LTL declared bankruptcy a second time just over two hours after the decision to dismiss, arguing that its second attempt was different in that it had less money available and had more support for the possibility of settling.

Todos los talcos tienen asbesto. “The law firms behind this filing have financial interests that conflict with, differ from and oppose the interests which their clientele. We will be submitting a response to the appellate court.”
Todos los talcos tienen asbesto. Clay Thompson, a lawyer for MRHFM that boasts more than mesothelioma victims who have filed lawsuits against J&J and J&J, has said that J&J’s second bankruptcy effort will fail.
“J&J issue press releases that boast about how amazing its plan is while simultaneously requesting that details of the plan, such as what individual sick people would actually receive — be kept private,” Thompson said in the statement. “What does the company have to hide?”
Kaplan has directed the parties to create a strategy for reorganization, under the oversight by two mediators.
On February 20, 2022 Kaplan confirmed J&J’s recourse to Chapter 11 to hasten a settlement that would relieve J&J from the thousands of lawsuits concerning its talcum products.
But in January of this year an appeals court of the federal government overturned the ruling, ruling that the company was not able to be considered in “financial trouble.”
After J&J’s make an appeal before the U.S. Supreme Court was denied at the end of April J&J was granted a second petition for bankruptcy about two hours later. In response, Kaplan froze the lawsuits for 60 days, allowing the company to decide whether to grant to file for bankruptcy again.

June 1, 2023 Update: Todos los talcos tienen asbesto. First trial after J&J took the decision to disband its talc segment and file for bankruptcy is an important moment in the ongoing talc litigation saga. Trial started on Monday in the poignant case of a young 24 year-old plaintiff, diagnosed with a rare and aggressive type of mesothelioma last year. which lawyers on both sides acknowledge is a grave tragedy.
Opening statements revealed huge differences between the sides’ narrative. The attorney for the plaintiff took aim towards Johnson & Johnson, alleging the use of deceitful strategies in its research practices as well as throughout the litigation process. According to the attorney, the company tried to manipulate asbestos’ definition, in spite of internal documents from 1978 and 1994 showing that asbestos fibers found in plaintiff’s tissue are included.
Johnson & Johnson’s uncertain $8.9 billion settlement offer hangs in the balance as we development of the trial. Despite the particularity of this mesothelioma-related case and its distinct issues compared to the majority of talcum powder lawsuits A verdict in favor of the plaintiff could cause the company with a major setback in its expectations of widespread acceptance of the settlement they have proposed among plaintiffs.
May 31st, 2023 Update: Johnson & Johnson’s bankrupted talc unit has is defending their two-time Chapter 11 filing in the in the face of challenges from injured talc claimants. In an opposition filed with the New Jersey bankruptcy court, the company argued that the case differed fundamentally from the first filing. It emphasized the unprecedented commitment to $8.9 billion in settlement from J&J which is the biggest settlement ever to be made in the history of a mass tort bankruptcy. Todos los talcos tienen asbesto. The issue is not discussed: whether the magnitude of the settlement signifies that it’s an equitable settlement. J&J also claimed support from several plaintiffs’ legal firms representing more than 600,00 claimants. This is difficult to verify but is probably incorrect.
May 24 2023 Update: As of Johnson & Johnson’s 2021 bankruptcy filing, the very first trial on the cosmetic talc products it claims to that contain asbestos is scheduled to begin jury selection on Monday, California within the Alameda County Superior Court, which is a well-known jurisdiction for plaintiffs. The trial also includes six retailers accused of selling talc-containing products.
May 22nd, 2023 Update: Lawyers involved in the 2nd J&J Talc bankruptcy are battling over who should be appointed to the position of future claims representative, the role is crucially essential in resolving the talc claims. Todos los talcos tienen asbesto. Randi Ellis, a lawyer who regularly appears in MDLs across the country was appointed the claims representative in the initial bankruptcy. J&J’s defense team would like Ellis to be appointed in that position and again, but attorneys for the plaintiffs in talc are arguing due to the fact that Ellis has an unrelated conflict of interest that would prevent her from assuming that position in the future. This conflict is rooted in the issue that Ellis was reportedly involved in the creation of the hotly contesting second bankruptcy, which raises concerns about her capacity to be neutral. It’s true that the bankruptcy will be tossed out anyway.
May 17th, 2023 Update: The pretend company that J&J created for the talc litigation bankruptcy informed the New Jersey bankruptcy court that they have set aside $400 million to pay the claims brought by states accusing the company of deceptive advertising for its talc products. Todos los talcos tienen asbesto. That’s an $8.5 billion settlement for cancer sufferers. It’s hard to imagine the scenario in which J&J can get the settlements of baby powder through given these numbers. While J&J’s $8.5 billion offer seems like a lot of money initially, it will not appear appealing when you look at the numbers. The proposed settlement based on our rough calculations would not offer victims anything more than $100,000 per case. This isn’t enough.
May 15 2023 update: J&J is potentially facing a lawsuit brought by an advocacy group that represents cancer victims. Todos los talcos tienen asbesto. The group claims J&J intentionally canceled the $61.5 billion fund-raising agreement that it had with its company subsidiary LTL Management LLC, to simulate financial stress and to validate the company’s Chapter 11 bankruptcy filing. The group asserts this action is a fraud transfer of rights of compensation for victims. They intend to investigate J&J’s actions in the wake of the dismissal of LTL’s first bankruptcy suit.
May 10, 2023 Update: Next week, the U.S. Bankruptcy Court in New Jersey will hear oral arguments on a petition to dismiss the second bankruptcy application from J&J subsidiaries LTL Management. May 5th, 2023: Update on Talc provider Whittaker, Clark & Daniels filed for Chapter 11 bankruptcy due to numerous lawsuits alleging that its Talc products caused cancer through asbestos exposure. Todos los talcos tienen asbesto. More than 2700 people have filed lawsuits against the company and it has been spending $1 million a month on legal defense. The company’s recent $29 million verdict that was handed down in South Carolina forced it to file for bankruptcy protection, arguing for a fair distribution of assets between talc claimants rather than being confiscated through the receiver. Other talc suppliers have also declared bankruptcy because of legal proceedings.
May 4, 2023 update: U.S. bankruptcy judge Michael Kaplan has directed Johnson & Johnson to relaunch settlement discussions with lawyers who turned down the proposed $8.9 billion settlement offer. In Trenton, New Jersey yesterday, the parties appeared before a judge to discuss next steps for this second case of bankruptcy and Judge Kaplan has pushed for further settlement talks.
This is the answer to settle these claims for J&J. A baby powder settlement could be made. Todos los talcos tienen asbesto. However, it will require more money – more billions of dollars of Johnson & Johnson.
Lawyers are split on whether or not to agree with the proposal and not all clients view this issue the same way their lawyer sees it. The second bankruptcy case is likely to be a failure the judge Kaplan has set a date for a hearing in June to determine if she will close the case for the third time.
May 3, 2023 Update A group of cancer victims who are suing Johnson & Johnson (J&J) asked to have J&J’s Third Circuit halt the bankruptcy filed by J&J subsidiary LTL Management, claiming it is an attempt to derail the litigation involving talc products. The group representing the claimants has filed a motion this week, asking the Third Circuit to consider their case and send it back the lower court with instructions for dismissing the bankruptcy. Todos los talcos tienen asbesto. They also asked that stopped tort litigation against J&J allow the litigation to continue.
LTL applied for Chapter 11 protection once again after its bankruptcy filing was denied by the Third Circuit earlier this year and offered an $8.9 billion deal. The committee believes that the recent ruling allowing LTL’s 2nd Chapter 11 to continue, in addition to halting trials against J&J is a reason for immediate Third Circuit review. The US Trustee also requested that an New Jersey bankruptcy court dismiss the LTL bankruptcy case. J&J’s global vice president of litigation Erik Haas, was quoted by Bloomberg as saying that J&J plans to file a statement to the appeals court characterizing the filing as an “desperate and legally insufficient move” by a select group of law firms that have competing financial interests.
May 1 2023 Update: One frequently asked question is how plaintiffs and their lawyers turn down $8.9 billion. That’s of course a lot of money. There are a lot of victims. Todos los talcos tienen asbesto. These are actually a good cases for plaintiffs. We were reminded of this recently with two talc trials ended in large verdicts for plaintiffs. In February mesothelioma cases, a talcum powder trial in Oregon resulted in an award worth $18.1 million. In the same month, a different mesothelioma-related talc case went to the court on the other side of South Carolina and resulted in an award of $29 million in favor of plaintiff. It was the same defendant as in these cases: Whittaker, Clark & Daniels Inc. which is one of the leading suppliers of talc in the U.S.
April 30 2023 Update: When J&J first attempted to drag the talcum powder litigation into bankruptcy, they came with the option of putting aside $2 billion for settlements. The sum was ridiculously low. All of the talc plaintiffs supported the offer. This time, however, J&J has increased the offer to $8.9 if the talc plaintiffs agree to a bankruptcy settlement and also has the support of a large part of the talc-related plaintiffs as well as their lawyers. Todos los talcos tienen asbesto. But 75% of the plaintiffs who are a talc, which is needed for approval of the bankruptcy plan It’s a long and difficult process with so many lawyers with large stocks of baby powder lawsuits that are opposed against the proposed settlement.
What can be done to end the impasse? More billions.
April 25 2023, Update Talc cancer claimants have asked a judge to disqualify their Chapter 11 case filed by LTL Management LLC, a absurdly-made-up Johnson & Johnson subsidiary, saying the company is not financially troubled. LTL applied for Chapter 11 to settle tens of thousands of claims that J&J’s baby products caused cancer. Todos los talcos tienen asbesto. LTL was denied Chapter 11 in January. 3rd Circuit dismissed its first Chapter 11 case in January in a ruling that said the company wasn’t eligible for bankruptcy relief because it was unable to demonstrate financial difficulties.
The plaintiffs argue that LTL’s Second Chapter 11 case is an overreach of the bankruptcy system and that the case is being handled in bad faith. J&J states that the bankruptcy settlement has “significant backing” from companies representing approximately 60,000 claimants. It’s fair to say that the plaintiffs’ attorneys and victims are divided over their disagreement over the $8.9 billion deal.
April 21st, 2023 Update A bankruptcy judge has ruled in favor of Johnson & Johnson must face new lawsuits alleging that the company sold baby powder that was contaminated and causing cancer. Even though trials for Talc lawsuits are suspended for a minimum period of 60 days however, new lawsuits may be filed and lawyers can begin preparing their cases. Todos los talcos tienen asbesto. Judges expressed doubt about J&J’s ridiculous effort to revive its strategy by filing a second bankruptcy trial.
April 13, 2023 update: the biggest update is about the $8.9 billion over 25 year period settlement offered. Lawyers representing cancer victims within the MDL group action promised to fight the settlement alongside Talc claimants. Why? They believe it’s too little money for the those suffering from cancer who are 70,000. Todos los talcos tienen asbesto. The lawyers say that J&J should negotiate a larger settlement or litigate individual claims if the latest bankruptcy is thrown out.
There is a different group of lawyers outside of the top leadership in the class action. These lawyers have collectively amassed the equivalent of tens of thousands of lawsuits. The group is seeking to settle the case now with what they believe is lower than what the victims should be paid. Their argument seems to be twofold. The first is that they claim the settlement – about the equivalent of $100,000 per plaintiff – is fair.
This argument isn’t easy to prove. But their second argument has more force: the victims can no longer wait and want the money immediately.
April 12, 2023 Update: People are wondering if J&J can file for bankruptcy once more. The answer is complex and confusing. But let’s try to explain it simply.
Johnson & Johnson asserts that bankruptcy is the only way to settle both present and future talc litigations in a definitive manner. That is, it believes it can pay less should there be a bankruptcy element that creates pressure for a settlement. Todos los talcos tienen asbesto. In a quest to cover more than 400 years in American history, the company argues that bankruptcy benefits all parties by distributing settlement payments more equitably and effectively than trial courts where litigants are awarded significant awards while others receive nothing.
The gist of the 3rd Circuit decision was this isn’t a case that involves the profit-making company that has subsidiaries to meet the legal risk and declare bankruptcy – something Congress thought of when drafting its Bankruptcy Code. However, the court also ruled that the subsidiary was not in financial trouble because J&J promised unlimited funding.
Thus, J&J jumped on the unlimited funding aspect of the contract and did not promise to fund unlimited litigation. J&J claims that its updated financing arrangements with its subsidiary address the concerns of the appellate court, while offering funds to pay claims. In the hope that offering victims less money would solve the problem at hand.
Attorneys representing cancer victims who oppose the agreement counter the agreement with what is the legal argument. Todos los talcos tienen asbesto. They counter with legal absurdity: J&J fraudulently transferred $50 billion in assets to LTL Management to circumvent the appeals court’s ruling. Hyperbole did not go unnoticed by the victims’ lawyers, who call it the most significant “fraudulent move in United States history.”
Despite the legal jargon, J&J does not really believe that this bankruptcy will last. It is however a method to try and push the $8.9 billion settlement to keep pressure on plaintiffs.
April 10, 2023 update: Bloomberg is running an intriguing article on a new law in New Jersey that is shedding new light on litigation funding in the baby powder Class action suit. The funders who fund litigation Virage Capital Management and TRGP Capital invested in hundreds of lawsuits from Johnson & Johnson (J&J) over talc products in exchange in exchange for a portion of wins. J&J has now offered the payment of $8.9 billion to settle any lawsuits.
The funders’ involvement is public knowledge because of an New Jersey court rule requiring the release of certain details about outside funding backers. The rules aim to respond to the increasing calls for the regulation of lawsuit funders. J&J is facing more than 60,000 claims when you add up state and federal Baby Powder lawsuits. Third-party financing in mass tort cases has pros and pros and. There is no doubt that we are witnessing how third-party funding can level the playing field between individuals and large corporations in the courtroom.
April 4 2023 Update: It’s interesting to watch the worm turning in this legal battle. J&J took another hit this week when the Third Circuit denied J&J’s request to maintain the automatic stay in the meantime that J&J appeals a bankruptcy ruling before the U.S. Supreme Court. This automatic stay stopped thousands of talcum powder cases and stopped the filing of new lawsuits ever since J&J launched the controversial attempt to spin the talc liabilities off into a bankrupt subsidiary over a year back. Todos los talcos tienen asbesto. When the 3rd Circuit ruled that this bankruptcy was insufficient only a few months back, the stay was removed. J&J had hoped to have it continued pending hearing the SCOTUS appeal. However, the answer was no.
April 1, 2023 Update: Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The odds that is that the Supreme Court is willing even to take up the appeal? Low.
March 16th, 2023 Update: with the bankruptcy stay now fully lifted, the first new cases were filed and incorporated into the class action involving talcum powder MDL in over one year. Seven new talc cases were joined to the MDL in the past month increasing the number of cases that are pending to 37,522.
February 25 2023 Update The following information is available: A Congressmen from Tennessee has now demanded that be the U.S. Government Accountability Office (GAO) start an investigation into how much J&J Talc products have cost the government over the many years.
Recently, in an open letter to the GAO, Rep. Steven Cohen (D-Ten.) claimed that J&J of failing to recognize the dangers of its talc products over years while tax dollars were spent on treating people who suffered injuries from exposure to the product. The demand comes just weeks after J&J’s significant loss in the 3rd Circuit Court of Appeals.
Todos los talcos tienen asbesto. J&J must begin making reasonable settlements to victims to begin getting this behind it. It’s a mark on one of the world’s greatest firms.
February 14 , 2023 Update: At the hearing held today at the hearing in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention following his 3rd U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
