Johnson & Johnson (JNJ.N) has set aside $400 million to resolve U.S. state consumer protection actions as part of its broad $8.9 billion deal to settle claims that its Baby Powder and other talc product causes cancer. Is talc safe for skin.

J&J company subsidiary LTL Management filed a bankruptcy plan in New Jersey late on Monday that outlines how the firm intends to pay for different types of cancer patients in a bankruptcy settlement. Is talc safe for skin. J&J has said that its Talc products are safe, and do not cause cancer. It is attempting for the second time to end more than 38,000 cases in bankruptcy and stop new cases from arising in the near future.
LTL’s bankruptcy plan would pay $400 million into a separate trust for claims filed with state attorneys general alleging that J&J was in violation of the state’s unfair commercial practices as well as consumer protection laws through misleading consumers regarding the security of its talc-based products.

A number of states had already initiated consumer protection cases against J&J before LTL’s first bankruptcy filing stopped those investigations from moving forward in 2021. Is talc safe for skin. New Mexico and Mississippi had already filed suit with Johnson & Johnson before then, and the states of Arizona, Maryland, North Carolina, Texas and Washington had issued civil investigative subpoenas or demands according to court filings.

New Mexico and Mississippi have moved to dismiss LTL’s bankruptcy in a joint move with cancer victims and those affected by cancer and the U.S. Justice Department’s bankruptcy watchdog. have claimed that a lucrative company like J&J does not qualify for bankruptcy protections intended for people with debt problems.
LTL’s first attempt at resolving the bankruptcy cases was dismissed after similar arguments. The U.S. appellate court ruled it was not LTL did not have “financial distress” and thus not eligible under bankruptcy law. Is talc safe for skin. LTL filed a second bankruptcy just over two hours after that dismissal, arguing that the second bankruptcy was different due to the fact that there was less money available and more support for the settlement.

New Mexico and Mississippi said in their motion to dismiss LTL’s new bankruptcy violates state law enforcement authorities by seeking to unilaterally limit the liability of the company in state consumer protection laws.

The filings of LTL’s latest bankruptcy proceedings also include additional details about the way in which the company will evaluate and pay cancer claims in the event that the bankruptcy plan is approved.

The maximum amount under the settlement would be $500,000 to those diagnosed with cancer of the mesothelioma ovary before age 45 and $260,000 for people diagnosed with terminal ovarian cancer prior to age 45.

The proposed settlement offers discounts based on the nature and severity of the cancer, the person’s age, the history of the use of talc, and other aspects. Is talc safe for skin. For instance, a woman who used talc products weekly, had an ovarian cancer family history, cancer and was diagnosed the stage 2 ovarian cancer when she was 55 may qualify for a $21,125 payment under the program.

Judge gives order to J&J, talc opponents to engage in settlement talks.

Following another round of hearings in Johnson and Johnson’s efforts to utilize a Texas Two-Step bankruptcy strategy to resolve talc litigation, federal bankruptcy Judge Michael Kaplan has ordered the company and those opposing the plan to hold negotiations to settle the matter, Bloomberg reports.

With its second bankruptcy attempt for LTL Management, a subsidiary created by J&J to hold the claims–the company made a settlement offer of $8.9 billion. Is talc safe for skin. While a group of law firms representing plaintiffs is in favor of the settlement, a different group opposes the move.

In the last week, an opposition group, dubbed”the Official Committee of Talc Claimants requested the bankruptcy court to disqualify the petition by saying that LTL can not be considered to be in financial trouble.

“The filing is an incredibly legal and ineffective attempt by a few of law firms to try to stop claimants from voting on the resolution plan – a plan the vast majority of claimants approve of,” J&J’s litigation chief Erik Haas, said in an announcement. Is talc safe for skin. “The law firms behind the filing are pursuing financial interests which are in conflict with, diverge from, and oppose the interests of their clients. We will be submitting a response in the appeals court.”

Is talc safe for skin. Clay Thompson, a lawyer for MRHFM that has more than 80 mesothelioma patients who have filed lawsuits against J&J for bankruptcy, told the company’s second bankruptcy try failed.

“J&J sends out press releases about how great the plan is but simultaneously requesting that details of the plan, such as what individuals with illnesses would be treated to,” Thompson said in the statement. “What does the company have to conceal?”

Kaplan has instructed the sides to develop a new arrangement plan under the oversight by two mediators.

On February 20, 2022 Kaplan stated that J&J’s use of Chapter 11 to hasten a settlement that will free the company from the thousands of lawsuits concerning its talcum products.

However, in January of this year, a federal appeals court ruled against the decision, ruling that the company could not be considered to be in “financial distress.”

When J&J’s attempt to make an appeal before the U.S. Supreme Court was turned down at the end of April J&J applied for its first bankruptcy two hours after. In response to that move, Kaplan froze the lawsuits for 60 days to decide whether or not to approve to file for bankruptcy again.

J&J’s omnipotent profit engine fails after $6.9B the talc litigation cost.

With Two Chapter 11 attempts, J&J has bought 19 months during which cases have been in limbo. Is talc safe for skin. The company would like claimants to vote on accepting their settlement. J&J requires 75% acceptance in order for the agreement to be accepted.

Alongside the group of talc attorneys who have panned LTL’s bankruptcy plan, the U.S. Trustee, a branch that is part of the U.S. Department of Justice has also filed an appeal to dismiss LTL’s second bankruptcy case.

In a letter filed this week, U.S. trustee Andrew R. Vara wrote that the bankruptcy are “open to honest, but naive debtors.” Those doors “are not accessible to those that do not have a legitimate goal or who seek to use the bankruptcy process to hinder or delay their creditors.” Vara continued.

In its own words, J&J maintains there is no evidence conclusive that its Talc-based products, such as its iconic baby powder, can cause cancer. J&J has taken its products off of the market, first for North America in 2020–and the rest of the world next year.

J&J wants to avoid the cost of going to trial. It has prevailed in most of the cases decided in court, however some losses have been severe.
A high-profile trial in Missouri ended in a $4.7 billion verdict against the drug maker that was later reduced to $2.1 billion following appeals.

Johnson & Johnson faces high-stakes hearing over ‘Texas Two Step’ talc strategy: report
Overall, J&J has lost nine trial cases in talc which are being appealed or settled. Of the 41 trials, 32 of them ended in winning for J&J as well as mistrials or plaintiff verdicts that were reversed in appeal. Is talc safe for skin. Separately, the company in 2020 negotiated to settle nearly 1000 cases at a cost of 100 million dollars, Bloomberg stated at the time.

Johnson and Johnson Talcum Powder Lawsuit Update 2023 – Is Talc Safe For Skin

June 2 2023 Update: During the asbestos talc case at the trial in California yesterday, a few technical issues disrupted the opening statements of the defense attorneys. Is talc safe for skin. Jurors who were watching from home on Zoom, did hear Johnson and Johnson’s lawyer express doubts about the 70s research claiming asbestos was present in their product before the trial was abruptly closed.

In the meantime, the plaintiff was able to introduce their first witness, Arthur Langer. Langer explained that the existence of additional minerals along with the talc mineral is a given. He also testified that his team had notified J&J in 1971 of the presence of asbestos chrysotile in the talc produced by the company, although in less than 0.1 percent. He also uncovered more asbestos in 1976.

June 1st, 2023 Update: Is talc safe for skin. First trial after J&J has decided to separate its Talc segment and file for bankruptcy is an important turning point for the ongoing litigation drama. The trial started yesterday in the poignant trial of a young plaintiff who was diagnosed with a rare and aggressive form of mesothelioma last year. which lawyers on both sides of the argument agree is a tragic loss.

The opening statements exposed the huge differences between the sides’ story. The attorney representing the plaintiff took aim at Johnson & Johnson, alleging the use of misleading tactics in research practices and throughout the litigation process. According to the attorney the company attempted to manipulate the definition of asbestos in spite of internal documents from 1978 and 1994 showing that asbestos fibers in the plaintiff’s tissue are included.

Johnson &J’s tangled $8.9 billion settlement proposal hangs in the balance with the course of this trial. Despite the unique nature of the mesothelioma trial and its distinct issues compared to other lawsuits involving talcum powder and a decision in favor of the plaintiff could inflict an unintended setback to Johnson & J’s hope of gaining broad acceptance for their proposed settlement with plaintiffs.

May 31st 2023 Update: Johnson and Johnson’s bankrupt talc business was able to defend their Second Chapter 11 filing in the face of challenges from the talc injury plaintiffs. In an appeal to the New Jersey bankruptcy court, the subsidiary argued that the situation was fundamentally different from the prior filing. It also emphasized the unprecedented commitment of $8.9 billion from J&J which is the largest ever settlement in a mass tort bankruptcy case. Is talc safe for skin. The issue is not discussed: whether the size of the settlement signifies that it’s a fair settlement. J&J also claimed support from numerous plaintiffs’ law companies representing over the 60,000 plaintiffs. This is not easy to confirm but is probably incorrect.

May 24 2023 Update: Following Johnson & Johnson’s 2021 bankruptcy filing, the very first trial regarding its cosmetic talc products allegedly that contain asbestos is scheduled to begin jury selection on Monday, May 24, California at Alameda County Superior Court, which is a well-known jurisdiction for plaintiffs. The plaintiff claims his mesothelioma is the result of asbestos exposure from J&J’s products and J&J does not deny. The trial also involves six retailers who are accused of selling talc-containing products.

May 22nd, 2023 Update Lawyers involved in the 2nd J&J talc bankruptcy are fighting over who should be appointed to the role of a future claims representative. This is an important role essential to the resolution of the claim for talc. Is talc safe for skin. Randi Ellis, a lawyer who regularly appears in MDLs all over the nation, was appointed as the claims representative in the first bankruptcy. J&J’s defense group wants Ellis to be named to the position again, but lawyers for the plaintiffs in talc are arguing because Ellis has a conflict of interest that would prevent her from being appointed to that post in the future. The conflict stems from the issue that Ellis was believed to have been involved in the drafting of the highly contesting second bankruptcy, which raises doubts about her ability to be neutral. The reality is this bankruptcy could be tossed out anyway.

May 17, 2023 Update The pretend company that J&J made up for the talc litigation bankruptcy informed an New Jersey bankruptcy court that they have allocated $400 million as a settlement for claims made by states accusing the company of misleading advertising regarding its talc products. Is talc safe for skin. That’s an $8.5 billion settlement to cancer victims. It’s hard to imagine any scenario in which J&J can push these settlements for babies with these numbers. While J&J’s proposed $8.5 billion offer sounds like a lot of money initially, it will not look good when you do the math. This settlement offer based on our rough calculations – would not be able to pay victims more than $100,000 per case. That’s not enough.

May 15 2023, Update J&J is potentially facing a lawsuit from an advocacy group that represents cancer patients. Is talc safe for skin. The group claims that J&J deliberately withdrew a $61.5 billion funding agreement with its subsidiary, LTL Management LLC, to simulate financial stress and validate the unit’s Chapter 11 bankruptcy filing. The group asserts this action amounts to a fraudulent transfer of rights of compensation for victims. They will investigate J&J’s actions after the announcement of the decision to dismiss LTL’s first bankruptcy suit.

May 10 2023 Update: During the next week, next week, the U.S. Bankruptcy Court in New Jersey will hear oral arguments on a motion to dismiss the second bankruptcy filing of J&J company LTL Management. However, in the meantime LTL Management has filed an order calling for both parties to participate in a new settlement mediation hoping that it will be possible to reach a global settlement agreement been reached.

May 5 2023 Update: The talc provider Whittaker, Clark & Daniels filed for Chapter 11 bankruptcy due to numerous lawsuits alleging its talc products cause cancer from asbestos exposure. Is talc safe for skin. More than 2700 people have filed lawsuits against the company and the company was spending $1 million a month to defend itself. The company’s recent $29 million settlement in South Carolina forced it to apply for bankruptcy protection and argue for equitable distribution of assets to talc claimants, rather than being seized from the receiver. Other talc suppliers have also declared bankruptcy because of lawsuits.

May 4 2023, Update U.S. The bankruptcy Judge Michael Kaplan has directed Johnson & Johnson to restart negotiations with lawyers who have rejected the company’s proposed $8.9 billion deal. The court in Trenton, New Jersey yesterday, the parties appeared in court to discuss next steps in their second bankruptcy matter. Judge Kaplan encouraged further settlement talks.

This is the solution to resolve these claims for J&J. A baby powder settlement could be achieved. Is talc safe for skin. However, it’ll require additional money – perhaps billions of dollars – coming from Johnson & Johnson.

Lawyers are divided over whether to accept the proposal and not every client views the situation the same way their lawyer sees it. The second bankruptcy case is expected to be a failure and Judge Kaplan has set a date for a hearing in June to decide if he will dismiss the bankruptcy for the second time.

May 3 2023 Update: A group of cancer patients who have sued Johnson & Johnson (J&J) asked an order from they request that the Third Circuit halt the bankruptcy filed by J&J subsidiary LTL Management, claiming it is an attempt to halt the litigation involving talc products. The group of talc claimants filed a motion on Tuesday, asking that the Third Circuit to consider their case and then send it back the lower court, with instructions for dismissing the bankruptcy. Is talc safe for skin. They also asked that halted tort litigation against J&J should be permitted to proceed.
LTL requested Chapter 11 protection once again after its bankruptcy filing was rejected by the Third Circuit earlier this year and offered the possibility of an $8.9 billion deal. The committee believes that the recent ruling which allowed LTL’s third Chapter 11 to continue, in addition to halting trials against J&J should be subject to immediate Third Circuit review. The US Trustee requested the New Jersey bankruptcy court dismiss the LTL bankruptcy case. J&J’s vice president for global litigation Erik Haas, was quoted by Bloomberg saying that J&J plans to file a reply in the appeals court, characterizing the filing as a “desperate and legally insufficient move” by a handful of law firms with conflicts of financial interests.
May 1 2023 Update: One question people keep asking is how plaintiffs and their lawyers be able to turn down $8.9 billion. Of course, that’s an immense amount of money. But there are a lot of victims. Is talc safe for skin. These are an excellent claims for plaintiffs. We were reminded recently with two talc trials ended in large verdicts for plaintiffs. In February mesothelioma cases, a talcum powder trial in Oregon was settled with an award of $18.1 million. In the same month, a different mesothelioma trial involving talc was held for the court within South Carolina and resulted in the verdict of $29 million in favor of plaintiff. The defendant in both cases was Whittaker, Clark & Daniels Inc. one of the leading suppliers of talc within the U.S.
April 30th 2023 Update: J&J first attempted to drag the litigation over talcum powder into bankruptcy, it was met with an offer to set aside $2 billion for settlements. It was a ridiculously small amount. The talc plaintiffs had not agreed with it. This time, however, J&J has increased the offer to $8.9 If the talc plaintiffs accept a bankruptcy settlement and they have the backing of a significant portion of the talc plaintiffs as well as their lawyers. Is talc safe for skin. But 75% of the plaintiffs of talc are required for bankruptcy plan approval, it a tough road due to the sheer number of lawyers with large inventory of baby powder lawsuits opposed in favor of the deal.

What are the solutions to the impasse? More billions.
April 25 2023 Update Talc plaintiffs have requested a judge to reject their Chapter 11 case filed by LTL Management LLC, a absurdly fabricated Johnson & Johnson subsidiary, insisting that the company is not financially distressed. LTL requested Chapter 11 to settle tens of thousands of claims that J&J’s baby products caused cancer. Is talc safe for skin. LTL was denied Chapter 11 in January. 3rd Circuit dismissed its first Chapter 11 case in January The court ruled that LTL was not eligible for bankruptcy relief because it failed to show financial stress.

The claimants contend that the 2nd Chapter 11 case is an abuse of the bankruptcy system and that it’s being conducted in bad faith. J&J says the bankruptcy settlement is backed by “significant support” from companies representing approximately 60,000 people who are claiming. It’s safe to say that plaintiffs’ lawyers and victims ‘ lawyers are not united over this $8.9 billion amount of settlement offered.

April 21, 2023 Update: A bankruptcy judge has ruled that Johnson & Johnson must face new lawsuits alleging that the company sold tainted baby powder causing cancer. While trials in the talc lawsuits have been suspended for a minimum period of 60 days and new lawsuits are able to be filed and lawyers can begin preparing their cases. Is talc safe for skin. Judges expressed skepticism about J&J’s ridiculous effort to revive its strategy with the second bankruptcy case.

April 13 2023 update: the major announcement is an $8.9 billion over the next 25 years offer for settlement. Lawyers representing cancer patients involved in the MDL collective action pledged to fight the settlement with Talc claimants. Why? They think it is not enough to pay for more than 70,000 cancer victims. Is talc safe for skin. The lawyers say that J&J could negotiate a greater settlement or even litigate individual claims in the event that the latest bankruptcy is thrown out.

There is a different group of lawyers that is not part of the top leadership in that class action. They have amassed hundreds of thousands of cases. They want to settle with what they believe is lower than what the victims should be paid. The argument they make is two-fold. The first is that they claim the settlement, which is about the equivalent of $100,000 per plaintiff is fair.

This argument isn’t easy to argue. But their second argument has more teeth: victims can not afford to wait any longer and need the money immediately.

April 12, 2023 Update: People are wondering if J&J could file for bankruptcy once more. The answer is complicated and confusing. Let’s try to clarify it in simple terms.
Johnson & Johnson asserts that bankruptcy is the only way to deal with both present and future lawsuits involving talc conclusively. It thinks it can get a lower rate when there is a bankruptcy component that applies pressure for a settlement. Is talc safe for skin. Moving past 400 years of American time, the business claims that bankruptcy benefits everyone by dispersing settlement payments more equitably and effectively than trial courts in which some litigants receive substantial awards while others receive nothing.

The main thrust of the 3rd Circuit decision was this is not a case – the profit-making company that has a subsidiary to take the legal liability and declare bankruptcy – Congress contemplated when drafting the Bankruptcy Code. But it also said that the subsidiary was not in financial trouble due to the fact that J&J offered unlimited financing.
Then J&J decided to go with the unlimited funding portion of the agreement and didn’t promise to offer unlimited funding for the litigation. The company says that its new financing agreements with its subsidiary address the concerns of the appellate court, while offering funds to pay claims. As if providing victims with less money would solve the underlying issue.

Lawyers representing cancer patients who do not agree with the agreement counter this argument by saying that it is a defense against legal nonsense by pointing out legal absurdity: J&J fraudulently transferred $50 billion in assets away from LTL Management to circumvent the appeals court’s previous decision. Hyperbole did not go unnoticed: victims’ lawyers call it the largest “fraudulent transaction that has occurred in United States history.”

Notwithstanding the legal mumbo jumbo, J&J does not really think that the bankruptcy will endure. However, it’s a means of trying to push this $8.9 billion settlement and keep the pressure on plaintiffs.

April 10 2023 Update Bloomberg is running an intriguing article on a new law within New Jersey that is shedding new light on litigation funding in the suit for class actions. Litigation funders Virage Capital Management and TRGP Capital invested in hundreds of claims against Johnson & Johnson (J&J) over talc products in exchange in exchange for a portion of winnings. J&J is now willing the payment of $8.9 billion to settle lawsuits.

The funders’ involvement is made public because of the New Jersey court rule requiring the release of certain details about outside funding backers. This rule is intended to address the rising calls for the regulation of lawsuit funders. J&J has to deal with more than 60,000 lawsuits when you take into account federal and state baby powder lawsuits. Third-party funding in mass tort claims has both pros and pros and. But there is no question that we are witnessing how third-party funding can level the playing field for individuals and big companies in court.

April 4 2023 Update: It is enjoyable to see the worm turning in this legal battle. J&J suffered another setback this week, when an appeals court in the Third Circuit denied J&J’s request to continue the automatic stay as J&J appeals a bankruptcy ruling to the U.S. Supreme Court. It has froze the cases of talcum powder in a number of years and prevented new lawsuits from arising ever since J&J initiated the controversial effort to spin the talc liability off into a bankrupt subsidiary more than one year in the past. Is talc safe for skin. When it was decided that the 3rd Circuit ruled that this bankruptcy was not legal a few months ago, the stay was lifted. J&J had hoped to have it stayed in place until hearing the SCOTUS appeal. The answer was no.
April 1st, 2023 Update: Johnson & Johnson announced it will appeal its 3rd Circuit bankruptcy loss to the U.S. Supreme Court last week. The odds that is that the Supreme Court is willing even to hear the appeal? Low.
March 16th, 2023 Update: with the bankruptcy stay fully lifted, the first new cases were filed and incorporated into the class action for talcum powder MDL in over one year. Seven new talc cases were included in the MDL over the last month, bringing the total number of cases that are pending to 37,522.

February 25 2023 Update The following information is available: A Congressmen from Tennessee is now requesting that authorities from the U.S. Government Accountability Office (GAO) begin an investigation to determine how much J&J talc products have cost the government over the decades.
Recently, in an open letter to the GAO, Rep. Steven Cohen (D-Ten.) in a recent letter to the GAO, Rep. Steven Cohen (D-Ten. J&J of failing to recognize the dangers of its talc products over decades while tax dollars were spent on treating people who suffered injuries from exposure to the products. The lawsuit comes just a few weeks after J&J’s major loss in the 3rd Circuit Court of Appeals.

Is talc safe for skin. J&J should begin to make reasonable settlement proposals for victims in order to put all of this behind. This is a disgrace to one of the greatest firms.

February 14 2023 Update: In the hearing held today at the hearing in New Jersey, U.S. Bankruptcy Judge Michael Kaplan announced his intention in light of his 3rd U.S. Circuit Court of Appeals ruling to dismiss the bankruptcy case.
