Going back to 400 years of American past, the company believes that bankruptcy is beneficial to all parties by distributing settlements more fairly and more efficiently than trial courts where litigants are awarded significant payouts, while others are left with nothing.
The basic tenet of the 3rd Circuit decision was this is not a case – one that makes a profit, but an affiliate to accept the legal liability and declare bankruptcy Congress had in mind when it came to drafting the Bankruptcy Code. However, the court also ruled that the subsidiary was not financially difficulty due to the fact that J&J promises unlimited funding.
So J&J jumped on the funding unlimited part of the deal and didn’t promise to provide unlimited funding for the litigation. The company says that its revised financing arrangements with its subsidiary address concerns of the appellate court, while offering claim payment funds. As if providing victims with less money would solve the overall issue.
Attorneys representing cancer patients who do not agree with the agreement counter this argument by saying that it is a defense against legal nonsense by pointing out legal absurdity: J&J fraudulently transferred $50 billion of assets away from LTL Management to circumvent the appeals court’s previous decision. The hyperbole wasn’t spared by the victims’ lawyers, who call this the biggest “fraudulent transaction in United States history.”

The involvement of the funders is public information due to a New Jersey court rule requiring the release of certain details about funders outside the state. The rules aim to address the growing calls for the regulation of litigation funders. J&J faces over 60,000 claims when you combine state and federal Baby Powder lawsuits. Third-party funding in mass tort claims is not without its pros and cons.
