April 13th, 2023 update: the big update is about the $8.9 billion over 25 years of settlement. Johnson & Johnson asserts that bankruptcy is the only option to settle both present and future talc-related lawsuits definitively. Also, it believes it can pay less when there is a bankruptcy element that creates pressure to negotiate a settlement. Are talc powder safe. Moving past hundreds of years of American past, the company asserts that bankruptcy benefits all parties because it distributes settlements more fairly and effectively than trial courts in which some litigants receive substantial award while others do not.

The gist in this 3rd Circuit decision was this is not a case – the profit-making company that has a subsidiary to take the legal responsibility and declare bankruptcy – Congress thought of when drafting its Bankruptcy Code. However, the court also ruled it was not in financial distress due to the fact that J&J offered unlimited financing.

Attorneys representing cancer patients who do not agree with the agreement counter this by arguing that the plaintiff is a defense against legal nonsense by pointing out legal absurdity: J&J fraudulently transferred $50 billion in assets to LTL Management to circumvent the appeals court’s previous ruling. Hyperbole is not exempt attorneys representing the victims claim this the biggest “fraudulent move in United States history.”

Despite the legal jargon, J&J does not really think that the bankruptcy will endure. But it’s a way to try and push the $8.9 billion settlement and keep pressure on plaintiffs.

Funders of litigation Virage Capital Management and TRGP Capital invested in hundreds of lawsuits from Johnson & Johnson (J&J) concerning talc products in exchange for a percentage of any winnings. J&J is now offering an offer of $8.9 billion to settle all lawsuits.

The involvement of the funders is publicly available because of the New Jersey court rule requiring the release of certain details about funding sources outside of the.
