April 13 2023 Update: most important story is that there’s an $8.9 billion over 25 years offer for settlement. April 12 2023 Update: People are wondering if J&J can file for bankruptcy once more. The answer is complex and complicated. Let’s try to simplify it in simple terms.
Johnson & Johnson asserts that bankruptcy is the only method to resolve both current and future talc lawsuits conclusively. In other words, it believes it can pay less if there is the bankruptcy element which applies pressure for a settlement. Which baby powder is talc free. Moving past more than 400 years in American history, the company believes that bankruptcy is beneficial to all parties by distributing settlement payments more equitably and efficiently than trial courts, which are where litigants get significant settlements while others get nothing.
The gist in the 3rd Circuit decision was this is not a matter of a profitable company making subsidiaries to meet the legal responsibility and declare bankruptcy – something Congress thought of when drafting its Bankruptcy Code. However, it also stated that the entity was in financial trouble due to the fact that J&J offered unlimited financing.
Then J&J took advantage of the unlimited funding portion of the agreement and did not promise that it would provide unlimited funds for lawsuits. J&J claims that its new financing agreements with its subsidiary addresses the appeals court’s concerns while still providing funds for claims. It’s as if giving victims less money would solve the problem at hand.
Attorneys representing cancer victims who do not agree with the agreement counter this argument by saying that it is countering legal nonsense with legal nonsense: J&J fraudulently transferred $50 billion in assets away from LTL Management to circumvent the appeals court’s earlier ruling. The hyperbole wasn’t spared attorneys representing the victims claim this the biggest “fraudulent move that has occurred in United States history.”
Despite the legal jargon, J&J does not really believe that this bankruptcy will last. But it’s a way to try and push the $8.9 billion settlement, and to keep the pressure on plaintiffs.
April 10, 2023, Update Bloomberg has an interesting report on a brand new law in New Jersey that is shedding new light on the funding of litigation in the baby powder plaintiffs in the class action. Funders for litigation Virage Capital Management and TRGP Capital invested in hundreds of lawsuits that were brought against Johnson & Johnson (J&J) concerning talc products in exchange for a portion of any winnings. J&J is now offering that it will pay $8.9 billion to settle any lawsuits.
The involvement of funders is public information due to a New Jersey court rule requiring the disclosure of certain information about funders outside the state.
