May 1 2023 Update: A frequently asked question is how could plaintiffs and their lawyers turn around $8.9 billion. Of course, it’s an enormous amount of money. But there are plenty of victims. Does talc cause lung cancer. And these are really good claims for plaintiffs. We were reminded of this recently in two talc trials which have resulted in huge verdicts for the plaintiffs. In February, a talcum powder mesothelioma trial in Oregon was settled with an award worth $18.1 million. The following month, a second talc mesothelioma case went to the court in South Carolina and resulted in an award of $29 million for the plaintiff. April 30 2023 Update: When J&J first attempted to drag the lawsuit over talcum powder into bankruptcy, they came with an offer to set aside $2 billion to settle the case. The amount was absurdly low. Does talc cause lung cancer. But with 75% of talc plaintiffs, which is required for bankruptcy plan approval is a difficult road due to the sheer number of lawyers with vast collections of baby powder-related lawsuits, opposed against the proposed settlement.

April 25 2023 update: Talc Cancer victims have asked a judge to reject their Chapter 11 case filed by LTL Management LLC, a absurdly-made-up Johnson & Johnson subsidiary, which claims that the business is not financially strained. LTL filed for Chapter 11 to settle tens of thousands of claims that J&J’s baby products caused cancer. Does talc cause lung cancer. It was the 3rd Circuit dismissed its first Chapter 11 case in January, saying the company was not eligible to receive bankruptcy relief because it had not demonstrated financial difficulties.
The claimants argue that LTL’s third Chapter 11 case is an fraud on the bankruptcy system and it’s being conducted in bad good faith. J&J claims the bankruptcy settlement receives “significant support” from companies representing about 60,000 potential plaintiffs. It’s safe to say plaintiffs’ lawyers and victims are divided over what they believe is an $8.9 billion offer for settlement.
April 21st, 2023 Update: A bankruptcy judge decided that Johnson & Johnson must face new lawsuits alleging that the firm sold a baby powder that contained a chemical that causes cancer. Judges expressed skepticism about J&J’s attempt to relaunch its strategy in another bankruptcy case.
April 13, 2023 Update: The major announcement is an $8.9 billion over the course of 25 years offer for settlement. Lawyers representing cancer patients involved in MDL class action MDL Class Action have vowed to fight the settlement along with Talc claimants. Why? They believe it’s too little money for the 70,000 victims who have cancer. Does talc cause lung cancer. The lawyers say that J&J should negotiate a larger settlement or pursue individual claims if the latest bankruptcy is declared unconstitutional.
However, there is a second set of lawyers who are not part of the leadership of that class action. These lawyers have amassed hundreds of thousands of cases. The group is seeking to settle the case now for what many argue is far less than what these victims deserve. The argument they make is two-fold. They argue that the settlement – about an average of $100,000 per plaintiff is fair.
This argument isn’t easy to present. However, their second argument has more force: victims should no longer wait and want the money immediately.
April 12 2023 Update: People are seeking out how J&J can go through bankruptcy again. The answer is complex and confusing. Let’s try to clarify it clearly.
Johnson & Johnson asserts that bankruptcy is the only way to resolve both current and future talc litigations in a definitive manner. Also, it thinks it can get a lower rate when there is the bankruptcy element which applies pressure to settle. Does talc cause lung cancer. In a quest to cover hundreds of years of American past, the company claims that bankruptcy benefits all parties by distributing settlement payments more equitably and efficiently than trial courts, where some litigants receive significant award while others do not.
The main thrust in this 3rd Circuit decision was this is not a matter of a profitable company making subsidiaries to meet the legal responsibility and declare bankruptcy, which is what Congress contemplated when drafting the Bankruptcy Code. However, it also stated that the subsidiary was not in financial difficulty because J&J offered unlimited financing.
This is why J&J did not hesitate to take advantage of the unlimited funding portion of the holding and did not promise that it would provide unlimited funds for litigation. J&J claims that its updated financing arrangements with its subsidiary addresses the appeals court’s concerns, while supplying funds for claim payments. As if providing victims with less money will solve the overarching problem.
Lawyers representing cancer patients who do not agree with the agreement counter this by arguing that the plaintiff is countering legal nonsense legal absurdity: J&J fraudulently transferred $50 billion of assets from LTL Management to circumvent the appeals court’s previous decision. Hyperbole was not spared attorneys representing the victims claim it the most significant “fraudulent deal of assets in United States history.”
Despite all the legal jargon, J&J does not really think that the bankruptcy will endure. However, it’s a means of pushing this $8.9 billion settlement through and maintain the pressure on plaintiffs.
April 10 2023 Update: Bloomberg has an interesting article on a new law within New Jersey that is shedding new light on litigation funding in the baby powder class action lawsuit. Funders for litigation Virage Capital Management and TRGP Capital invested in hundreds of lawsuits that were brought against Johnson & Johnson (J&J) on behalf of talc products. They exchanged in exchange for a portion of settlements. J&J is now willing that it will pay $8.9 billion to settle any lawsuits.
The funders’ involvement is public information because of the New Jersey court rule requiring the release of certain details about outside funding backers. The law is designed to address the growing calls for regulation of litigation funders. J&J is facing more than 60,000 claims when you combine state and federal Baby Powder lawsuits. Third-party financing in mass tort cases has pros and pros and. But there is no question that we are seeing the ways that third-party funding can even the playing field between individual as well as large corporations in court.
April 4, 2023 Update: It is interesting to watch the worm turning in this litigation. J&J suffered another setback this week, when an appeals court in the Third Circuit denied J&J’s request to maintain the automatic stay while J&J appeals an appeal in the U.S. Supreme Court. This automatic stay halted thousands of talcum powder cases and stopped new lawsuits from being filed ever since J&J initiated the controversial effort to spin the talc liabilities into a bankrupt company over one year in the past. Does talc cause lung cancer. After it was decided that the 3rd Circuit ruled that this bankruptcy was insufficient some months ago, the stay was revoked. J&J had hoped to have it continue in the meantime of hearing the SCOTUS appeal. The answer was no.
April 1, 2023 Update: Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The chance of the Supreme Court is willing even to hear the appeal? Low.
March 16 2023 Update: with the bankruptcy stay in effect, the first new cases were filed and incorporated into the class action involving talcum powder MDL in just over a year. Seven new talc-related lawsuits were included in the MDL in the last month increasing the number of cases that are pending to 37,522.
February 25, 2023 Update The following information is available: A Congressmen from Tennessee is now demanding that authorities from the U.S. Government Accountability Office (GAO) launch an investigation into the cost J&J product containing talc has cost the government in the years.
In a recent letter to the GAO, Rep. Steven Cohen (D-Ten.) claimed that J&J of not recognizing the risks of its talc products over many years, while tax dollars were spent treating those injured by exposure to the product. This lawsuit comes a few weeks after J&J’s loss to the 3rd Circuit Court of Appeals.
Does talc cause lung cancer. J&J must begin making reasonable settlement offers for victims in order the process of putting all this behind. This is a blemish on one of the most prestigious businesses.
February 14 , 2023 Update: At an earlier hearing at the hearing in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention following the third U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
