Litigation funders Virage Capital Management and TRGP Capital invested in hundreds of lawsuits from Johnson & Johnson (J&J) on behalf of talc products. They exchanged in exchange for a portion of wins. J&J is now willing an offer of $8.9 billion to settle all lawsuits.
The involvement of funders is public knowledge because of a New Jersey court rule requiring the release of certain details about funders outside the state. The law is designed to respond to the increasing calls for the regulation of lawsuit funders. J&J is facing more than 60,000 claims when you take into account state and federal baby powder lawsuits.
