It’s trying for the second time to end more than 38,000 lawsuits filed in bankruptcy, and to prevent any new cases from arising in the near future.
LTL’s bankruptcy plan would pay $400 million to an additional trust to settle lawsuits filed from state attorney generals alleging that J&J was in violation of the state’s unfair commercial practices and consumer protection laws through misleading consumers about the security of its talc-based products.

A number of states had already initiated consumer protection actions against J&J prior to the time that LTL’s bankruptcy filing prevented those investigations from progressing in 2021. Talc safe for men. New Mexico and Mississippi had already launched actions in the past against Johnson & Johnson before then and the states of Arizona, Maryland, North Carolina, Texas and Washington had issued civil investigative demands or subpoenas in LTL’s court papers.

New Mexico and Mississippi have moved to dismiss LTL’s bankruptcy in a joint move with cancer victims and their counterparts from the U.S. Justice Department’s bankruptcy watchdog, who have argued that a successful firm like J&J does not qualify for bankruptcy protections meant for struggling debtors.
The first attempt by LTL to resolve the bankruptcy lawsuits was dismissed after similar arguments. In the end, a U.S. appellate court determined it was not LTL did not have “financial trouble” and thus not eligible under bankruptcy law. Talc safe for men. LTL filed a second bankruptcy just over two hours after the dismissal, arguing the second bankruptcy was different as it had less money available and had more support for the possibility of settling.

New Mexico and Mississippi said in their motion for dismissal that LTL’s latest bankruptcy violation of state law enforcement powers in attempting to unilaterally limit the company’s liability for state consumer protection laws.

LTL’s recent filings also provided more details on how the company would assess and pay for cancer claims should the bankruptcy plan be approved.

The highest payments under the settlement would be $500,000 for those diagnosed with cancer of the mesothelioma ovary before age 45 and $260,000 for people diagnosed with ovarian cancer that is terminal before age 45.

The proposed settlement provides discounts based on the kind and severity of cancer, the patient’s age, the history of talc use and other factors. Talc safe for men. For instance, a woman who used the talc product on a regular basis, had the family history of ovarian cancer and was diagnosed with stage II ovarian cancer at the age of 55 could be in line to receive a payment of $21,125 according to the plan.

Judge orders J&J, talc opponents to engage in settlement talks.

Following another hearing in Johnson & Johnson’s attempt to employ a Texas Two Step bankruptcy strategy for talc litigation, federal bankruptcy Judge Michael Kaplan has ordered the company and those opposed to the strategy to engage in talks to reach a settlement, Bloomberg reports.

The second time it attempted to file for bankruptcy for LTL management, a subsidiary founded by J&J to hold the claims–the company offered a settlement of $8.9 billion. Talc safe for men. While one firm representing plaintiffs agree with the proposal, another group opposes the move.

The previous week, the opposition group, dubbed”The Official Committee of Talc Claimants and urging the bankruptcy court to dismiss the case asserting that LTL is not considered to be in financial distress.

“The filing is a desperate and legally deficient attempt by a tiny number of law firms to prevent claimants from voting on the resolution plan – a plan that the overwhelming majority of claimants approve of,” J&J’s litigation chief Erik Haas, said in an announcement. Talc safe for men. “The law firms involved in this filing have financial interests that are in conflict with, diverge from and are in opposition to the interests that their customers. We’ll submit an appeal to the appellate court.”

Talc safe for men. Clay Thompson, a lawyer for MRHFM, which has more than 80 patients with mesothelioma who have filed lawsuits against J&J for bankruptcy, told the company’s second bankruptcy try will fail.

“J&J sends out press releases describing how fantastic its plan is, while insisting that the plan’s details, including what individuals with illnesses would receive — be kept private,” Thompson said in an announcement. “What do they have to conceal?”

Kaplan has commanded the parties to create a strategy for reorganization, under the supervision by two mediators.

As of February 2022 Kaplan affirmed the ability of J&J’s use of Chapter 11 to hasten a settlement that would relieve J&J from the tens of thousands of claims over its talcum products.

In January of this year a federal appeals court overturned the ruling, ruling that the business could not be considered in “financial distress.”

In the event that J&J’s request to contest the U.S. Supreme Court was turned down in April, J&J filed for its second bankruptcy just two hours later. In response, Kaplan froze the lawsuits for 60 days in order to determine whether to grant an additional bankruptcy.

J&J’s unstoppable profit engine goes out of control after $6.9B cost of litigation involving talc.

In the two Chapter 11 attempts, J&J has bought 19 months during which the cases were suspended. Talc safe for men. J&J wants the claimants to decide whether they want to accept the settlement. J&J would need 75% support for the deal to go through.

Alongside the group of talc lawyers who criticised the company’s bankruptcy in the U.S. Trustee, the U.S. Trustee is an arm that is part of the U.S. Department of Justice was also the one to file an application to dismiss LTL’s second bankruptcy case.

In a statement this week, U.S. trustee Andrew R. Vara wrote that the doors of the bankruptcy court are “open to honest but unfortunate debtors.” The doors “are not open to parties who do not have a legitimate bankruptcy objective or seek to use bankruptcy to hinder or delay their creditors,” Vara continued.

On the other hand, J&J maintains there is no evidence conclusive that its products containing talc, such as its popular baby powder cause cancer. J&J has adopted the products from the market and will first launch them in North America in 2020–and the remainder of the globe later this year.

J&J intends to steer clear of the costly business of going to trial. J&J has won the majority of the cases decided during trial, however, certain losses have been punishing.

Johnson and Johnson Talcum Powder Lawsuit Update 2023 – Talc Safe For Men

June 2, 2023 Update: During an asbestos talc court trial held at the trial in California yesterday, a couple of technical issues interrupted the opening speech of defense lawyers. Talc safe for men. Jurors from home on Zoom, did hear Johnson & Johnson’s lawyer expressing doubt about the 70s research affirming the presence of asbestos in their product, but the trial was abruptly closed.

Meanwhile, the plaintiff was able to present the first of their witnesses, Arthur Langer. Langer stated that the presence of other minerals with the talc’s mineral content is inevitable. He claimed that his group advised J&J in the year 1971 about the presence of chrysotile asbestos the talc manufactured by the company, though with lesser than 0.1 percent. He also found more asbestos in 1976.

June 1st, 2023 Update Talc safe for men. This is the first court trial that has taken place since J&J took the decision to disband its Talc division and declare bankruptcy marks an important turning point within the ongoing lawsuit drama. Trial began yesterday in the heartbreaking case of a young 24 year-old plaintiff, diagnosed with a rare and aggressive form of mesothelioma last year, an illness that lawyers on both sides of the argument agree is a grave tragedy.

Opening statements revealed the distinct differences between each side’s narrative. The plaintiff’s attorney took aim towards Johnson & Johnson, alleging the use of misleading tactics in research practices and throughout the litigation procedure. The attorney claims that, according to, the company attempted to manipulate asbestos’ definition, in spite of internal documents from 1998 and 1994 that show fibers discovered in the plaintiff’s tissue are included.

Johnson &J’s tangled $8.9 billion settlement proposal hangs in the balance with the course of this trial. Despite the unique nature of this mesothelioma case and the unique issues it faces compared to most talcum powder lawsuits ruling in favor of the plaintiff could be the company with a major setback in its expectations of widespread acceptance of their proposed settlement among plaintiffs.

May 31, 2023 Update: Johnson & Johnson’s bankrupt talc business is defending its two-time Chapter 11 filing in the face of challenges from the talc injury plaintiffs. In an appeal to the New Jersey bankruptcy court, the subsidiary argued that the case differed fundamentally from the previous filing. It emphasized the unprecedented commitment of $8.9 billion from J&J as the largest settlement ever in any bankruptcy case that involves mass tort. Talc safe for men. There was no mention of how the magnitude of the settlement implies that it is a fair settlement. J&J also claimed that it received support from several plaintiffs’ legal firms that represent over sixty thousand claimants. This is difficult to verify but it’s likely to be false.

May 24 2023 Update: As of Johnson & Johnson’s bankruptcy in 2021 filing, the very first trial involving its cosmetic talc products that are believed to that contain asbestos is scheduled to start jury selection on Monday in California within the Alameda County Superior Court, an historically reliable place for plaintiffs. Plaintiff claims that mesothelioma was caused by asbestos exposure resulting from J&J’s products, an allegation J&J has denied. The trial also includes six retailers who are accused of selling talc-containing products.

May 22nd, 2023 Update: Lawyers involved in the 2nd J&J talc bankruptcy are now in a dispute over who should be chosen to fill the post of future claims representative. This is the role is crucially critical to resolving claim for talc. Talc safe for men. Randi Ellis, a lawyer who is frequently involved in MDLs across the country, was appointed as the claims representative in the previous bankruptcy. J&J’s defense team wants Ellis to be appointed in that position in the future, however lawyers representing the plaintiffs in talc are arguing because Ellis has an unrelated conflict of interest that would prevent her from assuming that position in the future. This conflict is rooted in the fact that Ellis was reportedly involved in drafting the controversially contesting second bankruptcy, raising doubts about her capacity to be neutral. In reality, this bankruptcy is likely to be dismissed in the end.

May 17, 2023 Update: The fake company J&J put together for the talc bankruptcy disclosed to an New Jersey bankruptcy court that they have designated $400 million to settle the claims made by states accusing the company of deceptive advertising regarding its talc products. Talc safe for men. This amounts to an $8.5 billion settlement for cancer sufferers. It’s difficult to envision any scenario in which J&J will be able to push the baby powder settlements given these numbers. While J&J’s proposed $8.5 billion offer seems like a large sum initially, it will not appear appealing when you consider the math. The proposed settlement based on our estimates – will not provide victims with much more than an average settlement $100,000 per instance. This isn’t enough.

May 15, 2023 update: J&J may be in the middle of a lawsuit by an advocacy group that represents cancer patients. Talc safe for men. The group contends that J&J deliberately withdrew a $61.5 billion fund-raising agreement together with its parent company, LTL Management LLC, to simulate financial distress and verify the unit’s Chapter 11 bankruptcy filing. The group claims this decision could be interpreted as a fraudulent transfer of rights of compensation for victims. They will investigate J&J’s actions as a result of the decision to dismiss the LTL’s bankruptcy case in its first instance.

May 10 2023 Update: Next week this week, it is expected that the U.S. Bankruptcy Court in New Jersey will hear oral arguments in a motion dismiss the second bankruptcy application from J&J subsidiary LTL Management. In the meantime, this bankruptcy court has issued an order calling for both parties to take part in a second settlement mediation with the hopes of achieving it will be possible to reach a global settlement agreement brokered.

May 5, 2023 Update: Talc supplier Whittaker, Clark & Daniels filed for Chapter 11 bankruptcy due to numerous lawsuits alleging that its Talc products caused cancer from asbestos exposure. Talc safe for men. Over 2700 people have sued the company and the company was paying $1 million per month to defend itself. The company’s latest $29 million verdict that was handed down in South Carolina forced it to file for bankruptcy protection, arguing for equitable distribution of assets to talc claimants, rather than being confiscated from the receiver. Other talc suppliers have also filed for bankruptcy due to lawsuits.

May 4, 2023 Update U.S. Court of Bankruptcy Michael Kaplan has directed Johnson & Johnson to resume talks with lawyers who have rejected the proposed $8.9 billion agreement. It was in Trenton, New Jersey yesterday the parties appeared before a judge to discuss the next steps in their second bankruptcy matter and Judge Kaplan pushed more settlement talks.

This is the answer to settle these claims for J&J. A baby powder settlement can be achieved. Talc safe for men. However, it will require more money, more billions of dollars – coming from Johnson & Johnson.

Lawyers are divided over whether or not to agree with the proposal and not all clients view the issue the same way their lawyer sees it. A second bankruptcy proceeding is destined to go nowhere as Judge Kaplan has set a date for a hearing in June to determine if she will dismiss the bankruptcy for the second time.

May 3, 2023 Update: A group representing cancer patients who have sued Johnson & Johnson (J&J) requested that the Third Circuit halt the bankruptcy filed by J&J subsidiary LTL Management, claiming it is a bid to stop the litigation surrounding talc-based products. The group representing the claimants submitted a motion on Tuesday requesting that the Third Circuit to consider their appeal and return the case the lower court with instructions to discharge the bankruptcy. Talc safe for men. They also requested that the lawsuit against the halted torts of J&J continue to continue.
LTL has filed for Chapter 11 protection once again following its bankruptcy filing that was rejected by the Third Circuit earlier this year which offered a $8.9 billion settlement. The committee says that the recent decision allowing the second Chapter 11 to continue, as well as halting the trials against J&J should be subject to the immediate Third Circuit review. The US Trustee requested be the New Jersey bankruptcy court dismiss the LTL bankruptcy case. J&J’s global vice-president of litigation, Erik Haas, was quoted by Bloomberg as saying that J&J plans to file a response in the appeals court calling the request an “desperate and legally flawed move” by a handful of law firms who have conflicting financial interests.
May 1st 2023 Update: A most frequently asked question is how plaintiffs and their lawyers be able to turn around $8.9 billion. That’s of course an enormous amount of money. There are a lot of victims. Talc safe for men. These are actually a good arguments for plaintiffs. We were reminded of this last week in two talc trials which ended in large verdicts for the plaintiffs. In February, a talcum powder mesothelioma trial in Oregon was settled with the verdict of $18.1 million. The following month, a second mesothelioma trial involving talc was held for trials within South Carolina and resulted in a verdict of $29million in favor of plaintiff. It was the same defendant as in these cases: Whittaker, Clark & Daniels Inc. one of the leading suppliers of talc in the U.S.
April 30, 2023 Update: When J&J initially tried to take the talcum powder lawsuit into bankruptcy, it did so with the option of putting aside $2 billion to settle the case. The amount was absurdly low. None of the talc plaintiffs agreed with the offer. However, this time, J&J has increased the offer to $8.9 if the talc plaintiffs accept a bankruptcy settlement and they have the support of a large segment of the talc plaintiffs and their lawyers. Talc safe for men. But with 75% of plaintiffs in the talc category, which is necessary for bankruptcy plan approval It’s a long and difficult process since there are so many lawyers with vast stocks of baby powder lawsuits opposed against the proposed settlement.

What could solve the impasse? More billions.
April 25 2023, Update Talc patients have demanded a judge reject their Chapter 11 case filed by LTL Management LLC, a absurdly fabricated Johnson & Johnson subsidiary, declaring that the company isn’t financially troubled. LTL applied for Chapter 11 to settle tens of thousands of claims that J&J’s baby products caused cancer. Talc safe for men. LTL was denied Chapter 11 in January. 3rd Circuit dismissed its first Chapter 11 case in January, saying the company was not eligible for bankruptcy relief as it failed to show financial trouble.

The plaintiffs argue that the third Chapter 11 case is an overreach of the bankruptcy system and that it’s being pursued in bad good faith. J&J says the bankruptcy settlement is backed by “significant support” from firms representing an estimated 60,000 people who are claiming. It’s safe to say plaintiffs’ lawyers and victims ‘ lawyers are not united over the $8.9 billion settlement offer.

April 21st, 2023 Update: A bankruptcy judge ruled the company Johnson & Johnson must face new lawsuits alleging that the firm offered a baby powder with a contaminant that caused cancer. Although the trials for the lawsuits involving talc are delayed for at least 60 calendar days, new lawsuits can be filed, and lawyers will begin preparing their cases. Talc safe for men. Judges expressed skepticism about J&J’s absurd attempt to revive its plan with the second bankruptcy case.

April 13th 2023: Update on the big story is that there’s an $8.9 billion over the next 25 years of settlement. Lawyers representing cancer victims involved in the MDL class action have pledged to fight the settlement with the talc claimants. Why? They feel it’s not enough to pay for 70,000 victims who have cancer. Talc safe for men. The lawyers say that J&J should seek a bigger settlement or pursue individual claims in the event that the latest bankruptcy is dismissed.

But there’s a separate group of lawyers outside of the leadership in that class action. They have amassed tens of thousands of cases. This group wants to settle the case now for what many argue is far less than what these victims deserve. Their argument is two-fold. The first is that they claim the settlement of around 100,000 dollars per plaintiff is fair.

It’s a difficult argument to argue. However, their second argument has more substance: the victims will be no longer patient and demand the money immediately.

April 12 2023 Update: Some people are wondering if J&J is able to file for bankruptcy again. The answer is complex and complicated. But let’s try to explain it in simple terms.
Johnson & Johnson asserts that bankruptcy is the only means to resolve both current and future talc lawsuits conclusively. Also, it thinks it will pay less should there be a bankruptcy component that applies pressure to settle. Talc safe for men. Going back to the 400-year span of American history, the firm believes that bankruptcy is beneficial to all parties as it distributes settlement payments more equitably and more efficiently than trial courts which are where litigants get significant awards while others receive nothing.

The basic tenet of the 3rd Circuit decision was this is not a case of the profit-making company that has a subsidiary to take the legal responsibility and declare bankruptcy, which is what Congress considered when it was drafting the Bankruptcy Code. It also clarified that the entity was financially crisis due to the fact that J&J promised unlimited funding.
Thus, J&J did not hesitate to take advantage of the unlimited funding aspect of the agreement and did not promise to fund unlimited lawsuits. The company says that its new financing agreements with its subsidiary address concerns of the appellate court, while supplying funds for claim payments. In the hope that offering victims lesser money could solve the underlying issue.

Attorneys representing cancer patients who oppose the deal counter this with what you conclude is a defense against legal nonsense by pointing out legal nonsense: J&J fraudulently transferred $50 billion in assets away from LTL Management to circumvent the appeals court’s previous decision. Hyperbole did not go unnoticed by the victims’ lawyers, who call it the most significant “fraudulent move of assets in United States history.”

Notwithstanding the legal mumbo jumbo, J&J does not really think this bankruptcy will survive. It is however a method of pushing this $8.9 billion settlement, and to keep pressure on plaintiffs.

April 10 2023 Update Bloomberg provides an insightful piece on a law that has been passed in New Jersey that is shedding new light on litigation funding in the baby powder suit for class actions. Funders of litigation Virage Capital Management and TRGP Capital invested in hundreds of lawsuits from Johnson & Johnson (J&J) concerning talc products in exchange for a percentage of any settlements. J&J has now offered an offer of $8.9 billion to settle lawsuits.

The funders’ involvement is public information because of an New Jersey court rule requiring the disclosure of certain information about funders outside the state. The rules aim to respond to the increasing calls for the regulation of lawsuit funders. J&J faces over 60,000 claims when you combine federal and state baby powder lawsuits. Third-party funding for mass tort lawsuits has pros and pros and. However, there is no doubt that we are witnessing how third-party funding can level the playing field for individuals and big companies in the courtroom.

April 4 2023 Update: It is fun to watch the worm turning in this litigation. J&J was hit again this week, when an appeals court in the Third Circuit denied J&J’s request to continue the automatic stay in the meantime that J&J appeals a bankruptcy decision in the U.S. Supreme Court. This automatic stay froze the cases of talcum powder in a number of years and stopped the filing of new lawsuits ever since J&J initiated the controversial effort to spin the talc liability off into a bankrupt subsidiary more than one year ago. Talc safe for men. After it was decided that the 3rd Circuit ruled that this bankruptcy was not legal a few months ago, the stay was lifted. J&J had hoped to have it continued pending an appeal to the SCOTUS appeal. But the answer was no.
April 1, 2023 Update: Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. There is a chance that of the Supreme Court is willing even to consider the appeal? Low.
March 16 2023 Update: with the bankruptcy stay now in effect, the first new cases were filed and incorporated into the Talcum Powder class action MDL in the space of a year. Seven new talc cases were joined to the MDL over the last month and brought the total number of pending cases up to 37,522.

February 25 2023 Update: A Congressmen from Tennessee is now demanding that the U.S. Government Accountability Office (GAO) launch an investigation to determine how much J&J Talc products have cost the government in the decades.
in a letter to the GAO, Rep. Steven Cohen (D-Ten.) in a recent letter to the GAO, Rep. Steven Cohen (D-Ten. J&J of failing to recognize the dangers of its talc products for years while tax dollars were spent treating those injured by exposure to the chemicals. This lawsuit comes a few weeks after J&J’s major loss in the 3rd Circuit Court of Appeals.

Talc safe for men. J&J must begin making reasonable settlement offers to victims to getting this behind. This is a blemish on one of the greatest firms.

February 14 2023 Update: At a hearing today in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention in light of his 3rd U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
