What could solve the impasse? More billions.
April 25, 2023, Update Talc patients have requested a judge to reject their Chapter 11 case filed by LTL Management LLC, a ridiculously made-up Johnson & Johnson subsidiary, declaring that the company isn’t financially distressed. LTL requested Chapter 11 to settle tens of thousands of claims that J&J’s baby-powders caused cancer. Talc asbestos Johnson. LTL was denied Chapter 11 in January. 3rd Circuit dismissed its first Chapter 11 case in January, saying the company wasn’t eligible for bankruptcy relief because it was unable to demonstrate financial distress.
The claimants assert that the 2nd Chapter 11 case is an fraud on the bankruptcy system, and that the case is being handled in bad faith. J&J asserts that the bankruptcy settlement has “significant support” from companies representing about 60,000 potential people who are claiming. It is fair to say plaintiffs’ lawyers and victims ‘ lawyers are not united over what they believe is an $8.9 billion settlement offer.
April 21st, 2023 Update A bankruptcy judge has ruled that Johnson & Johnson must face new lawsuits claiming that the company sold baby powder that was contaminated and causing cancer. The lawyers say that J&J could negotiate a greater settlement or even litigate individual claims in the event that the latest bankruptcy is thrown out.
However, there is a second lawyer group that isn’t part of the top leadership in this class action. The lawyers collectively have accumulated many thousands of cases. This group wants to settle the case now with what they believe is less than the victims deserve. Their argument is twofold. They argue that the settlement, which is about 100,000 dollars per plaintiff is fair.
It’s a difficult argument to make. However, their second argument has more force: victims should be no longer patient and demand their money today.
April 12 2023 Update: Some people are seeking out how J&J is able to file for bankruptcy again. The answer is complicated and confusing. However, let’s attempt to explain it in simple terms.
Johnson & Johnson asserts that bankruptcy is the only means to deal with both present and future talc lawsuits conclusively. It believes that it will be less expensive if there is a bankruptcy element that creates pressure to settle. Talc asbestos Johnson. In a quest to cover hundreds of years of American history, the company believes that bankruptcy is beneficial to all parties by distributing settlements more fairly and effectively than trial courts, where some litigants receive significant settlements while others get nothing.
The basic tenet of this 3rd Circuit decision was this is not a case – an enterprise that is profitable, forming an affiliate to accept the legal responsibility and declare bankruptcy Congress contemplated when drafting the Bankruptcy Code. But it also said that the entity was financially crisis because J&J offered unlimited financing.
Then J&J took advantage of the unlimited funding aspect of the holding and didn’t make any promises to fund unlimited litigation. The company claims that revised financing arrangements with its subsidiary address concerns of the appeals court while offering claim payment funds. In the hope that offering victims less money will solve the overall issue.
Lawyers representing cancer victims who are against the agreement argue this argument by saying that it is countering legal nonsense legal absurdity: J&J fraudulently transferred $50 billion of assets from LTL Management to circumvent the appeals court’s earlier ruling. Hyperbole did not go unnoticed the lawyers representing victims call it the largest “fraudulent transaction in United States history.”
In spite of the legal jargon, J&J does not really think this bankruptcy will survive. But it is a way of pushing this $8.9 billion settlement and keep pressure on plaintiffs.
April 10, 2023 Update Bloomberg has an interesting article on a new law that has been passed in New Jersey that is shedding new light on the funding of litigation in the plaintiffs in the class action. Funders for litigation Virage Capital Management and TRGP Capital invested in hundreds of claims against Johnson & Johnson (J&J) concerning talc products in exchange for a portion of any profits. J&J has now offered the payment of $8.9 billion to settle any lawsuits.
The involvement of funders is public information due to a New Jersey court rule requiring the release of certain details about outside funding backers. The rules aim to tackle the growing demands for the regulation of lawsuit funders. J&J faces over 60,000 claims when you add up state and federal infant powder litigation. Third-party funding of mass tort cases has its pros and cons. But there is no question that we are seeing how third-party financing can help level the playing field between individuals as well as large corporations in court.
April 4, 2023 Update: It is fun to watch the worm turning in this legal battle. J&J took another hit this week, when it was found that the Third Circuit denied J&J’s request to keep the automatic stay in place in the meantime that J&J appeals an appeal in the U.S. Supreme Court. Automatic stays have froze hundreds of cases involving talcum powder and prevented new lawsuits from being filed ever since J&J initiated the controversial effort to spin the talc liabilities off into a bankrupt company over one year in the past. Talc asbestos Johnson. After the 3rd Circuit ruled that this bankruptcy was not valid only a few months back, the stay was lifted. J&J wanted to see it stayed in place until hearing the SCOTUS appeal. But, no.

February 25 2023 Update The following information is available: A Congressmen from Tennessee is now requesting that The U.S. Government Accountability Office (GAO) begin an investigation to determine how much J&J product containing talc has cost the government over the years.
Recently, in an open letter to the GAO, Rep. Steven Cohen (D-Ten.) in a recent letter to the GAO, Rep. Steven Cohen (D-Ten. J&J of ignoring the risks of its talc product for years while tax dollars were spent treating those injured by exposure to the products. The demand comes just weeks after J&J’s loss to the 3rd Circuit Court of Appeals.
