Johnson & Johnson asserts that bankruptcy is the only method to settle both present and future talc-related lawsuits definitively. Lawyers representing cancer patients who oppose the agreement counter this by arguing that the plaintiff is countering legal nonsense with legal absurdity: J&J fraudulently transferred $50 billion of assets from LTL Management to circumvent the appeals court’s earlier ruling. Hyperbole did not go unnoticed the lawyers representing victims call this the biggest “fraudulent transfer that has occurred in United States history.”
In spite of the legal jargon, J&J does not really believe that this bankruptcy will last. But it is a way of trying to push this $8.9 billion settlement and keep the pressure on plaintiffs.
