April 25, 2023 Update: Talc plaintiffs have demanded a judge disqualify their Chapter 11 case filed by LTL Management LLC, a absurdly fabricated Johnson & Johnson subsidiary, declaring that the company isn’t financially strained. LTL was denied Chapter 11 in January. 3rd Circuit dismissed its first Chapter 11 case in January and said that the company was not eligible to receive bankruptcy relief because it did not show financial difficulties.
The plaintiffs argue that the 2nd Chapter 11 case is an abuse of the bankruptcy system and that it’s being conducted in bad good faith. J&J states that the bankruptcy settlement is backed by “significant backing” from firms representing about 60,000 potential plaintiffs. It is fair to say that lawyers representing plaintiffs and victims ‘ lawyers are not united over the $8.9 billion settlement offer.

This argument isn’t easy to present. The second argument is more substance: the victims will now not wait and they want to get their money right now.
April 12 2023 Update: People are looking for ways J&J can file for bankruptcy once more. The answer is complicated and confusing. Let’s try to simplify it simply.
Johnson & Johnson asserts that bankruptcy is the only way to address both present and future talc-related lawsuits definitively. It believes that it will be less expensive when there is a bankruptcy component that applies pressure to settle. Talcum powder lawsuit cnn. Moving past hundreds of years of American past, the company believes that bankruptcy is beneficial to everyone by dispersing settlement payments more evenly and effectively than trial courts where litigants are awarded significant settlements while others get nothing.
The gist in this 3rd Circuit decision was this is not a case of a profitable company making subsidiaries to meet the legal risk and declare bankruptcy, which is what Congress had in mind when it came to drafting the Bankruptcy Code. However, it also stated that the entity was financially crisis because J&J promises unlimited funding.
Then J&J took advantage of the unlimited funding part of the holding and didn’t promise to offer unlimited funding for litigation. The company claims that modified financing arrangements with its subsidiary will address appeals court’s concerns while still offering funds to pay claims. In the hope that offering victims less money will solve the overall issue.
Attorneys representing cancer patients who do not agree with the agreement counter the agreement with what is a defense against legal nonsense by pointing out legal nonsense: J&J fraudulently transferred $50 billion of assets away from LTL Management to circumvent the appeals court’s decision. Hyperbole is not exempt the lawyers representing victims call this the biggest “fraudulent move in United States history.”
Notwithstanding the legal mumbo jumbo, J&J does not really believe this bankruptcy will be able to last. But it’s a way of pushing this $8.9 billion settlement and keep the pressure on plaintiffs.
April 10 2023 update: Bloomberg has an interesting piece on a law that has been passed of New Jersey that is shedding new light on litigation funding in the plaintiffs in the class action. Litigation funders Virage Capital Management and TRGP Capital invested in hundreds of claims that were brought against Johnson & Johnson (J&J) over talc products in exchange for a share of any wins. J&J has now offered that it will pay $8.9 billion in settlements for all lawsuits.
The involvement of the funders is public information due to a New Jersey court rule requiring the disclosure of certain information about outside funding backers. The rule aims to address the growing calls for regulation of litigation funders. J&J is facing more than 60,000 claims when you add up federal and state Baby Powder lawsuits. Third-party funding in mass tort claims has pros and pros and. However, there is no doubt that we are seeing how third-party funding can level the playing field between individuals and large corporations in the courtroom.
