April 12 2023 Update: Some people are asking how J&J can go through bankruptcy once more. The answer is complicated and complex. Let’s try to clarify it in simple terms.
Johnson & Johnson asserts that bankruptcy is the only means to deal with both present and future lawsuits involving talc conclusively. Lawyers representing cancer patients who oppose the agreement counter this argument by saying that it is a defense against legal nonsense by pointing out legal nonsense: J&J fraudulently transferred $50 billion of assets away from LTL Management to circumvent the appeals court’s earlier decision. Hyperbole was not spared by the victims’ lawyers, who call it the biggest “fraudulent deal ever in United States history.”
Despite all the legal jargon, J&J does not really think this bankruptcy will survive. But it’s a way to try and push the $8.9 billion settlement through and maintain the pressure on plaintiffs.
April 10 2023 update: Bloomberg offers an informative report on a brand new law that has been passed in New Jersey that is shedding new light on litigation funding in the baby powder suit for class actions. Funders of litigation Virage Capital Management and TRGP Capital invested in hundreds of lawsuits that were brought against Johnson & Johnson (J&J) concerning talc products in exchange for a share of any settlements. The involvement of the funders is public information due to an New Jersey court rule requiring the release of certain details about outside funding backers.
