.9 billion settlement through and maintain the pressure on plaintiffs.

April 10, 2023 Update: Bloomberg is running an intriguing article about a new law in New Jersey that is shedding new light on litigation funding in the baby powder Class action suit. Funders for litigation Virage Capital Management and TRGP Capital invested in hundreds of lawsuits against Johnson & Johnson (J&J) concerning talc products in exchange for a portion of any winnings. J&J has now offered that it will pay $8.9 billion to settle lawsuits.

The involvement of the funders is public knowledge because of the New Jersey court rule requiring the disclosure of certain information about funders outside the state. The rule aims to respond to the increasing calls for the regulation of litigation funders. J&J is facing more than 60,000 claims when you take into account federal and state child powder-related lawsuits. Third-party funding of mass tort cases has its pros and cons. There is no doubt that we are seeing how third-party funding can level the playing field between people and big corporations in the courtroom.

April 4, 2023 Update: It is fun to watch the worm turn in this litigation. J&J has taken another blow this week when it was found that the Third Circuit denied J&J’s request to extend the automatic stay during the time that J&J appeals an order granting bankruptcy at the U.S. Supreme Court. It has halted thousands of talcum cases and stopped any new lawsuits from getting filed ever since J&J began the controversial plan to spin talc-related liabilities off into a bankrupt subsidiary more than a year back. Talc is it safe. When the 3rd Circuit ruled that this bankruptcy was not valid a few months ago, the stay was revoked. J&J wanted to see it continued pending an appeal to the SCOTUS appeal. The answer was no.
April 1st, 2023 Update: Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. There is a chance that of the Supreme Court is willing even to consider the appeal? Low.
March 16 2023 Update: with the bankruptcy stay being officially lifted, the very first new cases were filed and incorporated into the class action involving talcum powder MDL in just over a year. Seven new talc cases were added to the MDL over the last month and brought the total number of cases pending to 37,522.

February 25 2023 Update 2023 Update: A Congressmen from Tennessee is now requesting that authorities from the U.S. Government Accountability Office (GAO) start an investigation to determine how much J&J talc products have cost the government over the decades.
In a recent letter addressed to the GAO, Rep. Steven Cohen (D-Ten.) in a recent letter to the GAO, Rep. Steven Cohen (D-Ten. J&J of failing to recognize the dangers of its talc product for many years, while tax dollars were used to treat those who were injured through exposure to the product. The suit comes just a few days following J&J’s dramatic loss in the 3rd Circuit Court of Appeals.

Talc is it safe. J&J has to begin making fair settlement offers to victims, in order in putting this behind. This is a disgrace to one of the top companies.

February 14 , 2023 Update: At an appearance today in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention to follow the 3rd U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
