J&J subsidiary LTL Management filed a bankruptcy plan in New Jersey late on Monday that describes how the company intends to pay different types of cancer victims as part of bankruptcy settlement. LTL’s bankruptcy plan would pay $400 million to an additional trust to settle lawsuits filed from state attorney generals alleging that J&J was in violation of the state’s unfair commercial practices and consumer protection laws through misleading consumers about the security of its talc-based products.
A number of states had already initiated consumer protection actions against J&J prior to the time that LTL’s bankruptcy filing prevented those investigations from progressing in 2021. April 13th 2023: Update on the big story is that there’s an $8.9 billion over the next 25 years of settlement. April 12 2023 Update: Some people are wondering if J&J is able to file for bankruptcy again. The answer is complex and complicated. But let’s try to explain it in simple terms.
Johnson & Johnson asserts that bankruptcy is the only means to resolve both current and future talc lawsuits conclusively.
