April 25 2023 update: Talc patients have sought a court order to disqualify their Chapter 11 case filed by LTL Management LLC, a ridiculously made-up Johnson & Johnson subsidiary, which claims that the business is not financially distressed. LTL applied for Chapter 11 to settle tens of thousands of claims that J&J’s baby-powders caused cancer. Why is talc linked to asbestos. The 3rd Circuit dismissed its first Chapter 11 case in January in a ruling that said LTL was not a candidate for bankruptcy relief because it was unable to demonstrate financial trouble.
The plaintiffs argue that the Second Chapter 11 case is an fraud on the bankruptcy system and that it’s being conducted in bad faith. J&J states that the bankruptcy settlement is backed by “significant backing” from the firms that represent an estimated 60,000 plaintiffs. It’s fair to say that lawyers representing plaintiffs and victims ‘ lawyers are not united over their disagreement over the $8.9 billion settlement offer.
April 21st, 2023 Update: A bankruptcy judge has decided that Johnson & Johnson must face new lawsuits alleging that it sold tainted baby powder causing cancer. Although the trials for the lawsuits involving talc are delayed for a minimum period of 60 days, new lawsuits can be filed, and lawyers are able to begin preparing their cases. Why is talc linked to asbestos. Judges expressed doubt about J&J’s attempt to revive its strategy by filing another bankruptcy case.
April 13th, 2023: Update on the biggest news is the $8.9 billion over 25 years settlement offer. Lawyers representing cancer victims who are part of the MDL group action pledged to fight the settlement along with the talc claimants. Why? They feel it’s not enough to pay for more than 70,000 cancer victims. Why is talc linked to asbestos. The lawyers say that J&J should seek a bigger settlement or even litigate individual claims if the most recent bankruptcy is dismissed.
However, there is a second lawyer group that isn’t part of the leadership group in that class action. The lawyers collectively have accumulated the equivalent of tens of thousands of lawsuits. This group wants to settle in what many believe to be less than the victims deserve. Their argument seems to be twofold. The first is that they claim the settlement – which amounts to 100,000 dollars per plaintiff – is fair.
This is an argument that is difficult to argue. But their second argument has more substance: the victims will no longer wait and want their money now.
April 12 2023 Update: Many are wondering if J&J could file for bankruptcy again. The answer is complex and complicated. Let’s try to simplify it in simple terms.
Johnson & Johnson asserts that bankruptcy is the only means to settle both present and future talc lawsuits conclusively. In other words, it thinks it can get a lower rate in the event of a bankruptcy component that applies pressure to negotiate a settlement. Why is talc linked to asbestos. Moving past 400 years of American time, the business argues that bankruptcy benefits all parties by distributing settlement payments more equitably and effectively than trial courts, where litigants are awarded significant settlements while others get nothing.
The basic tenet in the 3rd Circuit decision was this isn’t a case that involves the profit-making company that has an affiliate to accept the legal responsibility and declare bankruptcy, which is what Congress considered when it was drafting the Bankruptcy Code. However, the court also ruled it was not financially trouble due to the fact that J&J assured it of unlimited funding.
This is why J&J took advantage of the unlimited funding part of the contract and didn’t make any promises to offer unlimited funding for cases. The company claims that updated financing arrangements with its subsidiary will address concerns of the appeals court while offering claim payment funds. As if providing victims with less money would solve the overarching problem.
Lawyers representing cancer victims who are against the agreement argue this argument by saying that it is countering legal nonsense with legal absurdity: J&J fraudulently transferred $50 billion of assets from LTL Management to circumvent the appeals court’s previous decision. The hyperbole wasn’t spared attorneys representing the victims claim it the biggest “fraudulent deal that has occurred in United States history.”
Notwithstanding the legal mumbo jumbo, J&J does not really believe this bankruptcy will be able to last. However, it’s a means to push for this $8.9 billion settlement and keep pressure on plaintiffs.
April 10, 2023 Update Bloomberg provides an insightful report on a brand new law that has been passed in New Jersey that is shedding new light on the funding of litigation in the class action lawsuit. Litigation funders Virage Capital Management and TRGP Capital invested in hundreds of claims against Johnson & Johnson (J&J) concerning talc products in exchange for a percentage of any wins. J&J has now offered to pay $8.9 billion to settle any lawsuits.
The funders’ involvement is public information because of the New Jersey court rule requiring the release of certain details about outside funding backers. This rule is intended to tackle the growing demands for the regulation of litigation funders. J&J has to deal with more than 60,000 lawsuits when you add up federal and state baby powder lawsuits. Third-party funding of mass tort cases has pros and pros and. There is no doubt that we are witnessing how third-party financing can help level the playing field between people as well as large corporations in court.
April 4, 2023 Update: It’s pleasing to see the worm turning in this legal battle. J&J was hit again this week, when the Third Circuit denied J&J’s request to continue the automatic stay during the time that J&J appeals an order granting bankruptcy at the U.S. Supreme Court. This automatic stay stopped thousands of talcum powder cases and stopped new lawsuits from getting filed ever since J&J launched the controversial attempt to spin the talc liabilities off into a bankrupt subsidiary over one year ago. Why is talc linked to asbestos. After it was decided that the 3rd Circuit ruled that this bankruptcy was insufficient only a few months back, the stay was revoked. J&J was hoping to have it continued pending an appeal to the SCOTUS appeal. The answer was no.
April 1, 2023 Update: Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The chance is that the Supreme Court is willing even to take up the appeal? Low.
March 16 2023 Update: with the bankruptcy stay in effect, the first new cases were filed and incorporated into the class action for talcum powder MDL in just over a year. Seven new talc-related lawsuits were added to the MDL over the last month increasing the number of cases pending to 37,522.
February 25 2023 Update This morning, a Congressmen from Tennessee has now demanded that authorities from the U.S. Government Accountability Office (GAO) launch an investigation into the amount J&J product containing talc has cost the government over the many years.
Recently, in an open letter to the GAO, Rep. Steven Cohen (D-Ten.) accused J&J of not recognizing the risks of its talc products over long while tax dollars utilized to treat people injured by exposure to the chemicals. The suit comes just a few days following J&J’s dramatic loss in the 3rd Circuit Court of Appeals.
Why is talc linked to asbestos. J&J should begin to make reasonable settlement proposals to victims to to put all of this behind it. This is a disgrace to one of the most prestigious companies.
February 14 2023 Update: In an appearance today in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention to follow the third U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
