April 25, 2023 update: Talc plaintiffs have sought a court order to reject their Chapter 11 case filed by LTL Management LLC, a absurdly-made-up Johnson & Johnson subsidiary, declaring that the company isn’t financially distressed. LTL applied for Chapter 11 to settle tens of thousands of claims that J&J’s baby products caused cancer. Why is talc powder bad for you. In the end, however, the 3rd Circuit dismissed its first Chapter 11 case in January, saying the company was not eligible for bankruptcy relief because it had not demonstrated financial distress.
The plaintiffs argue that LTL’s Second Chapter 11 case is an overreach of the bankruptcy system and that it’s being pursued in bad good faith. J&J states that the bankruptcy settlement is backed by “significant support” from the firms that represent about 60,000 potential people who are claiming. It’s fair to say that the plaintiffs’ attorneys and victims ‘ lawyers are not united over their disagreement over the $8.9 billion offer for settlement.

April 13, 2023 update: the major news is the $8.9 billion over the next 25 year period settlement offered. Lawyers representing cancer victims within the MDL collective action promised to fight the settlement alongside the talc claimants. Why? They argue that it’s not enough to pay for 70 000 cancer patients. Why is talc powder bad for you. These lawyers argue that J&J should seek a bigger settlement or litigate individuals’ claims if the current bankruptcy is thrown out.
However, there is a second group of lawyers that is not part of the top leadership in the class action. These lawyers have collectively amassed tens of thousands of cases. This group wants to settle today for what is believed to be less than the victims deserve. Their argument seems to be twofold. The first is that they claim the settlement of around the equivalent of $100,000 per plaintiff – is fair.
This is an argument that is difficult to make. But their second argument has more force: the victims can no longer wait and want the money immediately.
April 12 2023 Update: Some people are wondering if J&J is able to file for bankruptcy once more. The answer is complicated and complicated. However, let’s attempt to explain the issue in a simple way.
Johnson & Johnson asserts that bankruptcy is the only way to settle both present and future lawsuits involving talc conclusively. It believes that it will be less expensive if there is the bankruptcy element which applies pressure for a settlement. Why is talc powder bad for you. Going back to hundreds of years of American time, the business argues that bankruptcy benefits all parties as it distributes settlements more equally and effectively than trial courts, which are where litigants get significant settlements while others get nothing.
The essence of this 3rd Circuit decision was this is not a matter of an enterprise that is profitable, forming subsidiaries to meet the legal liability and declare bankruptcy – something Congress contemplated when drafting the Bankruptcy Code. However, the court also ruled that the entity was financially trouble because J&J offered unlimited financing.
This is why J&J decided to go with the unlimited funding portion of the contract and didn’t make any promises to fund unlimited litigation. The company says that its new financing agreements with its subsidiary will address appeals court’s concerns, while providing funds for claims. It’s as if giving victims lesser money could solve the underlying issue.
Attorneys representing cancer victims who do not agree with the agreement counter the agreement with what is the legal argument. Why is talc powder bad for you. They counter with legal nonsense: J&J fraudulently transferred $50 billion of assets from LTL Management to circumvent the appeals court’s previous decision. Hyperbole is not exempt the lawyers representing victims call this the biggest “fraudulent transaction of assets in United States history.”

April 10, 2023 update: Bloomberg is running an intriguing article on a new law of New Jersey that is shedding new light on the funding of litigation in the plaintiffs in the class action. Litigation funders Virage Capital Management and TRGP Capital invested in hundreds of claims against Johnson & Johnson (J&J) over talc products in exchange for a share of any settlements. J&J is now willing an offer of $8.9 billion in settlements for all lawsuits.
The involvement of the funders is publicly available because of the New Jersey court rule requiring the release of certain details about outside funding backers. This rule is intended to address the growing calls for regulation of the litigation funders. J&J has more than 60,000 claims when you take into account federal and state baby powder lawsuits. Third-party financing in mass tort cases has both pros and cons. But there is no question that we are witnessing how third-party financing can help level the playing field between individual as well as large corporations in court.
April 4, 2023 Update: It is interesting to watch the worm turning in this legal battle. J&J has taken another blow this week, when an appeals court in the Third Circuit denied J&J’s request to extend the automatic stay as J&J appeals a bankruptcy decision to the U.S. Supreme Court. It has froze thousands of talcum cases and prevented new lawsuits from arising ever since J&J began the controversial plan to spin the talc liability into a bankrupt company over one year ago. Why is talc powder bad for you. After the 3rd Circuit ruled that this bankruptcy was not valid some months ago, the stay was revoked. J&J wanted to see it continued pending the SCOTUS appeal. But, no.
April 1, 2023 Update: Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The odds that of the Supreme Court is willing even to take up the appeal? Low.

Seven new talc lawsuits were added to the MDL during the month of March and brought the total number of cases pending to 37,522.
February 25 2023 Update The following information is available: A Congressmen from Tennessee has now demanded that authorities from the U.S. Government Accountability Office (GAO) launch an investigation to determine how much J&J products containing talc have cost the government over the many years.
Recently, in an open letter to the GAO, Rep. Steven Cohen (D-Ten.) has accused J&J of ignoring the risks of its talc products over decades while tax dollars were spent on treating people who suffered injuries from exposure to the product. The demand comes just weeks after J&J’s loss to the 3rd Circuit Court of Appeals.
Why is talc powder bad for you. J&J has to begin making reasonable settlement proposals for victims in order in putting this behind it. It is a stain on one of the top companies.
