J&J subsidiaries LTL Management filed a bankruptcy plan in New Jersey late on Monday that describes how the company intends to pay different types of cancer victims as part of an arrangement for bankruptcy. J&J wants to avoid the cost of going to court. The company has won the majority of the cases decided through trial, though some losses have been very severe.
A well-known trial in Missouri ended in a $4.7 billion verdict against the drug maker and was later lowered to $2.1 billion after appeals.

April 13th, 2023 Update: The most important story is that there’s an $8.9 billion over 25 years of settlement. April 12 2023 Update: Many are seeking out how J&J can file for bankruptcy again. The answer is complex and complex. But let’s try to explain it simply.
Johnson & Johnson asserts that bankruptcy is the only method to address both present and future talc litigations in a definitive manner. Attorneys representing cancer patients who are against the agreement argue the agreement with what is countering legal nonsense legal nonsense: J&J fraudulently transferred $50 billion in assets away from LTL Management to circumvent the appeals court’s previous decision. The hyperbole wasn’t spared the lawyers representing victims call it the largest “fraudulent transfer that has occurred in United States history.”
Despite the legal jargon, J&J does not really believe this bankruptcy will be able to last. But it’s a way to try and push the $8.9 billion settlement to keep the pressure on plaintiffs.
April 10 2023 update: Bloomberg has an interesting article about a new law in New Jersey that is shedding new light on the funding of litigation in the suit for class actions. Funders of litigation Virage Capital Management and TRGP Capital invested in hundreds of claims that were brought against Johnson & Johnson (J&J) on behalf of talc products. They exchanged for a percentage of any wins. J&J has now offered to pay $8.9 billion to settle any lawsuits.
The funders’ involvement is public information because of an New Jersey court rule requiring the release of certain details about funding sources outside of the. This rule is intended to address the growing calls for regulation of litigation funders. J&J has to deal with more than 60,000 lawsuits when you include state and federal infant powder litigation. In a recent letter addressed to the GAO, Rep. Steven Cohen (D-Ten.) accused J&J of ignoring the dangers of its talc-based products for decades while tax dollars were spent on treating people who suffered injuries from exposure to the products. This lawsuit comes a few weeks after J&J’s loss to the 3rd Circuit Court of Appeals.
